Case Summary: Long Beach, California, has enacted several ordinances that severely limits all registered sex offenders living, working, and visiting the city. The ordinances are covered under Title 9, Chapter 9.66 of the Long Beach Municipal Code, which was enacted by a unanimous vote of the City Council and signed into law on March 18, 2008. Many of these ordinances not only violate the California Constitution, but the First, Fourth, Fifth, Eighth, and Fourteenth Amendments, as well as the Ex Post Facto clause of the United States Constitution. Per 9.66. While residency laws have routinely been upheld in other jurisdictions around the country, California jurisprudence would dictate that such laws should easily be dismissed. The more people that sign up, the more likely that affordable, yet competent, representation can be obtained.
