Case Summary:
I have an account with Drive Financial. I missed a payment. They began calling all of my friends, family, harassed me at work, told my friends and coworkers my personal financial information and made threats of repossession to these same people. I talked to the company and told them "you do not have my permission to call these people...you are telling them lies..." They continued to harass and make the calls. I sent letters and certified letters complaining, but they continued to call these people. I was caught up on payments but they sent a repo-man to my parent's workplace to harass them at work in another state! It's unbelievable and directly in the face of the fair debt collection practices.

I am looking to do something with this company. I have been lied to, harassed, threatened and my civil rights have been violated. I need help with this.

Case Details:
I had two contracts with citibank, one 2005 Nissan Altima and 2007 Ford Expitidition. Santander brought the loans. They sent statements stating I owe way more on thr contacts then expecting. It was like my contracts started over even though on the nissian I had already payed 5 years and the truck 3 years. I tried several times to call and talk to someone, but was put on hold or no answer. Finally after 7 years I paid off the nissian. They told me to send more money than the statement stated due to interest and was going to adjust it and send me back the rest. Well as you guts already know, I never recieve it. Now my truck, I was late a couple of times. They sent me a email stating if I pay a certain amount, by a certain date, the truck will ve paid off and they will sehd me the pink slip. Well that never happen I did oay them, but after a few months, they sent a repo man to come gef the tfuck. I have tried on several attempts to contact santander, but no luck. Now I have to call DMV to find out about who still have the paper work, this is insane. I pray that a lawer would read all of these complaints and help use. Thanks

I had a car loan with CITI and was bought out by Santander I believe. My maturity date is 06/14/14 my payments are $286 a month, my statement states I still owe $5300.00 I dont understand how I would owe more then $2k after my maturity date, Ive never been late but have defered my payment a few times. I called and questioned the remaining balance and didnt get a straight answer at all. I dont know what to do and need help . I do not want to pay an extra year on my car loan for a balance I dont owe. PLEASE HELP

I originally purchased my vehicle from Drive Financial in 2009, my loan was sold to Santander without my knowledge. I put 4k down on my vehicle and my loan amount was for 9k. I have paid to Santander over 9k and my payoff shows that I still owe them 11k!!!! (This is not including the 4k down) They call me non-stop and everyone I know, they call people that were not even listed as references on the loan to begin with. I can not understand the emailed statement they sent me that has thousands of dollars of misc fee's and the reps can't tell me what they are either. Nor, can I get them to send me a paper copy of my statement. I am charged for every payment I make. I hate this company and would do anything to get from under this loan. Please please please stop these people

I made an original contract of 60mo on 6/2006. 2 weeks ago Santandar told me I made the contract for 84Mo. I said no it should only be for the 60mo and 12mo more for 4 extension I was allowed. They state they have a signed contract for the 84mo. I have my original purchase contact. I have made a total of 67 payments of the full amount and at least 10+ payments for more than amount. My online account shows a final pay-off date of 02/2013, not even close to said amount still owed.

I purchased my VUE though Citi Financial for 13k. Santander acquired Citi Financial and all of their loans. My detailed statements were replaced with a very general monthly bill with no loan details. I got behind and deferred several payments which they ADDED to the loan balance. I have already paid over 15k in payments and they said i still owe another 19k. They also stated that ALL money paid went to interest and my principle was still at the original borrowed amount which was not the case with Citi Financial (have statements to prove). Was notified this week that my loan was written off. Today i received a call from a "Bank Fraud Investigator" that stated that all of my friends and relatives will be harassed until I give up the vehicle. I said that wasn't necessary and made arrangements to meet in a couple days to turn it in. My 75 year old mother was just harassed by a repo man banging on all of her doors, windows, he was trying to open each door at 2AM!!!!, she screamed though the window as she called the police and asked who he was. He stated he was trying to repo my car. She told him that I haven't lived there in over 10 years. He then told her he would be back again and again until they receive the car. THIS HAS TO BE COMPLETELY ILLEGAL!!! My mother is completely shaken up and doesn't feel safe in her own home. This is in COMPLETE violation of the Fair Debt Collection Act. Our civil liberties are being violated.

Case Details:
On September 29th, 2011, I made a $2000 payment to Santander, my monthly payments are $337.65. I received a statement from Santander acknowledging the payment and that I would not have another payment due until February 2012. On October 3rd, I mailed them a $3500 check to pay off the balance on my car, but I had to put a stop payment on the check due to an emergency. They had the car repossessed in late October 2011 because they said I was 6 months behind on payments. After a day lost from work, calling and speaking to numerous customer service reps and managers, I thought the matter was cleared up. My car was returned the same day, but it was dented, scraped and scratched up. I filed a complaint they said to get estimates for the damages, which I did, then said they denied the claim on the towing damages because my car is a 2002 with over 150K miles on it.

