Case Summary:
On the largest main interstate in the western United States (Interstate 5), Tmobile customers driving IN the USA, to within 5 miles of the Canadian Border, often have their cell phone's signal grabbed by a Canadian Network because Tmobile refuses to invest in its cell towers putting out a stronger signal for its U.S. originating callers. Because Tmobile allows these customers to be automatically picked up by another foreign network, despite their customers STILL originating & terminating their calls in the USA, Tmobile is charging these customers Canadian or Mexican network per minute "roaming" charges, ranging from $0.74 - $2.00+ per minute. Under Tmobile's various plans, likely 90% of these calls should be considered in-network calls, which should be included in their normal plan minutes (usually free - if client is under their monthly alloted plan minutes). This because, they originated and terminated within the client's authorized network coverage, under Tmobile's various plans.

Tmobile's response to these complaints is not to fix their cell towers, or refund their clients the roaming charges, but rather to tell its clients how to go through a series of technical menus and sub-menus (different on every phone) to manually force their cell phone to ignore the stronger Canadian signal and pay attention only to Tmobile's signal. This is not how any cell phones are set up and every time a customer turns off their phones, they would have to remember to go back in and re-set their phones through the same array of menus all over again.

Most USA cell phone plans with all U.S. based carriers provide for a much higher rate charged when their clients cross the border into Canada or Mexico. When these clients live or travel up to U.S./Canada border, most cell phone carriers locate cell towers with strong enough signals to insure their U.S. customers do NOT loose their company's cell signal to a Canadian company when the client is STILL using their phone in the USA, under the client's legal requirements for remaining within Tmobile's non-roaming covered area.

Because cell phones automatically are set to search for the strongest cell signal or closest cell tower, U.S.-based customers are possibly getting charged millions of dollars a month in incorrect roaming charges for calls that clearly fall within their Tmobile plan's "authorized coverage area" and "included plan minutes". (For Tmobile's most popular nationwide roaming plans, these calls would otherwise be free included calls, if customer is under their monthly alloted call minutes.)


Case Detail:
Therefore, this class action lawsuit would be to force Tmobile to make every effort to insure it's cell towers running along U.S. borders, emit strong enough signals to prevent its customers from incorrectly being charged roaming fees, while still making legitimate in-network covered calls, AND to seek renumeration from Tmobile for all those in the class party that have been charged cross network "roaming charges" for calls that Tmobile shows in their printed coverage maps as being "non-roaming" calls.
