Case Summary: In October of 2007, California State Automobile Association Inter-Insurance Bureau (CSAA) used a report prepared by CCC Information Services to establish the actual cash value of a vehicle deemed a total loss by CSAA. The report violates several key provisions of the California Fair Claims Settlement Practices Regulations, including the fiduciary duty of CSAA to the insured. To the extent that these unfair claims practices are frequent or constitute a general business practice, CSAA and other insurers who use CCC reports also violates not just California Insurance Code §790.03(h) but also California and federal antitrust laws.