So all this time I have not heard anything from Santander about payments or anything due. On March 12th, I got a statement from Santander saying I owed $1144 plus $470 in fees for the repossession in October. I immediately called Santander. The customer service rep said she would put my account in for a deferment and have the $470 fees removed. The next thing I know my car is being repossessed on March 15th. Again I called Santander, after speaking to a number of account representatives, I finally filed a complaint with the President's office. On Friday, March 16th, a Marcus in the President's offices said that an accounting error had happened (again) and that the deferment was granted, the fees were being taken off the account and my car would be returned in a few hours.

My car was not returned and it is still not returned as of today, March 19th. I called Santander back, this time Leandre in the President's office said I had to call the tow company and make arrangements to get my car back. I told him this was costing me time and money as I was having to miss work to take care of all this AGAIN. He said there was nothing he could do.

I called the towing company and was told my car could not be returned until tomorrow, March 20th after 1 pm. Luckily I have a way to work today and in the morning otherwise I would be missing even more work.

This has to be violating the Fair Debt Collection Practices Act and Due Process.

Took 2 payments from bank acct, when Santander took over, but never was told this, authorized 1, bank backed me up w a letter and statements that they DID withdraw 2 payments in 1 month. After 2 years of paying on time. I didnt make a payment the following month, which they said was fine bc of the 2 payments they took. After that, they denied taking the dbl payments, tacked on late fees, fell behind, then lost job, still continued to fight the withdraw, basically said it was Drives problem not theirs they had no records of it. So they showed I was still late, kept adding on fees, I still made payments even if they werent the total amnt, I would try to catch up but it was impossible. 3 years of paying for this car, I had one year left, they took it this morning. Also, harrassed everyone I knew, and my job. I somehow still owe like 10,000 and the original loan was for 13,000 at $366 A MONTH!!! I cant do it anymore, I am getting ready to move finally again into my own place and they took my car, I had stayed with fam and friends to catch up and send them more and more but never enough. This is unacceptable. I just googled them today and found all this out. I am so sorry we are going through this. They have caused me major grief and pain and financial struggles. I am hiring a lawyer tomorrow. Im a single mother and I will not do this anymore! They are evil and scandolous!

Me and my wife had bought a cube in 2010 from nissan dealer for 18000 financed at %24. We agreed to it due to poor credit. February 2011 I contacted Santander via online chat to discuss why my account said I owed roughly $9000 when I know that I only owed roughly a years worth of payments at $323.95/month. Got the run around and said that it would be resolved on November 2011. I just got a letter saying I still owe $8000+ and it is due in November. I currently have six payments remaining on my original loan and refuse to pay 8,000 more dollars. I have gone though a separation and been laid off from two jobs and still make my payments or make arrangements for late payments and go without to do so like many of us have done.

I purchased my vehilcle for 14,000 from a local Honda dealer. I paid over 10,000 on it over the course of 3 yrs. When SanTanDar took over my loan they told me I still owed over 15,000 dollars on my loan. I requested that they audit my loan and they told me that the records were correct was the answer I got right after I made the request. Santander is using Cab Companies to follow me and look for me so that they can get the car. With the economy like it is, it's no wonder anyone will do this for any amount of money. I am being followed constantly even by plain cars, driving past my house. I am pretty sure they have put a GPS on my car at some time when it was in a lot becaue they find me almost immediately. I tried to arrange payments with them and was paying what they said. Next thing a repo driver at at my door and I was not late as far as I knew but when I called they said I was 90 days past due and that I could not get a loan modification because of that. So, they can try to take the car, but stalking me is not legal as far as I know. Now they are bothering people with my same last name and my ex-husband of almost 20 years was just threatened the other day. These people have to be stopped. It has been over 6 months why do they keep stalking me llike a criminal and not file a judgement, write off the money, etc? My car is over 6 years old, 90,000 miles, and $3,000 worth of damage. They will be lucky to get $2,000 to $3,000 on auction for it. They have charged, me thousands not for all the attends to pick up the car along with non-payment and late fees.

Around 10pm I get a knock at the door of the repo man wanting to pick up my vehicle. He stated that I hadn't made a payment since June 10th. Well on June 13th per account records an extension was granted and I made a payment on June 18th and then the month of July I didn't make a payment but made it on 8/1/2011. The repo man had a statement that showed I owed 955.00 but one contacting santander they stated I owed 1415.93 and the repo fees would be added to my account. I don't understand these people. They have been crooked since taking over Drive Financial. I had no idea car was even out for repossession. I paid the 1415.93 to get car back and they told me I could pick up the car in an hour which ment I would be able to get the car around 1:25 pm. Well after calling the repo company they had received a release so called Santander back and they stated they had resend the release. So I stayed on the phone until they did it only to find out the repo man was closing down early to pick his kids up from school. So there goes another days storage fee.

