I saw an article that your firm currently has a class action lawsuit against amazon. I was using checkout by amazon in which I was selling items to relatives. Used their platform so that I could have them pay for the items with credit cards and they could earn 5x rewards on their credit cards. Amazon closed my account back in November 1, 2012 and has been holding about $15,000 of my funds since. Only thing I can get from them is they are claiming fraud (nothing specific) and withholding my funds permanently. All transactions were conducted amongst family members, all credit cards paid in full, only one out money currently is me. So I have no idea what "fraud" they are claiming.

they suspended my account right in the middle of making $6000 to $7000 a day in sells. while my competitors were allowed

to continue doing business the same way as I was with the same add. I estimtae my loses at From $40,000 to at least $1000,000 in a two week period. They claim I had to ship in two days on a product that was a pre-order not shippable until 30 days later. I did over $60,000.00 in sells in about 7days when they suspended my account , put a hold on my funds for products I had already shipped and was expecting payment for, all while my competitors, who were also taking pre-orders are allowed to continue doing business and whose accounts were not interupted for not shipping a pre-order in 2 days which was advertised to be shipped in 30 days. This is wrong and being a minority business person May be very discriminatory. There has not been an explaination, just a lot of monetary damage to my business on Amazons behalf.

An Amazon sales rep. contact me about the Amazon FBA program. He persuaded us to enroll because he said if we have the best price, reputation and are in the FBA program, then we will be the merchant listed in the "buy box" for those items (on the top level page). We spent a great deal of time analyzing the costs, learning how to manage our shipments, and teaching our warehouse staff how to handle the special instructions and paperwork involved in handling these orders. After shipping our inventory to Amazon, we discovered that merchants selling BOOKS (the primary item we sell) do not quality for the buy box (only amazon get that privileged). We were lied to. So now our inventory is warehoused by Amazon and we pay for it month-to-month but it doesn't move because they don't promote it on their site as promised even for items where our prices is $28 and Amazon is selling it for $44! I was successfully selling on Amazon for over a year, when this happened. A peer - another book seller - has purchased one of my books. I shipped it by Priority Mail in a cardboard box, with Signature Confirmation, i.e. paid extra to insure safe delivery. This seller then lied about the book condition, left me a negative feedback and filed A-Z claim. I promptly issued a refund so that the claim was removed from my account. However he never returned the book. I ended up losing both cost of the book - about $30 total - and the book itself. On top of that, my account was suspended permanently as I was a small seller with only about 70 or so feedbacks. Seller Support stated that the suspension was permanent. I want to re-instate my good name on that site even though it sucks.

The way Amazon freezes people's disbursements is illegal in all but 2 states. They have held $1,512 of mine since October! While I am not a seller, I have been an amazon affiliate that has aggressively marketed amazon on my sites. Since I signed up I had averaged 300-500 / month in referral fees. Due to some error on Amazon they had not deposited 500+ in referral fees into my account. They asked me to verify my account information on 10/2/12. On 10/9/12 I receive the message below with no prior warning. I call their customer service number to inquire as to why my account was closed and my funds were frozen. I am informed that the phone associate can not speak to me about this, nor is there anyone at Amazon that can. The person on the phone said that they will update my account and someone "should" get back to me. I have never heard anything from Amazon, not even an e-mail confirming that I called to question the issue.

Something needs to be done about these business procedures of Amazon. I did around $800.00 the month and a 1/2 I was on Amazon. I had already ordered lots more product to have in stock to put on Amazon and I can not get my money back. Amazon is holding around $450.00 on my money and plus the money I spent on Inventory is around $800.00 more. I am out around $1250.00 because of this. What can we do to stop this?

I began selling on Amazon in June of 2011.
I started by selling books. Seeing that I couldn't make too much money from selling books, I then began selling electronics - mainly Plantronics & a Philips DVD player. Everything was fine in 2011.
In 2012, I started selling video games. I then ventured into selling DVD sets such as The Wire, Big Bang Theory, Dexter, etc.
Once I started selling DVD sets - it was like I had hit a gold mine! I went from just under $2,000 in profit per month, to sales of $20,000 per month & profited about $5k per month.
All of my DVD sets were authentic - no fakes at all.
I had 125 customers leave me feedback & I never got anything less than 5 stars.
in July of 2012, Amazon suspended my account & held my funds. I figured this was because I began selling so much so quickly & they just wanted to make sure their customers were receiving their orders. I filled out all the questions they gave me & uploaded all of my tracking numbers. After 30 days, my money was released & I continued selling.
2 weeks after I was reinstated, they suspended my account again. Mind you, they never told me why. I called Amazon & was told to answer all their questions again & in explicit detail. I did. 30 days later I was reinstated.
2 weeks after that - I was suspended a 3rd time. On September 28, 2012 I received an email from Amazon stating that my account has been revoked & my selling privileges removed. I almost peed my pants & had a heart attack!
I called Amazon Customer service & the lady I spoke to said she didn't see any notes in the system as to why it was closed & that my "Customer Metrics" are "stellar". She was dumbfounded & told me to email Seller Support. I did. I begged on my hands & knees to be reinstated. 24 hours later I got a canned reply basically saying I am SOL.
This time Amazon was holding $1,000 of my money. I cancelled all sales that I hadn't yet shipped & refunded the money. No point in mailing inventory if I wasn't going to get paid for it. That's why my Cancellation Rate is so high right now. Friday morning it was at 0%.

Amazon won't tell me what I've done wrong & from what I can see - I've done nothing wrong.
I busted my ass working 7 days a week for 7 hours a day for the last year of my life. I put up with bullying customers & always gave the customers what they wanted. I sent a personalized email after every order received with a personal thank you to the buyer. I would think Amazon would want me as an asset to their company?!?

