Case Details:
I had a primary checking account, then I opened up a savings account and a money market account. When I opened up the savings and money market which had over 10K in them, I signed a form at time of account opening linking them all together and each one would pull from the other if one got low. I didn't worry about my checking getting low since I knew it was linked to my savings which had more than enough without ever pulling from the money market. My next bank statement came and I had 5 NSF charges, I exploded. I called into BOA and they tell me rudely that the accounts were never linked. I explained the form I signed and had a copy along with my account documents. They refused to reverse the fees but spent over an hour on the phone linking them together like it was suppossed to in the beginning. Next statement came, I had 7 NSF charges, again, I phoned in and the same thing happened, I was told they never linked my accounts. This kept happening for the next 3 months, they knew I had opened these accounts in another state that was difficult for me to get to but they insisted that I had to go back to the original branch and straigten this out. I phoned the original branch and spoke with the lady who opened these accounts and she remembered. She said that she did everything via computer as was policy and the form was sent via email. It was all there and documented. In the end, They refunded some of my NSF charges but not all. Now they are at it again, except I no longer have a money market. They assessed 2 NSF charges in 3 days when their policy is one and after 5 days they charge you an extended fee. The reps are so RUDE and hateful and they all same the same thing. They babble excuses and federal guidelines that no one could argue with because you would have to be a lawyer and financial master to know these things. I know that what they are telling me is probably not the truth but what can you do? They should have never charged me one NSF. I have never written a check without the money in the bank to cover it. It's just that simple. I have made deposits and called the automated service line to make sure the deposit posted, then I would make charges which would later cause an NSF all because they said the deposit reflected on the automated system before it was posted on the books. They always have an excuse and you can't argue with them. I dispise this bank and have lost so much money.

1) Bank statements and online banking tools available for customer use do not support BOA new method of processing these charges. Even when multiple NSF charges have been assessed statements and online banking may never show a negative balance. *****Customers have no way of seeing when these pending charges are presented to BOA, especially when checks are presented. Bank of America could claim they came through in whatever order they choose, not that they do, because the customer will never be privy to this information*****
2) NSF Fee will be charged if sufficient deposits are not available to cover pending authorization, even if funds are present at the time when transaction is posted. CONTRADICTION: NSF Fee will also be charged if funds are not available at time transaction is posted, EVEN if funds WERE present when items was originally presented. SO BOA CAN HAVE THEIR CAKE AND EAT IT TOO!!! They use the intraday overdraft practice to attack pending authorizations based on date/time presented and then post transactions not by date/time but from largest to smallest to cause additional opportunities to claim NSF fees for nsf for posted transaction.
3) Practice often results in multiple NSF fees for a single day (single deposit which didn't get posted prior to transactions in question), yet their decisioning system for NSF fee reversal automagically excludes victims of these types of incidents because of the # of fees involved.
4.) Processed Debits and Checks before deposits that were done on the same say triggering excessive fees to be charged to my account.

i have paid over 6k in nsf for reasons that they cash the largest pmt on debit card even though the smaller pmts were maid the days prior and still got nsf for all the smaller chages when there were funds in the acct.. now all banks do this and if it is illigal i want to do somthing about it with bofa wells and chase

As previous customers have noted i have found myself being charged continually for not having enough money in my account, due to the fact i had been sold the wrong account, i am a single mom working cheque to cheque to make ends meet, i had noticed my money not going as far as it had been and so checked my account to audit my outgoings and income to see where i could be going wrong, turns out the BOA had been taking money from my account on a weekly/daily basis without my consent or informing me of this, some weeks i was being paid and they were holding my cheque for 10 days resulting in late fees and bank charges on bill payments i had set up, this has caused sever hardship for not only myself but my child, when i contacted BOA they were not in the least bit interested in my plight and so i have had no option but to join a class action lawsuit to try to reclaim some or all of the money stolen from me over the past year, at the last count i have totalled the theft to be in the region of $5000.