I originated with Drive, they sold to santander, i had a bankruptcy, i then continued to pay for the car which i think was a mistake. I noticed two things; one was when me and my wife got the car the deal was suppose to be done under my wife, but it was done and registered to me, not sure why at this point. At any rate after my last payment i made i sent a reply to them asking for the title, and putting out there that i think the loan was down with some sort of fraud, and i also mentioned that predatory lending might be a factor. I havent heard a word from them via regular mail, certified mail, or nothing. Once they had someone come to repo the car but i had been paying so i got it back. Bottom line i think the loan was done fradulently, my wife was preyed upon via predatory lending, and since i havent heard anything on a car that supposedly belongs to them that i havent paid for in 4 months at least that is indication to me they acknowledge the fraud

I originally got this loan in July 2005. Since then I have been making my payments. Not always on time. My loan was finished as of 4/23/11. They don't send me statements monthly and nothing is broke down so I can see where my money is being applied to when I send them over 1,000 and only 300 is applied to principle, hmmmmm. Called today telling them I wanted something showing the breakdown, was told she could not get that info but would email her supervisor about it asked to talk to the supervisor but "he's not available" yeah right!

We bought our truck in '08 using United Auto Credit. The only thing I don't like about UAC is that they then turned around and sold the note to Santander (or so Santander claims). We had tried from November 2010 to January of 2011 to get them to validate the loan via phone, get a copy of the paperwork, etc. - never had anything show up. We knew we were close to paid off, even though they stated we owed more money on it - I've done high-end accounting, and monthly compounded interest is just not that hard - and after receiving countless phone calls on a daily basis from them, we sent written notice in January to stop the phone calls (they haven't) and that we were contesting the debt. We waited. And waited. And waited. We never received anything from them, and then in early April a guy shows up with a flatbed to repo the truck!! Had another guy out last night, 10:00 at night, pitch black, out in the country, and they first encouraged us to call the sheriff and then kept trying to take off with our truck. Since the debt has been contested since January, Santander is not legally allowed to hire an agent until the contested matter is resolved.

In December of 2005 I purchased a car through Drive Financial. The loan was transferred to Santander a couple of years ago. My loan was for 5 years originally to end in December of 2010. Because of the loss of a couple of jobs over the years I differed several payments. Santander TOOK my vehicle in spite of the fact that my recent payment posted to my account the day before - and all I got in return was rude treatment and spineless apologies from them save for one manager in their Reinstatement Department who was courteous enough to give me somewhat of a bit of help - STILL later, I spoke with another so-called "supervisor" in their Reinstatement Department who REFUSED to take accountability ofr the fact that their was a miscommunication regarding my payment and was obstinate in his insistence that this was a so-called "valid repo." What even angers me more is that they don't want to take accountability for their mistakes and won't release my car back to me, the last payment that posted has me less than 90 days past due. This is POOR customer service and unfair business practice - they didn't even send me any notice of intent to repo the vehicle, which they are REQUIRED to do under the law!

I want my car back NOW - and I want a lawyer to help me go after these people.

Santander took over my account in Sept. 2010 from Citi Financial Auto.
I was in the hospital suffering with severe depression. I wasnt receiving my mail as I was in the hospital. By the time i was released and able to manage my truck payments i was 3 payments behind. called citifinancial only to be told they had no account for me. Finally received a letter from Santander consumer so stating I was 3 months behind. Made two payments was told they would defer the third. Walked outside to find repo man dragging the truck out of my driveway. not flat bedding dragging. the truck was dragged for an hour. Finally found out from santander after 2 days who the repo company was. I was told if I made the third payment which was suppose to be deferred I cld get my truck. Did this over the phone. Called repo company was told I need to make 3 more payments before the repo company wld release it but for 60 dollars I cld get my stuff out of the truck. Drove an hour to the truck paid the money was taken to truck only to find the backend all twisted from be dragged. never got a notice for intent to repo, never got a notice for intent to sell. BUT I DID GET TOLD BY SANTANDER THEY WERE FIXING THE TRUCK FOR 6 weeks. Today got a letter informing me the truck was sold for $3,759.00 dollars. I owed $4,271.32. the bill is now for $14,113.26 due to a deficiency charge. They can freeze my bank account and put a lien against my house if I dont Pay. I don't have that kind of money and they wont accept payment arrangements