Now I am SOL - Amazon won't email me back & my selling privileges have been removed forever. I know I can build a ghost account, but after a year of busting my ass everyday for the one that was just revoked - I'm not sure I have the energy to build all that back up again. I am the only income for me & I just lost that income. Let alone the fact that I have thousands of dollars in inventory sitting here AND Amazon is holding $1,000 of my money.

Completely absurd & I am actually heart-broken.

I opened a sellers account in April of 2012. Just like many others here I was contacted by Amazon via email saying my account was "suspended". I sent in all of the documentation to prove that I was an authorized distributor for the products that I sold and again just like everyone else, they closed me down. All of my order were on time and only had 2 complaints, 1 was a crazy woman who I know tampered with the product. Never the less when they closed the account, I knew that there was a 90 day hold according to their contract. Here is the problem. During that 90 day hold, they shut down all access to my seller account. I had no way to find out what fees were being assessed to my account and what my balance was. In the interum, there were 3 A-Z claims which Amazon handled by refunding the customer in full without my authorization. Besides this, they refunded without having the product sent back to me and in 2 instances, they refunded for one product that there was no issue with. I contacted the buyers via email and spoke to one of them who claimed that Amazon told her she did not have to return the product. I have saved all correspondance with the customers whom I have email access to. It has now been over 90 days. Amazon sent me an email that stated my funds were released on August 23rd, 2012. Today is September 7th and still no funds. I have been emailing them for the last 8 days 3 emails a day and no response. Not even a "hey, we are keeping your money because!" I contacted the Attorney General and received a file number. I was also told there are hundreds of complaints like this. This is outright fraud and contract violation. There is no way to speak to any one only by email and no one responds. I am sure that there is a great case here and I believe that now Amazon owes for damages that it has cost me due to paying for all shipping and for product that I had to pay for to sell on Amazon.

Amazon has a long history of class actions against it and I have been ripped off again by this company; I went into a store and bought a $100.00 non-refundable Amazon pre-paid debit card. I then went online at Amazon and bought several items with the Amazon pre-paid debit card. My order went though no problem and I received email receipt conformation that the item would be shipped soon. The next day Amazon locked me out of my Amazon account online. Calling and email to them proved totally worthless except that they said over the phone that the account was frozen and that they won’t be sending my order. It’s very important to realize that once Amazon locks you out, you have a worthless $100 Amazon pre-paid gift card that can’t be returned to the store nor used on any account with Amazon (because they have the number from the previous order) nor anywhere else. Amazon has my $100 at this point and won’t ship anything using this card under any account or circumstances. That’s how they steal money from me and other consumers. I want my $100 back now.

Even during the day of the appeal, I still kept my word to customers and shipped product. Amazon closed my account 90 days. I'm unable to even attend to returns. Amazon owes me over $48,000 in funds for product shipped. I had over 4,000 items in fullfillment . I have to do a removal order on items at a cost of 99 cents storage fee and 50 cents per item to return wich will cost me over 8,000 to get my items back. If i was going to leave product
for 90 days cost would be over 12,000 . The rule is wrong I believe amazon does this because most sellers cant afford to get there product back and amazon sells on there website Amazon wholesale items.

I have seen several of my products that i own and sell with my brand in there store. I believe when you ship items to fulfillment and you send 100 items but only 90 show up there are taking product
and putting in there store and i have the proof.

I actively sold on Amazon in a specialized materials market for 29 months. My lowest months past the first six months was $20k with peaks over $50k. My feedback was never less than 98% for the year and lifetime was 98%, averaging one negative feedback once a quarter. Positive feedback was still being received nearly three weeks after the ban was begun.

Suddenly, I was accused fraud and price fixing and banned. No facts nor proof were provided. The appeal was decided before it was even submitted.

Even during the day of the appeal, I still kept my word to customers and shipped product. Amazon closed my account such I'm unable to even attend to returns. Amazon owes me over $1900 in funds for product shipped.

Their actions have cost me approximately $250,000 in sales for 2012 based on total sales of $450,000 in 2011.

I got up this morning to check and see if the disbursement was ready to be released to my checking account. There was suppose to be 356.80 when I logged in and checked Amazon had only released 283.00 and some change. I contacted amazon and they told me since I did not confirm shipment until on June 4 they were waiting two weeks before letting me have the rest of my money. Well the suppviosor was no help. Told me she didn't care if I had a family and I did not have any food to put on the table for my family. I send an email satin that they had better have ALL my money in my bank account in the morning. Well I get an email saying that they are awaiting another three weeks before releasing my full funds. This is NOT THE FIRST PROBLEM I HAD WITH THEM. I think it's time either the law steps in or we have a class action lawsuit against these people. I don't know about the rest of the complainers but I'm darn tired of these big name companies stealing from people like us.

Started selling on Amazon because I had a large collection of dolls that were worth a good chunk of change and My 10 year old basset required a very expensive bladder surgery. I sold dolls for about two weeks before there was ever an issue. Then one day I get a message stating that the item was not new in box and the buyer wanted a refund...the item was listed as used, and noted as so in the description as well as the category. There was no way to not know you were buying used...you have to click the category to view the used ones... Because I had read all the mumbo jumbo amazon requires you to read I knew I must honor a return no matter what. but I was informed that because she sent the items back highly damaged (she sent back a doll that was dirty and broke and I sent her a pretty much brand new doll that had only been used for display.) I was charging 20% restocking fee and less shipping. I emailed amazon that the item was not what i shipped and they sent me a message back, saying to just refund the money to make sure I don't get a A-Z claim against me because I could lose my account. I refunded her minus shipping and 20% even against my better judgement. Amazon then refunded her through A-Z the next day when she filed a claim even after I had given her a refund. They will not help me at all to recover the first or second refund. Amazon allows scam artist to thrive like kings on their site..... F*$% You Amazon!