First on 08/12/09 I had a bill hit my account for $105.00 the company that process payments also charge a seperate fee of $4.95 for processing payments. At the time I only had $9.60 in my account, instead of them using that to pay the $4.95 of course they charged me for both saying they use the larger amount first.
Second on 11/03 I looked at my statement and I was in the negative for $13.19 plus a check came in for $54.95. I went on my lunch break and deposited $69.00. My receipt said that my account was no longer in the negative. The next day I checked on my account and they assessed me a fee after business hours apparently as the nsf was dated for 11/03 to cover themselves of course for$35.00( for the initial negative balance of $13.19). I still had $55.81 but instead of covering my check when I deposited the money, they kept it, added their fee that night and subtracted it from my deposit which caused the check to bounce again, which initiated another $35.00 fee that the bank charged. Everytime I turn around I am paying the bank$35 to $105.00 for bogus fees. It is costing me more to keep this account than it being beneficial to me. It is time that someone put a stop to this. The customer service reps are no help. I went to speak with someone in the bank and she did not know what she was talking about reading my transactions incorrectly I had to tell her what type of transaction each one was. I am tired of these big corps thinking that they can run over the little people as I am the single parent of 4 children and I need all of my money to support my family.

In July I was on a business trip and they hotel charged both my card and the business card causing me to be overdraft for a couple hours. BOA charged me over $200 in fees and were unwilling to refund more then half after hours of talking to supervisors. I decided to change banks after almost ten years. I asked to have the overdraft protection removed "opt out". They said that was not an option. They said they could link to my savings and if no funds were available there would be no charges. I found a new bank and requested my direct deposits be changed. While waiting for the last DD to change I was charged another $200 in OD fees for autopay items that were requested changed had not been updated yet. I had called BOA back in late September once I heard they now offered an actual opt out choice. I was told today that I never fully opted out, just switched to the savings link option. I was also told by a supervisor that even once you are opted out of OD protection your account is still accessed fees even when they return the charge because they still have to review the account to decide whether to pay. So whether you are opted out or not, whether the item is paid or not you are charged a $35 fee even if it is a $5 charge. THEIVES

from the dates of 08/20/08 to 10/22/09 I have been charged with 79+ overdraft charges. Some of which were from my own doing, but others were due to the bank deducting from high to low, others were because of crazy reasons even I have yet to understand. As soon as we can afford to switch banks we plan on it, but we live paycheck to paycheck and as of now BofA is eating it all up as much as they can and as often as they can.

Two issues:
I was charged four $35.00 fees because a merchant overauthorized (duplicate authorizations) which reduced my available funds more than they should have been.
There were FOUR fees charged because BOA posted the 'offending' transactions in an order of 'highest to lowest' dollar amount, regardless of the actual time the transaction took place.
(I am interested in participating in a class action lawsuit, if one exists or is being considered)

I went to my computer on the night before I was hit with 5 overdraft fees on the next day. On the day I was hit with these fees, I checked and there was no sign of negative actions on my account. At night I was told that I had overdrafted when I went to check on my balance. I called BOA and they said you couldnt see it on there online screen. I checked the next day and also my account shows no negative action. It was all internal but didnt show on the online banking screen. What a Rip off!! I would love to join a class action case against BOA. My only advice is to call the FTC and tell them what happened to you.

I am so fed up. I checked my balance all of this week - first I had almost $90. I spent $40 on groceries. I underestimated and acted like I had $40 left (leaving an almost $10 buffer). I check my online balance at least twice daily. I spend $22 at a restaurant. So, okay, I have about $18 (with the almost $10 buffer). Then I go out for a beer and spend $10.60 and then get cat food the next day. Then suddenly I check my balance today and it's negative $41, from a $35 overdraft fee and then two transactions (the beer and the cat food) totalling $6.08.
$6.08!!
And I have been checking my online balance and keeping track for the past week. This is not fair!
I even got paid for my writing jobs through Paypal, and just withdrew everything this morning when my balance was still at $18. I'm transferring over $120 into my bank account and now it's going to disappear into bank charges. I need food, I'm on my period - what the hell is wrong with these bastards? This makes absolutely NO sense whatsoever. On top of this I have fallen ill with the flu. I don't know what to do.