SANTANDER HAD JUST ENTERED INTO AN AGREEMENT WITH CITI-FINANCIAL TO SERVICE THIS ACCOUNT AT THE END OF AUGUST. THE FIRST PAYMENT IN THE AMOUNT $464.68 WAS MADE TO SANTANDER CONSUMER ON SEPTEMBER 29, 2010. SANTANDER STATES THAT THIS PAYMENT WAS RETURNED TO MY FINANCIAL INSTITUTION ON OCTOBER 15, 2010 AS INSUFFICIENT FUNDS. I EXPLAINED TO THEM THAT THERE WAS NO RECORD INDICATING THAT THERE WAS A NSF ENTERED INTO MY ACCOUNT. THEY ASKED THAT I PROVIDE MY BANK STATEMENT TO THEM IN WHICH I DID. THEY DID NOT WANT TO ACCEPT THIS DOCUMENTATION. I THEN CONTACTED MY FINANCIAL INSTITUTION AND THEY PREPARED ON THEIR LETTERHEAD INDICATING THAT THERE WAS NEVER AN NSF TO SANTANDER. I SUBMITTED THIS INFORMATION TO SANTANDER BUT THEY REFUSED TO ACCEPT THIS INFORMATION ALTHOUGH IT WAS ON LETTERHEAD FROM MY INSTITUTION.MY INSTITUTION ALSO PROVIDED A CONTACT NUMBER FOR SANTANDER TO CONTACT THEM REGARDING THE INCIDENT. SANTANDER NEVER CONTACTED THE INSTITUTION REGARDING THIS INCIDENT BECAUSE I CONTINUED TO CHECKED ON THIS SITUATION. I FINALLY OBTAINED AN ATTORNEY(PRE-PAID LEGAL)AND THEY CONTACTED SANTANDER IN FORM OF LETTER FROM NOVEMBER 2010 UNTIL JANUARY 2011 AND WERE UNABLE TO RESOLVE THIS ISSUE. NOW WHAT ELSE SHOULD I DO? I financed a 2010 Jeep Islander through Citi financial in April of 2010. The loan was sold to Santander. In August of that year my wife lost her job and we were struggling to make the payments. We would send every month at least half a payment which were not counted as payments at all. In November we were contacted by Santander and got the 2 payments we were behind tacked on to the end of my loan catching us up. But Santander still reported it to the credit agency as being late. We have a friend that is going to take over payments on the Jeep, and has already sent them money, but they will not seem to send him the paper work that they keep promising to send to get everything out of my name and in to his. It is showing up now as a repo on my credit report. It has not been repossessed and in fact they are getting current payments on it. I am now trying to trade in my truck because it is starting to break down on me and I cannot do so because they will not say that the loan has been transferred. Nor will they send a fax, or email, or even talk to anyone on the phone about the fact that the Jeep is no longer mine.

My monthly payment is 595.00 per month, and I have made 18 payments (totaling $10,070) and still owe more than the total purchase price plus loan interest. Santander took over my auto loan from Triad/Roadloans in January 2010 without any notice or communication. I had stop receiving payment statements as well. In February ’10, I filed for chapter 7, but excluded my auto loan and continued to make payments. In July of ’10, I received a phone call from a repossession agency notifying me that my car was being repossessed. I call Santander to inquire about the repossession and found that Santander did not map my Roadloans account number to a new Santander account number they had assigned to my account. The checks that I was sending Santander under my old account number was being applied to someone else account. I forwarded the agent copies of the checks and she stated that she would to credit the payments to my account and suspend the charge back/repossession procedures and return my loan payment status to good standing. Again, I did not receive any correspondence from Santander, thus I thought my account status had been restored to good standing and my status was fine.

Fast forward, to February 18, 2010. I was visiting my son and on my son. I was told by his mother that my car was missing. Needless to say I was not happy. The next day I called Santander to inquire if they had taken my car. The customer service agent was so rude and would not take the time to explain in any detail. I mentioned to him that there was an error in my account and that it was never corrected. Now, I did miss payments for December ’10 and January ’11, but I had mailed a check in for December ’10 in which Santander cashed Monday, February 14, 2011. I had planned on mailing them another check for January’s payment on the Friday when the car was taken and another the final week of February to get caught up. Since I did not get any assistance from the agent, I waited until Monday February 21 to contact another agent. In the mean time I was left without a vehicle and not sure whether or not I was going to get it back, thus I took the payment that I was going to send Santander and purchased a car from a friend.

When I got the new agent of the phone February 21, she assisted in reconciling my account and mentioned to me that they should have not taken the vehicle. Santander had made the changes to correct my account back in July of 2010, but they did not reverse the charge back in the system. Thus I had been paying on a car that had been charged off in July of 2010. Not only did they not reverse the charge back, but also due to the sale of Roadloans to Santander, my forgiveness of 2 payments missed in December of 2009 were not recorded on my account. When I asked for the payout balance, it appeared to be a higher amount than I it should have been. I believe that there had been some additional charges placed against my account. My records indicated that I had a balance was around $11K on the vehicle and there’s indicated a balance of $15k. I’m not sure of what the other fees were but I made my concerns known to the agent. The agent mentioned to me that I could possible pick my vehicle up in 2 days. She had put in the request to reverse the charge back, but it was going to take a couple of days to reverse. After a couple of days, I realized that I no longer wanted the car that was taken back from me in error, thus, I plan on letting Santander keep the car.