Their Forums are stuffed with bullies. One bully and I had a disagreement, following which he purchased my book, then gave me a negative feedback claiming item not as described which was untrue, and filed AZ. Amazon then suspended and subsequently closed my account. I was selling on Amazon for a couple of years, but I am a small seller, so this incident successfully has gotten me out of business and prevented from further posting on the Forums which is exactly what the Bully was after. The Bully was able to post under his Buyer name, while I was forced to post under my Seller name, thus leaving my name exposed and vulnerable to any Bully attack. As a result, I have lost money in potential revenue as well as my reputation and my good name.

Buyer claimed their item was damaged, 3+ weeks AFTER they received it. They acknowledged that they used it through the entire period and stated this in Amazon's buyer/seller messaging center which keeps a record of all conversations. Knowing how much of a nightmare Amazon is, we chose to provide a Return Authorization to the buyer as requested. When the item was received, it was not even our item! We contacted the buyer, told them they were caught, and that it was fraud. We contacted Amazon directly and let them know what happened. They requested that we return the item to the buyer and they will close the case. We shipped it back with tracking info and waited. They sided in favor of the buyer and closed our case. (!?!?!?!) We appealed the decision, showed proof of non-matching serial numbers, showed the broken screen, and provided the tracking number for the shipment they told us to make. They denied the claim and said that the item was listed as damaged by the buyer and our money would not be refunded. ????, We asked for the case to be escalated and sent email after email with a formal request. Nothing. The buyer has our tablet, the broken tablet they tried to fraudulently return to us, and their full refund. This is one of at least a DOZEN issues that we have had with Amazon. Our account was closed on March 9th after dealing with their nonsense for too long. At the time it was closed, it contained $6,600 - they have kept the money now for nearly 75 days and it is now down to $3,400. Every time a claim is filed, they side in favor of the buyer, sometimes months and months after the return period has expired. In short, their policies and how they enforce them are outrageous. We are standing in a locked room, being robbed at gunpoint, with no way out. We have read HUNDREDS of similar (and worse) cases with similar details and it has to stop. We would like to be the catalyst for this action.

Seems if you know someone who's been banned by Amazon it's enough to get you banned from Amazon permanently yourself. The person who introduced me to amazon, is the person in question. He had helped me become a seller for UK goods. I'd sell and he would ship. But after 6 months, I could see he was making careless mistakes on simple issues. It was jeopardizing my reputation as a seller and I had to part ways (eventually). I even got Amazon involved, to help me reset up my own bank account as his was being used previously. Seemed once I was on my own, he probably contacted Amazon himself to make the point that got me suspended. During the Christmas rush I got this notice from Amazon.

We are writing to let you know we have removed your selling privileges, canceled your listings, and placed a temporary hold on any funds in your Marketplace Payments account. Any new selling accounts you open will be closed.

We took this action because it has come to our attention this account is related to an account which has been previously blocked for performance issues or violations of our policies. While we do not provide detailed information on how we link related accounts, we have significant evidence that this account is related to a previously closed account.

We encourage you to take appropriate steps to resolve any pending orders. Note that any amounts paid as a result of A-to-z Guarantee claims and chargebacks may be deducted from your Marketplace Payments account.

After 90 days, the hold will be removed and any remaining funds will be available per your settlement schedule. Looks like I'm guilty just by association! Which in itself is illegal, as it is unfair. Seems if I stayed with him, I still might be a seller (as my performance record was flawless). But in less than a month on my own I was unfairly labeled unfit and banned from Amazon forever. I tried appealing the verdict and got nowhere. As they offered no reason or evidence that I myself had done any wrong. But when that seemed like a dead end I sent a registered letter to Jeff Bezos himself!! Appealing to the CEO's better judgement and all I ended up getting was this response.

The SYSTEM IS FLAWED! With no one you can talk to directly (all responses come from 'the seller performance team'). And offer no reasons or evidence either! This is nothing more than financial slavery! With the bar raised so high, that the sellers are the scapegoat and Amazon is the slave master. Look at the carnage (below) of sellers coming from this one employer! If we were ACTUAL employees, we could of received monies through labor laws that have already been in place, in all the 50 states, including Canada. This would of saved us a lawsuit, but since we're considered 'sellers' we are not protected and therefore this loophole is formed that ONLY applies to us (and not Amazon). Just because Amazon says so! Does this makes it right? Really we have a great case against this company as they have made us jump through hoops needlessly and maliciously. I believe there is a massive class action here as I among others have lost thousands of dollars in lost revenue. It was one of the 'few' jobs available to me, as it supplemented my income as I am presently on permanent disability. I am an Amazon marketplace seller. Amazon recently closed my account. Yesterday I found out that I cannot even log on to my seller's account to reply email or respond to the A-to-Z claims. I called their offer and they told me I have to I have to write an email to seller-performance@amazon.com to get an answer. I did what they told me and the answer I received is totally not related to what I asked. I keep receiving emails saying my customer filed the A-to-Z claim and Amazon immediately granted the claim. Since I cannot log on to my account, I cannot contact either Amazon or the customer. I am being robbed. Amazon completely shut me down. I don't know what to do. They keep using my fund to reimburse those customer who filed the A-to-Z claim without my consent. I cannot even request the customer to send the item back to my. I don't know what to do. Amazon shut me out, refuse to reponse. I am really worry because they are keeping my $23,608.59 and won't release it back to me

Case Details:
I bought $250 worth of merchandise from amazon using gift cards that were bought for cash. Once I redeemed the gift cards, they put my account under review. I called customer service, but it turns out its only an answering service. I was promised every time they would get back to me in 24 hours and nobody ever got back.
They told me my account was under review. Order was placed in September, and no resolution until now.
Seems like Amazon is stealing clients' money especially money they control like gift cards or money from amazon merchants that they can freeze at will. I will wait another week for a resolution and then I will file a claim in small claims court. I will never again buy anything from Amazon. Having read other customers/vendors feedback it seems like this policy of stealing funds from customers/vendors is new. Customers and vendors beware! And if you have the time and money, sue them and publicise your case anyway you can (i.e. youtube, print media, investigative journalists, blogs, etc). They must pay!

