My husband has a home loan, that was sold to BAC. They lost our first payment. The payment was Oct 09. We have been in constant contact with them to resolve this error of theirs. We have given them all the documents to prove they have the payment and have always had it. Our credit is being hit every month, it is emotionally draining. My wife went into the local B of A to discuss this problem. She is not on the loan, but the manager Brenda was willing to help her. My wife has been in 3 more times to check the status, and was helped by 3 different employees of this bank. As of April 20th, the manager Brenda said they would no longer help my wife with this loan since she was not on the account. When Brenda was informed that she and others have been helpful, she said no, she had never helped my wife. Brenda claims to not have helped my wife and claims my wife led her and all other employees on to believe she was on the loan. Now we find out that a person at BAC has accidentally marked our dispute as "invalid", which means our dispute is no good even though they have all the information. This company has started the acceleration process and is going to proceed to try to foreclose on our home. Pure incompetence is what we have been dealing with. My wife is so stressed out, and frustrated with this bank. Every time you call you get someone from another country, and they refuse to listen, and transfer you to someone who can comprehend English and help.

Our 1099 for 2009 did not show the interest for the payment we made. So... $911 dollars in interest was not on the 1099, so will it be on this years?

Hello I have been in a foreclosure suit against BAC here in Brevard County Florida for the past 18 months . I was one of those fraudulant foreclosures by BAC attorney David J stern in Orlando Fl. I hired an attorney and we have been trying to get answers from BAC . My lawyer sent several notices to respond and produce but they never did on several times in the past 18 months so the court dismissed on 02/21,2011 the foreclosure case against me and awarded me my attorney fees . I paid over $8500.00 and the Unhorrible Judge Lawrence V. Johnston of Brevard court system awared me only $3500.00 out of $8500.00 . So I ask how is this justice when I was wrongly foreclosed on to begin with . Before all this took place I tried to get a remodification and they told me no I had to be two months behind and then it went to four months so I said the hell with that and sent in my payment . They sent my payment back and filed a foreclosure on me . So here I sit back at square one with less money and the possiblity of losing my home because they want remodify. And I am the pround owener of a foreclosure on my credit and it hasn't even happened yet . How can this be. I have three small kids and own my own business trying to teach my kids right from wrong and to put trust and faith in the couret system and the goverment while they are screwing us over at the same time . Enough is enough people we have to stand up in masss numbers to show washington who runs this country . This is our country for the people by the people or has everyone forgotten that . Watch the news . This is what is happening over in Liybia and Seirria the people are tired of being raped by the government

for approximatly 25 months i have been trying to get a modification on my home i have made all payments i was asked to. last week i recieved a notice of intent to accelerate which means they plan on forclosing on my property. after calling them upon reciept of this notice i come to find out that my application for modification was declined in june for the hamp program i am being told and have been told seems like forever that theyre reviewing my application and i shoudl call back in 2 weeks to check the status. ive bee calling back every 2 weeks for over a yr and like many otheres get nothing but a run around. example i called to get a copy of all my records that they have so i can check to be sure these incompitent people have the correct items and get told by the representative that they cannot do that and i need to call another department when they give me the number it is the one i had called them on. it is amazing that the government continues to aid this company instead of shutting these thieves down i am at wits end here and im considering a short sale now before they procede with the foreclosure process so i can at least save some of the dignity i have left i agree with the person above who mentioned a national class action siut against bank of america and its subsidieries

include all the above and add the fact that we were in the trial program and was then told we did not need to send in any payments only ss paperwork and bank statements to a fax number so we did so then we got a letter less than 2 weeks after that we were sent a letter that we were out of the program so I called and the first lady said that there was alot of people that work there dont know what they are doing and should not have told us that she would send it back thru and not to do anything that they would contact us well they never did so at this point we got a letter saying we will have to leave our house

We are looking for advice and help in dealing with Bank of America Home Loans.

We started in Dec of 2009 applying for a loan modification. Till this day we still have not even been approved for a trial plan.