This experience has left me not willing to deal with Santander and their business practices. Since I have made this decision, I went on the internet and found that there are hundreds who share my experience since their auto loans had been sold to Santander. To add, they made me drive for 2 hours to a small town north of my city to get my personal belonging. When I arrived at the repo location, I was informed that the auto was moved south to another location that was 40 miles from my house. I had to wait 2.5 hours to get my belonging. The agent at the auction center said that this was very unusual. I hope that the attorney general or some other federal agency investigates Santander’s business practices.

I expect them to sell the vehicle in the next couple of days and bill me for the balance like they have done too many of their customers. I fully intend to file complaints with everyone who will listen. I have CC’d my local and federal agencies to voice my concerns and experience with this financial institution. I have also included a link to hundreds of individuals who are not happy with Santander’s business practices. Is there currently a class action suit against Santander either locally or nationally and if so, could you direct me to them.

So I called them they said it was set up for Feb. 2011 to be taken out I said ARE YOU SURE they said yes, I said so I dont have to worry about Feb. payment they said no I was like ok thinking this was going to get somewhere. Well Feb. came around and they called me on the 12 asking were the payment was I was like you should have taken it out of my checking they said no nothing in our computer states that I was like WHAT I told them I talked to 2 different ppl in Jan to confirm this they said nothing showed that I told them to go back to ALL the phone conversations they have ever had with me and re view, So by this point I was really really upset so I got to thinking this past friday the 25 Feb. 2011 wanted to see what my pay off was now mind you I payed my Jan payment with a money order because they didnt take it out and wanted to charge me like 13 dollars to take it by phone so anyways I was checking to see how much I owed on the car 11,800, I was LIKE WHAT THE HELL I owed that like 4 months ago. Every since this Santander Consumer USA took over for CitiFin, it has been a nightmare for me. For the last 3 months they keep telling me they are not getting my payment I have mailed to them in the return envelope provided by them with there address preprinted on the slip, so I have to pay the extra 14.95 or 10.95 fee they decided to charge me. They like to call 10-15 times a day from different numbers not leaving a message and I have even had a few of them hang up on me when I answer. Not to mention the Sunday phones I get from them. This month they stated they did not get my payment I mailed to them so on the 16th I provided the checking account information to the man on the phone to pay by payment, then today I get a call stating the payment from the 16th was returned due to wrong routing number, and If I don't pay my payment they will be at my house to pick up my truck tonight and this is going on my credit.. Really are you kidding me, not only was 1 check mailed in on 2/4 but a new one was giving to them on the phone 2/16 and you are talking about coming to repo by truck. This is just craziness, I think this company needs to be stopped and sent out of business. Every person I have ever talked to has been rude and don't care about anything and want to make me feel stupid. This is not my fist auto loan this will be the 4th auto for me to pay off, they also have my payoff about wrong so I have asked for a complete copy of my contact I signed when I first got my truck they said I will have it in 7-10 days we will see. I have had my account with CitiAuto since 2005 for my 2003 Toyota Camry for 2 years I had no problems with anything but then Citi Auto changed their payment processing and there system which in turn caused them not to draft from my checking account for 3 months. Citi Auto and I caught the problem and Citi waived 2 payments and I paid the 3rd and switched to another bank for my auto payment all went well for another 2 yrs until just today 12/15/2010. Today my wife calls me at work and ask who Santander is and why would they send a questionaire about there service and she called them and they told her they bought our Citi account in September and we had not made our payment since 9/26/10 and I called and check our account and it they were right that it had not come out. Well my problem with this is I was never notified of my account being sold, never being notified that my payments would stop, and its a week before Christmas and the money I thought was being AUTOMATICALLY taken out was in fact not being taken out. To make matter worse I called Customer Service to see what could be done and was told "To be an Adult and Pay My Bills" and I asked where is the courtesy call or courtesy Certified Mail that my AUTOMATIC Payments would stop and was told "There Not In The Business of Courtesy they are here to Make People Like Me Pay Their Bills". I work in Banking and this was quite frankly the absolute WORST Experience with A Company a so-called Customer Service and just overall lack of respect for people when the company themselves are the ones who did not notified in any way of what was happening. The customer service that was telling me I have a responsibility to contact and update information asked me my address and had my address from a year ago on file I gave her tonight 8:36pm EST on 12/15/10 my address for where I have lived since February of 2010 and told her Citi Auto sent me receipt each month and then went on to tell me I was lying since I used to get receipts from Citi I should have noticed something and contacted them but would not let me finish to tell her I just assumed it was either PAID OFF or simply another change in processing. I thought the money was in the account but my assumed that it was already taken out and has used most of the money for either Christmas or other bills. I told Customer Service that I would let them put in on the back of the loan but I do not have the money to pay for Their Mistake, I do NOW however realize never to ASSUME that Automatic Payment arent automatic and Banks Errors cost me and the worst time...