Amazon FBA is just a total scam. I hope to warn all those new to AMAZON FBA: You will get burned. They charge extortionate fees for inventory removal and always favour the buyer (even fraudulent buyers). Here is what happened to us last christmas (2010):

A few weeks before Christmas, one buyer bought $4000 worth of inventory from us via FBA, around 200 pieces of the same product (almost all our inventory for this product). Exactly 28 days later he returned ALL the inventory with 80% damaged. All the products were originally factory sealed, he ripped them open, damaged the products and returned them to the Amazon FBA warehouse.

Surprisingly he got a full $4000 refund. And we were told "Sorry, Amazon is buyer centric. We always rule in favor of the buyer."

Our questions are: Why we were not allowed to cancel this FBA order while it was pending? - We were told "It is not allowed under Amazon FBA policy". Even when the order appeared suspicious.

Secondly: Why there are no quantity limits for orders. How can somebody purchase all our inventory for one product? Why is there no function to set limits?

Thirdly: How can FBA refund such an obvious fraud. The buyer bought 200 pieces of the exact same product, damaged it and then said "Unwanted item".

Finally, we found out that the buyer was another seller (based in California) selling the exact same product. He could have sent us his old, damaged products.

Amazon FBA then refused to talk or provide any evidence. Just brickwalled us saying policy, Amazon buyer protection etc.

Overall we are very unhappy with Amazon FBA service and would say Amazon FBA is a scam.

Often Amazon FBA even charges items (in different colours) of the same weight and size different pick and pack fees. around $0.60-$1.00 difference and we have to spot each discrepancy and point it out in a clearly arranged Excel Spreadsheet, or else they keep the money. It turns out to be even more work than FBA promises to relieve you off. All they relieve you off is not customer service but your money. They hold your inventory hostage, locking you in and then setting fire to your business by suspending you without any reason given and no communication or discussion at all!

Often you will see orders that went through as "Undeliverable Address" - "Customer Damaged" So the item did not get delivered but somehow the invisible customer damaged the product!??? And Amazon then says, they cannot refund you. Wow Congratulations Jeff Bezos, maybe if you did not spend all your time giving interviews to Wired magazine and did some work!!!

I was a seller on Amazon Starting in January of this year until they shut me down on 3-10-11 for "an excessive product defective rate" of 3%... basically, for product returns. That's 6 items returned out of 200 sold in the first 2 months of my seller's account being opened (by the way, only two items were actually defective). Does 3% sound excessive to you? And so starts the real fun...

I appealed my suspension 3 times, only to have all 3 rejected leading to my account being permanently revoked. I asked for a phone call from the review team in each of my appeals so I could make sure I was addressing their concerns correctly... no calls received. They were as vague as they could possibly be as to why I was being kicked out, providing no explanation whatsoever. I even called customer support and asked how I could file a formal complaint about the lack of phone support for the seller account review team, and the agent told me, "I can send them an email on your behalf, but I doubt it will do any good. But, we appreciate your feedback, though." (I laughed out loud when he said that last part!) They informed me that they were going to keep my funds for 90-days (they still have them). I am fighting with them on the principle of this policy right now. Also, they state that they can and will make interest on my money and will not pass any of it along to me - it's in one of their "policies".

Problem #2:
Amazon.com FBA lost 7 of my items, but waited for me to inquire as to why they weren't showing up in my inventory as available for sale before they even looked into the problem. Then, they spent two weeks "investigating the issue" only to conclude that they indeed had lost the items. To give you an idea of how crazy this is, all of the items were very large and heavy (corporate printers, street legal scooters, projection screens, etc.)... not exactly items you would expect to go missing during the receiving process. They took their sweet time to look into each one, most of them took two weeks to resolve. At the point they deem the item lost, they reimburse your seller account based on their calculation of the "value" of the item. When you look up their policies on determining the "value", it is once again as vague as possible. The amounts they reimbursed me for these items were nowhere near the true value of the item. They were far from fair reimbursements. They told me that if I wanted to dispute the reimbursement amounts, I had to produce my sourcing invoices to prove higher value. It is absolutely unethical for them to request to see my sourcing information so they can compete with me directly, so I refused to do so. (I have some very unique sources and products listed on those documents, and I'm not about to let Amazon have them.) So at this point, I have lost nearly $1000 from FBA inventory mis-handling, and they refuse to make it right. I even proved the value based on what the product was selling for on THEIR OWN SITE and what my price for that item was still set at in the system (lowest price of all sellers), and they still refused to make adjustments.