Our mortgage was with Countrywide, which we had no problems with. Bank of America then took over and the nightmare began.


BOA took it upon themselves to start an escrow account on our mortgage. We have never had a escrow account when we were with Countrywide, we always paid our own taxes.

BOA paid property taxes on a parcel that is not our mortgaged property.


We informed them of this mistake, checked the mortgage papers to make sure there was not an error, which there was not the correct parcel number in on the mortgage.


They paid on a commercial piece of property that has been paid for for 60 years and has never had a mortgage. The taxes on this piece of property are $8,000.

We have a 100x200 lot with a modular home on it. How they can possibly think that the taxes would be $8,000 is beyond belief. But being told this time and time again, and sending them the correct parcel numbers, which as stated are correct on the mortgage, they still can not figure it out.


I called and explained this to them, sent tax papers showing the correct property description/ID number. They said it would have to be reviewed.


They then raised our monthly payment from $489 to $1,500. Many more phone calls, being transferred from department to department and still getting no where.

In the meantime we are still trying to get the loan modification done until they can get this other mess corrected.


Finally in March( 3 months after my initial phone call) they fed ex'ed the paper work which we filled out and sent back right away.

We were told it would take 30 to 45 days to be processed. It has now been 9 months. We call every other week and get sent to the modification department, then transferred to the status department, No one knows anything.


There has been nothing done since July. Every time I call they say they are putting a rush on it to escilate it through.

I have gone to the local Bank of America branch in the hopes that maybe I could find one "real person" to work with that could straighten this huge mess up.

All she was able to do was call the same list of phone numbers that I have been calling.

She was told the same thing they have been telling me, that they will put it on a rush escilation and to check back in two weeks.

She told me as long as I am still making my payment, which we have been doing but only the $489 as our mortgage was written for we would be fine.


I have never dealt with such an incompetant company in my life. It is like they are just playing games with peoples lives and homes. You can never get the same person, you just keep getting transferred from department to department and no one knows anything. It is just a big circle and you end up right back where you started. No where.

In November we received papers saying that they were going to start foreclosure, I went down to the office and Jill told me that is what they do when you are behind on payments.

We are not behind on payments, We have never missed a payment.But I am only paying the $489 as that is all that we owe...

I am not paying them the $2,000 they are asking for because they have everything wrong, they have changed my entire mortgage agreement.


Seriously could they mistakenly go pay Mc Donalds taxes and put that on my Mortgage then when I refuse to pay take my home away.

They can not charge my mortgage property taxes that are not my mortgaged property.

Then to top it off they went and paid taxes on that same commercial piece raising my escrow to $16,000.


On December 6th we were sent foreclosure papers from a Tripp and Tripp law firm out of Farmington Hills.

We are at our wits end, we have made at least a 100 calls over the past year, we have gone round and round with this company and can get no where.


The final straw now is that I went down to pay my December payment of $489 and they are refusing to accept my payment at all.

With them refusing to accept my payment I guess they are going to try to steal my home.


How can a company operate this way? How can they make someones life hell for a year and do nothing to help you?



They just do not understand what they are doing is hurting other people, how stressful is it to deal with this for a year. This has been an absolute nightmare.



Please help us, we do not know what else to do.

We have done nothing wrong but make our mortgage payment every month and now they are going to take our home away.

I tried to get a remodification on my home because my hours were cut short. while going this mess I since then had married. once again I had to submit my wifes income over and over. finally after months of negotiations. I had to come up with my first remodification payment of 1306.00 they saved me a whopping 21.00 dollars off my original payment of 1327.00 and this new payment had to be in before the sheriffs auction with was about 5 days away. they put me on the spot. more or less it was accept our new offer or the house goes into auction.

I want a class action national suit filed against BOA just like the one that was filed by the Texas home owners justice League.
Please someone help the Americans that are being raked over the coals who want to keep their home and spend thousands of hours on the phone with their disorganized and neglectful crew of customer service people who admittedly have no training and " I am just reading from a script mame" when the homeowners are doing everything and they do nothing yet they got bailed out by our TARP money.