I was not even aware that they horrible people bought the loan from roadloans.com. I had to find out by viewing my credit report online. From Oct-Dec 2009 I was getting over 8 calls every day from these people. They harassed me to no end.

I am a survivor of DOMESTIC VIOLENCE! I was forced into cosigning for a car that I did not want in 2004. I signed under duress, and fear of what my now exspouse would do to me. That was the WORST mistake (second to being married to an abuser). After he threatened to STAB me in July 2007, I started to get help. I moved out in Jan 2008, and filed divorce.

The judge ordered him in stipulated judgement to get that car refinanced into his own name. Well, 2.5 years later, this loan is STILL on my credit reports. It is being reported late. I never ever got any statement in the mail to notify me this loan had been bought by santander. They refuse to send me any documents about this car, because they told me I was not the primary borrower.

I have called them several times recently to try to get them to remove that account from my name, and my credit reports. I faxed all court documents, and even mailed them two copies certified mail over 8 months ago.

Last week they reconfirmed receipt of all documents. They refuse to take my name off the loan. I have no idea where the car is. I have not seen it in nearly 3 years now. I had to move 100 miles away just to be safe. Santander will not return my calls.

They claim I am responsible for $19K on this car. Yet, I have to see one statement. They will not delete it, and could care less if my life was in danger. They just told me "oh well, you signed a contract."

I am not even the registered owner of this car.

The contract I was forced to sign is not valid, and needs to be cancelled. I just want my name, and my credit protected from that batterer who tried to kill me. He is dangerous, and I do not deserve to have my credit ruined indefinately until he finally sells it. It is NOT MY FAULT, he is not paying them on time.

Where is the justice for women who were abused, and had to start over with literally zero?!

Per court documents, I am NOT responsible for that car. PLEASE HELP!

I will be filing complaints with Dept of Cosumer Affairs, Federal Trade Commission, and CA & TX Attorney State General office.

I want this company brought to justice, for violating my rights under the Fair Credit Reporting Act, and Fair Debt collection Act.

Thanksgiving morning we awoke at 6 a.m. and found that our car had been repossessed. When we called back to find out what had happened, we were transfered to 3 different extremely rude people who told us we would have to pay $798 to get our car back. We kept asking to be transfered to a supervisor, but got hung up on 2 separate times.Finally they said it was a repossession error and a restatement coordinator would have to call us back in a half an hour. It has been 3 hours so far and we don't know what we should do after reading all of the article posted against Santander on the internet.Please help. The "customer service" reps are NOW saying that on top of the original $798 fee there is an additional $400 repossession fee, plus the fee from the car lot, totaling over $1000. They are now also not admitting any error, but instead trying to bully us into making a payment and telling us it is OUR fault it didn't post until the 25th. No one ever called us back " due to the triple volume" of phone calls today (ha....no wonder). Everyone we have spoken to has had horrible attitudes and been incredibly rude. The only thing we can do right now to get our car back soon is borrow the money ....pay them ... and pursue different avenues of reimbursement in the future. I have read numerous articles on class action law suits against Santander and it's affiliates. There are no listings for any other phone numbers online. When you call the "customer service" department and ask to speak to a supervisor, they just transfer you to another, even ruder, "customer service" rep. and then even hang up on you.

Case 1- Auto was totaled and while waiting for insurance and gap to pay (6 weeks), they reported me as a charge off and skip. Received 3 different amounts for a payoff for remaining money owed. Now reporting as pay off after charge off and skip. Was told by one employee that maybe I should pay my bills on time and that wouldn't happen. I hadn't had a single late pay in over a year before the total loss happened. Before the total loss, they would call me the day before my due date to find out where my payment was. Case 2-auto was traded, they rolled it into loan for auto in case 3 below, now showing multiple late pays that they will not verify or remove. case 3/ took over a drive account, originally a triad account, car was totaled without insurance and repo'ed in 9/2004. Santander now reporting as a recent repo on me and my husband, he was never even a cosigner on the original account. Sent letter asking for validation of debt, received a letter stating that it was verified for both my husband and I, but sent it for the auto mentioned in case 2, which he was also never on the loan for. Refusing to remove, validate, or change reporting to credit, despite two request letters. Sent a third demand of removal letter to them today.