Problem #3:
I have lots of my inventory still in Amazon.com FBA warehouses. I am now forced to sell these on other websites, such as eBay, for a much lower price. Regardless, Amazon has impacted my stellar customer service reputation on the other sites twice by FBA's failure to perform. Once, they placed an item I had sold into "Reserved" status as I was building the fulfillment order, and it stayed in that status for 2 weeks. I had to refund the customer's money and beg his forgiveness as a result. The other item... I submitted a fulfillment order for a large corporate printer I had sold on eBay. They shipped it and provided me a tracking number just like normal. I gave the tracking number to my customer. All was good... until, the customer asked me what the status was with his shipment about a week later, stating that UPS has no information on the tracking number I gave him. I checked, and sure enough, UPS hadn't received the item yet. I opened a case with Amazon, and they acted surprised and said they would look into it. A week went by (during which, I had to refund my customer and beg forgiveness again), Amazon finally admitted they had lost it during the shipping process. How that happens, I'll never know.

Problem #4:
Some of my FBA order fulfillments were charged a dimensional shipping charge, generally reserved for very large, heavy packages. On the latest order fulfillment, the longest side of the box was 18" and the weight under 10 lbs. When I asked why, they simply stated "it's in our policy you agreed to when you signed up." Anyone vaguely familiar with common shipping practices would, and should be able to assume that Amazon follows the same basic principles without finding surprise charges in their statements.

I sell on several different web venues and value my reputation for integrity and excellent customer service. I am absolutely shocked that Amazon works this way, and that all of this could happen in such a short period of time. Amazon is getting away with anything they want to and I want to contribute to a solution to this unethical behavior in any way I'm useful. This has to stop quickly.

I was recently robbed by Amazon.com and their BS A-Z program that lost me $400.00 dollars to a scammer down in Miami,FL.

I tried to reason with the buyer and they refused to send my Blackberry back to me and then two months later Amazon refunded them back the money to them.

So not only did they get the money back they also have my brand new blackberry that they got away with.

Amazon does not care about the sellers and told me tough luck and that it’s part of the risk of selling on their website.

I am so frustrated with them WHEN IT WAS MY MONEY!

They never listen or care and I am done with selling on a crooked website that caters to scammers.

The funny thing they did tell me is that “sir they can only do that (5) times a year until they are banned from Amazon.”

That is just disgusting. IT SHOULD NEVER HAPPEN AT ALL.

Amazon.com should have a system just like the seller has to put in a tracking number to get the money it should be the same for the buyer on returns before they get their money. Then when the seller receives the item back then a refund can go back to the buyer.

I am in the same boat, I have been a A++ seller, I shipped the same day Amazon has told me buyer info, I purchase shipping within Amazon so everything is documented and verified. I am a good seller and now Amazon is withholding $1500 of my money which I need, Their excuse.. I need more feedback which will speed up the process of getting my account out of review status and freeing up my funds. This is Amazon, not eBay who leaves Feedback on Amazon??? This is out of my control. After I saw my account was being review it noted I would be contacted within 3 or so days to discuss my account being reviewed which no one did. My story is too long but if someone wants to take this case please feel free to contact me. I have everything well documentated.

I really hope they are not using our money and collecting interest off it by using horrible business rules to allow them to hold funds. This is not right and to make this whole situation worse we are too disconnected from the review team, I was told for legal reasons I am not allow to speak to anyone on the inside about it but I can email or file an appeal. I did both and both times it is impersonal, I spent a lot of time expressing my appeal and an E-mail only to have a reply E-mail saying this is an automated response.

I've been selling on Amazon for about a year. This month I've received a notification from amazon stating account has been blocked due to your failure to follow through on completed transactions. Their response was I've violated the policy and the account cannot be reinstated and now holding my funds.

I have had my account under review for 30 days now. Amazon owes me on pcrepairs-online second account $1,230.21 [1] and Wilkinson Micro account $166.37 [2]. Totally of $1396.58. I am on S.S.D., Trying to make a living since we have no raise in two years and this paying the bills to live on. They stated as it follows:

[1] Your pcrepairs-online second account has been blocked due to your failure to follow through on
completed transactions. As stated in our policies, sellers must list only those items they can
deliver and may not back out of completed transactions.

Any remaining funds will be reserved in your Amazon.com account for 90 days from the date your account was blocked. After 90 days, the funds will be disbursed, provided we do not receive
charge-backs or A-to-Z Guarantee claims against your sales.

[2] On the Wilkinson Micro account. We are writing to let you know we have removed your selling
privileges, canceled your listings, and placed a temporary hold on any funds in your Marketplace Payments account. Any new selling accounts you open will be closed.

We took this action because it has come to our attention this account is related to an account which has been previously blocked for performance issues or violations of our policies. While we do not provide detailed information on how we link related accounts, we have significant evidence
that this account is related to a previously closed account.

This means they can't hold my money! There is not one, not even one, reason why they can reasonably conclude that there will be customer disputes, charge backs, or other claims.

I have researched this and read articles posted on this Web site on Amazon.com's seller practice which I believe you they are guilty of Embezzlement of funds and not limed to Money laundering by Unlawfully holding money from seller(s) on their Cockamamie agreements from sellers’ performance and/or feedback issued.

The conclusion on his statement is not if we ALL have a 90 cash flow and/or or some has made money by selling on amazon.com. The question is embezzlement by holding funds from the sellers for more than 90 days on their Unreasonable online agreement or even not even paying them. Nevertheless, is up to a court of law to determine this is fair and a binding contract and/or online agreement.

Amazon harrassed and try to frame me for fraud email sales confirmation in which amazon send to me. This was a set up in order to take over the product I was selling on their platform. Immediately less than a minute that I was forced out of the platform Amazon launched a sale on the same product for higher price. Like many other people here, I had an A to Z claim filed for "item damaged or not as described". The buyer claimed the item arrived damaged. I asked the buyer if she preferred a refund or replacement. Buyer stated she preferred a replacement. I sent the buyer a replacement.