Due to the "rearrangement" of my online statement has occurred over $210 in overdraft fees EVEN THOUGH my statement shows AND has shown a positive balance. Trying to clear this up with a representative, they credit me $35 (A shut-up courtesy) for the ORIGINAL overdraft fee that started it all but does not help in the reoccurring fees that began to stack-up in 5 DAYS!!!! Although my "online statement" shows I was in the "positive" they claim that due to their own knowledge and what should have been mine (according to the representative) they assessed more overdraft fees on top of those and I should have been keeping a "written balance" of my account. According to my charges, I only went negative even WITH the original NSF would have only been $8.34 and that would be the TWO SMALLEST transactions. I check my account 3 times a day. Check my login with B of A and still I am surprised and CONFUSED with my account. This has not been the first time and nor will it be the last. Apparently the NEW CLAUSE since March of 2008 is (I cannot quote but was told by a representative) that if B Of A's statement shows a negative amount then they assess your NSF EVEN if YOUR Online statement shows you in the positive.
I keep thinking of that STUPID COMMERCIAL where the two guys are at a Starbucks and keep buying things to see how fast the transactions show-up in their online statement. Giving the consumer this "FALSE SECURITY" that you don't NEED to keep a WRITTEN check registry, that it is all online now. "Save Time, Save Money. Bank Of America". "Go Paperless. Receive your account statements online-sorted, filed and secure." Although you should be keeping a "Paper account of all of your transactions. I have even signed-up for all of the alerts but they assess the fees first and then send you an alert when it is too late.

The practice of BOA rearranging my transactions has gotten me so far behind in my bills and I can't even buy gas to get to work or food to feed my family. Last night when I went to bed my account showed a positive balance of $58.00 and some change. When I woke up to see if my direct deposit had posted, it had. However I had 9 transactions that were in the red. All transactions that had cleared the night before, were rearranged and in the red. The same thing happened a month ago and when I called customer service, I was told that I should pay closer attention to my account and the couldn't reverse the NSF charges because the charges hadn't appeared on the account yet. I knew they would show up the next day and so did she. Needless to say, they didn't get reversed. I always get the same excuse. "Our customers have told us that they would rather larger amounts come out first, so that mortgages and car payments are deducted first." First of all, they never asked me what I wanted and second, they always go ahead and pay all the other checks or debits anyway. Why can't they just let them pay out in order. If the account is a little short to cover the mortgage check, why can't they just cover that one item and charge me the $35,00? No, they want to take MY hard earned money!!!!

I was charged an overdraft fee when I had a positive balance becuase a pending transaction put my account in the negative range. I made a deposit the next morning and that night along with my deposit an Overdraft fee posted. Their definition of an "overdraft fee" states that a fee will be charged when the bannk "PAYS" something that results in a negative balance. If it is pending it hasn't been paid yet. I called customer service and was told the fee could not be refunded. I am SO tired of big corporations taking my hard earned money that should be going to gassing my car or putting food on the table for my family!

I have worked for BOA as a Community Bank Executive and managed 2 banking centers. I was asked to leave because of NSF charges that I refunded. The policy at the time I was employed was that as a banking center we could NOT refund more than 20% of those who asked for refunds. Those refunds were ran through a computer system and gave an automated answer. I had the authority to override the system and give refunds if there was an unexplained reason for the override. This system monitors those people who override the system. Because I had over 20% refunds, I recieved verbal and written warnings and then terminated all on the same day. (This was for legit customers and NOT for friends or family or anything that was against policy or procedures!!!)
They just ased a lLoan Officer I hired to retire last month because he had NO loans for a quarter. Times are hard for BOA right now. NSF's are the biggest source of income to most of their banking centers.

I checked my bank statment and everything had gone through on my account .I wrote a check to buy food knowing i would be charged a fee but i was out of food and knew i was getting paid soon i was carefull not to spend more than i could afford plus the fee . BOA restrucred my account to cause me to have 5 nsf fees instead of 1 . How can they take something that has already posted and resubmit it. I have thousands in nsf fees in the last two years.

So far this year I know I have accrued more than 10 NSF charges of $35. I make sure to make a deposit before using my card, but it never shows up until after I've already used it and overdrafted my account. The last time I called I was told that I had a history of overdrafts so there was nothing they could do to help me. They are conforming their rules to cheat you out of your hard earned money. Bank of America, like most other banks, has reported losses this year, so they're doing anything they can to make up for their short falls.

I have worked for bank of america for 6 years this October. I have had several hundred dollars in overdraft fees in May and June alone. On June 10th, 2008 just as an example, I deposited money to cover pending transactions after looking online. I had a negative bal of around 53.00. I went to deposit 63.99 to give me a positive balance. Then they charged me 3 overdraft fees before posting my pending transactions resulting in more overdraft fees. I have started printing from my online banking to show examples of contradicting fees. On May 28th I had an approximate balance of 92.00. I went to Mcdonalds on that day and spent 11.00. On the 29th I did have a transaction for insurance go through for 99.00 they posted that 1st before the Mcdonalds to result in me receiving 2 overdraft fees. I should have only had 1. I have had probably over 1000.00 in overdraft fees in 2008 alone.