After I sent out a replacement, Amazon responds, saying they are refunding the buyer.

it seems to me Amazon never even looked at the details, they simply have a policy of refunding any buyer who files an A-to-Z claim.

To sum up, I have sent the same item twice to the buyer. I have not received either one back. The payment has been refunded to the buyer. This is a completely absurd situation that defies belief.

All attempts to email them and explain the situation are completely fruitless. (it is a bit like talking to the robot on 2001, A Space Odessey). I ask them if I am expected to send free items to customers with no reimbursement, i just get a form letter back in reply.

Amazon's A-to-Z policy is unbelievable, and, it seems to be most likely illegal. What sort of business model requires you to provide items to people and not be paid for it?

Upon founding Amazon.com, the original goal was not to make profits - it was strictly to manage a massive amount of cash flow.

I believe that Amazon is doing something completely illegal in holding money from sellers for 90 days.

I started using Amazon, and over the period of a couple months obtained 100% positive feedback from 24 customers.

Amazon is not like eBay, MOST do not leave feedback. Usually on Amazon what motivates a buyer to leave feedback is that they're pissed since they can't receive positive in return!

However, mine were all 5 out of 5 stars!

That's one heck of an accomplishment, with zero refunds, A-Z policy or guarantees etc etc.

It just makes no sense. Today we're over 60 days into the hold and there's been nothing. No customer complains. Zero refund requests. Zero negative feedback.

Everything's 100% tracked as delivered, all sent within minutes to a couple hours upon customer buying on Amazon.

It's just ridiculous, they have ZERO reason to think that I pose any risk to Amazon financially and therefore it should not be legal for them to hold my money without paying interest. That money should have been flipped over and over and over and I feel they owe me several thousand in lost profits.

Amazon confirmed specific reason being: "Per section 2 of the AMAZON SERVICES BUSINESS SOLUTIONS AGREEMENT:

"If we reasonably conclude based on information available to us that your actions and/or performance in connection with the Agreement may result in a significant number of customer disputes, chargebacks or other claims, then we may, in our sole discretion, delay initiating any remittances and withhold any payments to be made or that are otherwise due to you under this Agreement for the shorter of: (a) a period of ninety (90) days following the initial date of suspension; or (b) completion of any investigation(s) regarding any Seller actions and/or performance in connection with the Agreement."

This means they can't hold my money! There is not one, not even one, reason why they can reasonably conclude that there will be customer disputes, chargebacks, or other claims.

My account was suspended indefinitely for 90 days due to a high pre-fullfillment cancellation rate. I understand this can lead to a poor customer experience, having a buyer place an order and then it be canceled. However, I NEVER claimed they were shipped or asked for disbursement, etc. Legally buyer should never be billed until this point as well.

The reason for pre-fullfillment cancellation rate was mostly always due to the 15 minute change period. If I listed something and noticed an error, I'd have to change it. Sometimes there would already be a sale, I would sincerely apologize to the buyer and cancel the order. (another reason being I did not fully understand how it all worked. They ask how many of an item you have, so I state it. Sometimes the last item will sell elsewhere, and then I'd see it sold on Amazon minuets later before I could end the listing. Everything was always in minutes. When someone order, I shipped literally in minutes. When an order needed canceled, I was already on the site in order to update the inventory.. yet either the inventory / cancel listing update took up to 15 minuets and someone placed an order, or Amazon just delayed notifying me about an order until after the listing was closed and sold elsewhere.

Creating a poor customer experience when needing to cancel an item? Guilty. Suspend me for that.

However, I feel they have no reason to hold my money for 90 days (it's been about 30 now), and if the only reason they have is "per section 2," then it's invalid.

But just one day later, my account balance was cleared, my money has gone with neither explanation nor notification. Even if someone else used money in my account, I should see the order in my account, but nothing there.

On 8/19/2010 I receive an email from Amazon claiming that my account is under reveiw and that they can hold my funds up to 30 days before releasing it to me. I think this is total bs and Amazon has figured out a way how to make money off of our money . I sent them all the tracking info and other info that my help me get my money quicker. Case Details:
Sold a PS3 160GB system and shipped to buyer insured and delivery confirmation. Two days after delivery received email from shipper saying he wanted to return becasue he didn't "have the money right now." I responded with some suggestions but said could not accept return (I looked at the policy and it said buyers remorse was not a reason for return) I though I would be fine. A week later I received an email that a A to Z claim was filed and buyer said he did not receive an item. Money was taken from my account and I submitted the initial email and explained my side. In the end of course I lost and Amazon is refunding buyer and said it is up to him to send back and he can keep the PS3. Absolutely no customer help on the seller end. How is this even possible it makes no sense. Of course now the buyer wont respond to my emails to send item back but why would they if they know they get to keep the item and get a refund.

Case Details:
I never realized so many people are experiencing the same treatment. I've been selling on Amazon for about a year and a half. In March of this year I received the first A to Z claim from this customer. The buyer claimed the he didn't received the item and the tracking showed that it was delivered. He lived in a small town where everyone knows each other. Who would steal his package? Obviously the buyer won the case and got his full refund and I lost the item plus shipping. He basically got a free item without having to pay for shipping.

This month I've received a notification from amazon stating that I've signed up for another account which I didn't. I've tried to email them asking for how they've determine that I did. Their response was I've violated the policy and the account cannot be reinstated.

Although we've accepted their terms and condition when we signed up, but I don't think it's fair to be treated upon their discretion. There's no protection or support whatsoever for sellers. I'm not sure if a class action would be the right thing to do. I hope there's a better place to go than amazon. Who's the next big guy other than amazon and eBay?

On June 19th they sent me an email saying that we had passed the review process and that our funds were released. That from there on, they were going to release our payments for the first 7 days and the other 7 days were going to be held for the next disbursements. Still stupid I agreed.
On July 24 they finally relased the funds from May 27th, it took 8 days to arrive to my bank.
On July 8th they release only 281.00 out of the 1080.00 that I had sold
On July 9 they sent me an email that our account had been suspended and that they were going to held our funds for 90 days to prevent any charge backs.
How can they do something like this? They play with our money while we have to cover all of the cost of product materials and shipments

A buyer bought a game controller from me and emailed with one one sentence: that he want full refund as the "software" doesn't work. buyer then ignored our 3 email responses offering him 1) technical support to help trouble shooting 2) return for refund or 3) replacement.

buyer filed A-Z claim the same day.

We were NOT notified by Amazon of this claim and didn't hear of this claim till an email came notifying the issuance of full refund plus shipping to the buyer.

we emailed Amazon 4 times, they deleted all my evidence that i copied in the case history and simply responded :'your case has been forwarded to another dept" then case is market "resolved"; when i reopen the case, i got the same message.

Amazon does NOT follow the terms of filing A-Z claims in that:
1. the buyer should give seller 3 days to respond.
2. The seller should be notified of the claim and had the chance to response.

we have came to the conclusion that Amazon is catered to buyers (even the fraudulent ones) at seller's expense to expand their buyer base and profit.

We'd be happy to see something to be done to seek justice.

we have since pulled out of amazon.

We are thinking about our local laws and this qualifies as larceny.
Amazon stole our money, Amazon committed larceny and we are going to the authorities first thing Monday morning and we are going to sue the CEO personally.
We are not going to sue the company we are going after the CEO because it is their ultimate responsibility and I recommend we all sue the CEO and keep his next year booked with legal proceedings

He then proceeded to keep emailing saying I wasn't responding to his emails and that item hadn't been delivered. I continued to reply to each fraudulent complaint. He then filed an A to Z claim to which I promptly responded with tracking number, which showed item was delivered, 4 days after he placed the order, and all the messages showing my previous responses. Amazon found in his favor and refunded his money and took the money from me. Amazon is complicit in criminal activity. If I have proof that item was delivered and they refund the buyer money for "item not delivered" then both the buyer AND AMAZON are guilty of theft!!!

I had an Amazon account for about a year went to them when i left Ebay. Months ago I contacted them asking why I kept getting orders for APo addresses and PO Boxes since I did not ship to them. Had this stated on the site and in my returns and shipping info Got no satisfactory answer from them. A little over a month ago had my account hacked into and contacted them They closed my account immediately. lmost 2 weeks later got the go ahead to open a new account. Spent about 2 weeks relisting items and had gotten business going again and bam account suspended because of old account and too many cancellations. Amazon cancelled over 20 orders when they deleted my account and told me I would not be held responsible since the account was compromised. After contacting them was told too many cancelled orders even though I was assured by them that my account would not be cancelled because I had contacted them on both occasions and let them know about the problem. Amazon is currently holding about 550. for the first account which was supposed to be received in 6 weeks at the most and still has not been and now another 70 from the second account. Amazon was my main selling place and this has cost me over 1000-1500 a month in sales at least on a slow month. Being a single work at home mother was depending on this site and now have over 1000 products built up because amazon was so successful and not sure what to do.

I thought Amazon wanted protect sellers against fraudulent claims. HA!! After the claim I immediately refunded her money. A few days later, some Amazon employee decides to hold the sale amount + shipping + an extra 4 or 5 dollars. FOR AN ISSUE THAT WAS already resolved.

After a few days of interactions with rude customer service I started my own blog amazonfraud.recessionstories.net in order to bring together people that are tired of being defrauded by Amazon, and tired of the special treatment it gets as it works to destroy all independent bookselling and associated independent publishing.

I wasted at least 40 hours trying to communicate with Amazon to resolve this in a business-like manner. They made no good faith attempt to determine if it was reasonable to hold my money. I am self employed. I have a client who pays me $20 for every hour I work without limit. Even though I now have my $16.98 back, I want to be reimbursed the $800 I lost trying to resolve this complaint in a reasonable fashion.

The only kind of lawsuit I wish to participate in is a class-action suit in which the only money paid to lawyers is less than 34% of the judgement received.

Case Details:
Back on September 25th, 2009 I sold a book to someone as a third party seller on amazon.com. In November the same person filed a claim with Amazon saying he never received the book. The person claimed to have contacted me but never did. This is what the buyer wrote on his claim to Amazon.com: "I received a brown scrap of what was used to wrap the item in an envelope from USPS. The scrap had part of my address and part of the seller's address on it. It also had a red RECEIVED WITHOUT CONTENTS stamp and a delivery confirmation sticker (0308 2690 0001 8952 2446). I emailed the seller twice to resolve this, but have received no response." The first problem is that that tracking number does not exist. I gave Amazon the correct tracking number that actually shows it was delivered to the recipient and provided them all the additional information they needed. As far as I'm concerned this should have all been over with when the buyer provided Amazon with an incorrect tracking number. But Amazon decided to refund the buyer their money at my expense. Also, they didn't debit my account until months later. Customer Service took forever to get back to me when I asked for an explanation and they still didn't answer any of my questions. They claimed I should have shipped with signature confirmation even though they barely provide me a postage reimbursement to cover delivery confirmation! It's not even recommended anywhere on their site to ship with signature confirmation. Someone @ Amazon is claiming that because I can't prove it was delivered right to the house that I'm not eligible for a refund but the buyer can just make up a delivery confirmation number and that is ok. For that reason I just can't figure out how they can take the buyer's word over mine. The buyer lied all along and Amazon ripped me off. Before all of this Amazon claimed I never even sent the information they need. They've never addressed why it's ok for a buyer to make up a tracking number and be able to get a refund and scam sellers. It took them 9 days to reply. I had to send 5 different messages too. Their customer service is terrible. They want sellers to use a shipping method that shows it was delivered right to the house but don't provide a shipping reimbursement that is high enough. We're required to offer the cheapest option that doesn't come close to covering the cost.

Here was Amazon's response to a BBB complaint:

If an order is shipped, there are three ways to mitigate the risk of an A to Z Guarantee claim for an order not-received:
1. Ship promptly and use a method that ensures delivery before EDD.
2. Ship with tracking and provide tracking information to the buyer.
3. Based on your business model, determine which items should ship with signature confirmation and /or insurance to minimize the risk of loss.

Please note these suggested shipping methods are only suggestions and will not necessarily prevent an A-to-z Guarantee claim from being filed. It is the seller's responsibility to determine if the item sold is worth the cost to add signature delivery confirmation to protect yourself in the case a claim is filed. Plaese consider this claim closed, as this is our final decision.

My complaint is about you bunch idiots here complaining about amazon. Here's the problem with all your nonsense you're complaining about. Amazon states in their agreement that you MUST AGREE TO in order to create a seller account, that 1, you must have a 90 day cash flow to sell on their site. Why? Because during a review they could hold your money up to 90 days. If you had the cash flow, situations like the previous poster stated wouldn't happen. i.e. couldn't pay for merchandise so got interest fees. 2. They state in their agreement that a buyer may file a claim and if closed in their favor may be entitled to a refund without sending the merchandise back. It's in their god damn agreement! Should they have someone call you and make sure you understand all the terms? If you don't agree to that part of the agreement you click on "I don't agree" and the site will not allow you to continue with the registration.

The reason you all want to file this law suit is because you made a LOT OF MONEY on amazon & they cut you off. They protect their site from shitty sellers and that's only ONE of the things that makes their brand so valuable and trusted.

Hi, I have been selling at Amazon for a couple years. However, early this month, Amazon send me an email that my account is permanently block, because "because your items fit a set of criteria that indicates they may be unauthorized by the intellectual property owners."

I was a seller on Amazon.com til from January 2009 until this past weekend November 21,2009 and abruptly had my account blocked and suspended for unethical reasons. They are currently holding a considerable amount of my funds ( approroximately $2000) they say for up to 90 days. The sellers performance department which you have to communicate with was not specific on reasons other than for excessive returns ( which they FORCE you to accept then hold it againsty you, and for any negative feedback which 1 or 2 negative feedbacks out of 180 positive feedbacks put you out of business!) They penalize you for holding you up to their own rules. This is the third time they have held onto my funds in the past 3 months. They held it for 30 days in July and 30 days in september totalling $16,000 ! This has caused emormous damage to my finances as was not able to pay for my merchandise as the bills were due as they were holding the funds when I should have been able to pay for my merhcandise on time causing me to pay ridiculaous interest on the funds withheld, not to mention the stress of never getting an answer of how to resolve the problem or why they are contradicting themselves and their own policy.

I have documented all my communications via email and believe that they Amazon.com are operating unethically and illegally against sellers on their site. I know from the" ripoff report " and google searches that there are hundreds of other Amazon.com sellers who have had their sellers account blocked or suspended and their funds held unjustly. I would also like to hear from business law attorneys that might be interested in this issue to make a class action lawsuit out of it. I have compelling additional information about Amazon.com that could blow the lid off their scam of screwing sellers! That additional information will only be discussed with a trusted attorney(s) who will put this class action lawsuit together. I reported this to the better business bureau in washing state who just blew me off . I believe that I have information that would make an open and shut case against them! Please Contact me if interested in building a class action lawsuit against Jeff Benoz and Amazon.com! They need to pay for their unethical treatment of sellers. they take 20% commission, let customers KEEP merchandise if they complain and DEBIT your account whether it is legit or not. Then they suspend and BLOCk you from selling! and still hold your money as long as they want.

I have sold on Ebay for over 10 years and never had problems like this. The only reason I even ventured to sell on Amazon was to grow my business.

I had some leftover college textbooks and thought that I would sell them on Amazon. The A-Z seller account policy wasn't shown in plain english when I created my seller account but when I sold my first book.. Bammm, a complaint by the thief/buyer was decided against me for a "scratched cover" and that a full refund had been given to the buyer at my expense. Amazon does not give sellers any rights nor are they entitled to have their merchandise returned by the buyer.
Someone name one business that let's buyers get free merchandise -without having to return the item that they are not satisfied with. Amazon gives unscrupulous buyers a license to steal with the A-Z guarantee and does not require any proof from buyers (other than their good word, yeah right) that they received defective or other than listed condition books. Now Amazon wants me to refund (pay) for a book that was stolen from me! This goes against the most basic business laws and has to be illegal. Someone file a class action suit, please! It's the principal but I'm sure many sellers have been out alot of money due to this illegal policy. Sellers aren't knowingly exposing themselves to thieves (Amazon or bad "buyers"). Don't sell on Amazon until they come clean on this!

I was a successful amazon.com seller for a few months and generated a nice amount of profit, then one day I got a short e-mail from amazon.com that they're getting rid of my selling account (without explaining why ) I tried unsuccessfully to contact them by phone, e-mail and they just ignored me, when I try to get back on they kick me back off, this has been going on for 3-4 years now, without them explaining as for what I am banned from selling on their site forever till I die. I've lost tens of Thousands of dollars in potential revenue.