I was also told that if i get 6 deferments, which means that i get two late payments moved to the end of my contract then the contract dates move and more interest is added to my account, then I am eligible to be able to receive payments decreased half way. Then i have been harassed by customer services, i have received 10 calls a day when my payments are late. I was once called vigor names by a customer service representative and then he started yelling in the phone. These never stop i also have received calls up until 3am in the morning, which causes my children to lose sleep and causes distractions within my home. I have tried my best to keep my vehicle and have fallen short on the journey of paying this vehicle off but there is no help from the Santander and drive company. had a car loan with HSBC, and no letter or notice of my loan was sold to Santander sometime after March of 2010 my last payment to HSBC was March 3 2010. On that last statement I was 3 months a head of my payments with HSBC. In April I got a statement from Santander and on there statment I still was 3 months ahead. and I never recieved a billing statement from them, but I continued to make my payments with a copy of the statement from April. I didnt not receive and statement for 4 months, I never got credit of the payments that I made, on their statemant also did'nt not being the number of payments made down they stay the same, I made 6 payments and the only showed I made 1 payment for the very first statement I got.
I got my bank statement that showed proof of all payments and they had stated that I money that they received was going to interest only, with what they call a compound interest daily.
Now they are sending my statement late making it my payment late. This month I tried the online payment, thinking that would make it better, well same thing happened in 3 days time from that online payment I started getting phone calls they again did not credit my account.
The following amounts have been taken from my bank account by Santander.
On Nov 2 2010 a payment of $291.53 On Nov 9 2010 $601,01 again they demanded that amount to get my account up to date.
I can go on and on with all the harrassing phone calls , I even some how got my husband work cell number that is not listed to him and continue calling.
Please this loan trouble is making me mental drained and even starting to make me physical ill.
Thank You taking the time, and hope that something will be done soon. Before my car get taken, and I have no legal proof of their action. I research thousand and thousand of letter and complaints to Santander, and I just dont understand how this can continue to happen. How many more good people will have to suffer before something to done.

I was in an accident on 06/01/10, my insurance company paid and my gap insurance paid. I had a $500 deductible. While waiting for insurances to pay I continued to make two more payments because I was threatened by Santander if I didn't continue making payments they would charge me large late charges. My two payments totaled $430.76. To me then I should just owe $69.24. I was told by managment they charge me $0.05 a day interest. Now since the accident, I was given about three different payoff amounts, each time I call I talk to somebody different. I have asked to talk to a manager and was told "NO" many times. The last person I talked to was supposed to be a manager and he told me that the payments I made AFTER the accident dont count, I dont get reimbursed for them or credited for them. That doesnt even make sense. They kept threatening me that they will ruin my credit if I dont pay $642.37. I told them I will send a letter of explanation and I will only be paying the $69.24 and the $0.05 a day (only since the accident 163 days @ $0.05 a day equals $8.15); which would make the total I paid to them on the 10th of November $77.39 . I told the manager then please take me to court and try to explain what you are telling me to a Judge. He said "ohh no!!! we wont take you to court we will just ruin your credit with a charge off on your credit report." I told him that this statement might work with most people but I dont care, try and ruin my credit, but you will not take advantage of me. I suppose most people when they hear that statment will just cave in and pay it so their credit isnt hurt. I refuse and Im tired of being taken advantage of by them. If there is a class action suit I would love to be included in that....please contact me. There was a lot more that happened but I shortened it quite a bit for this. One thing I was never given was how they came up with this amount.

Sick of the unlawful mess, harassing collection calls 5 times or more a day, after making payments no balance change, high interest rate and as of 2008 I filed a chapter 7 no loan modification offered. I am sick of the unfairness paying $600 a month and no consideration on thier behalf. I have $0 liability for the car since the chapter 7 discharge. I have an auto loan that I had for the last 3 years with a company called Road Loans.About 6 months ago Road Loans was purchased by Santander.

While with Road Loans I have always had my payment paid electronically through
through my spouses bank account as we both have loans that belonged to Road Loans and are now through Santander. My spouse has always referenced my account number and name
on the account to insure payment was correctly applied. This has never been a problem.

Recently, an electronic payment was made by my spouse on September 2nd, 2010 through the Bank referencing my name and account number. Shortly after I began receiving harassing phone calls from Santander that my auto loan payment was late. My spouse and I kept explaining that it was paid electronically through my spouse's bank. My spouses bank even showed that payment was received and posted on September 3rd, 2010. I continued to receive harassing phone calls and each time I asked the customer service rep to investigate with Road Loans because the payment had cleared and each time the rep told me that they weren't going to do anything and that I need to investigate. By accident my spouse discovered the problem when opening their bill from Santander. Santander and applied what was a payment for my auto loan to my spouse's auto loan, which made no sense because payment was already made on my spouse's auto loan and it would have been paying 3 months in advance. Also, the account that payment was applied to referenced my old account number and my name. Santander changed my account number and did not tell me. I did not know I had a new account number. My spouse called their bank and initiated an investigation with the bank against Santander. The bank contacted Santander on October 15th, 2010 and had a three-way call, which included the investigator from the bank, Santander, and my spouse. During the conversation Santander agreed to correct the situation within 3-5 days. It has been 6 days and I checked my Santander account online and payment has still not posted and I still continue to receive phone calls from them. I have worked in accounting and I know that you never go by the name on the check or payment. You ALWAYS go by the account number or name that is referenced. This is very basic and yet this large company can't seem to understand that. Additionally, this should have been a one-minute fix. I do not understand why, to this day my account has not been corrected. This is fraud. They do not intend to fix my account but have added late charges for their mistake. Also, I asked for a fax number and they refused to give me a fax number. When I finally did get one from a rep the fax would not go through because the fax never answered. I went to their website and did an online chat on October 21, 2010 to explain the situation AGAIN and here is a copy of what happened:

No one has ever offered to help me or has been able to help me. My spouse spoke to them AGAIN on October 21,2010 and asked for their legal department and their corporate office phone numbers and the rep said they do not have the number. My spouse asked for the address and they refused to give an address. All that the reps do is collect money and tell you to pay. They are useless.

My spouse sent this email to the bank on October 21, 2010: Santandar still has not correctly applied the payment to the correct account. I spoke to them today and they were unable to answer any of my questions and they were unwilling to help me. According to them, they say that they requested certain documents to be faxed to them, but according to my records, which are from you, they made no such request. I asked for phone numbers to their coorporate office and they fefused. Can you help me deal with these people? I paid them yet they won't apply my payment.

They asked me to fax documents and there is no answer when you try to fax them. What kind of company does this? They purposely try to make it so that you can't create any records with them so that they can add on charges. Also, when my spouse had the 3 way conversation with the bank and Santander no one requested that anything be faxed because Santander said that they would take care of this. Besides, what is there to fax? They have the money. They are sitting on it and they are trying to get my spouse to pay their car loan 3 months in advance and tell me I'm late so they can overcharge me. They are criminals. This is fraud. I would like to take legal action against them. They are beyond unprofessional. They are incompetent and the worst company I have ever dealt with.

Santander bought my loan from United auto credit in May 2010. My account was to have matured on april 27, 2010 but because i deferred 3 payments in the course of my 5 yr loan, those payments were put to the end of the loan, making the mature date July 27, 2010. i have left over interest payments to make due to the deferrments. i was told by santander that i have 120 days to pay the interest. everyday they call me, they have reported my payments late to all 3 credit bureaus, they charge me $20 every 10 days that my payment is "late" and they charge me daily interest on the interest owed. I am currently one month behind on my 2007 Chevy Impala. This agency was sold my contract without my permission by City Financial Auto. I did not have an American working with me with my past car loan, rather someone from East India, or some South American company. Santander knows I am having difficulty making a full payment and will not lesson the payment to help me. I have read about the scam that they are and I do not want to be their latest victim. They should be shut down. All of the good people and myself making complaints should have our car and other vehicle loans refinanced by a better, more fair, and legal business. I had been told by an agent calling that I had until friday to make another payment when I had just made a partial payment on a 400 a month note. She threthen to repo the car. It was around christmas they came in the middle of the night and repo the car. I spoke with them about the partial payment I had already made but she told me I would have to come up with all the fees of repo before I could get my car back and I would have tobring the money to them to pick up the car. and that point I was already hurt I had already made at least a partial payment and really could not afford to give money away but you took the car anyway.

I had a 2007 Ford Mustang with a loan through HSBC Auto (which was acquired by Santander). I made the agreed upon payment, and they still took my car.

On 10/6/10 I talked to a collections rep (name unknown) with Santander who told me that my car had been assigned for repossession and I would need to make a payment of $275 by Friday, 10/8/10 to stop that from happening.

On 10/7/10, I made a payment of $310.

My car was repossessed ANYWAY the night of 10/7/10 - 10/8/10.

When I called Santander to get the situation resolved, 3 people (an account manager named Tasha, a collections person named Margaret Mays, and another account manager named Ed) said that it was their mistake or they empathized with the righteousness of my situation but they said it was out of their authority.

I was transfered to a woman in "reinstatement" (name unknown) who claimed that the reason the repossession had occurred was that since my payment had been made after business hours, the "stop" on the repossession had not reached their repossession affiliate.

At this point, I felt that although I had already missed a day of work at my new job for this, it was a relatively easy fix. They just had to contact their affiliate repossession company and have them return the car to me ASAP.

The woman in "reinstatement" with Santander said that what I had been told about having until 10/8/10 to pay was from "a different department" so therefore, it didn't matter, and that in order to get the car back, I would have to pay the ENTIRE past due amount, repossession fees of approximately $500, and whatever fees the the repossession company might choose to charge me. Her explanation was that because the message between them and the repossession company was apparently "crossed" that they are not at fault.

Yet:
- I had been told I had until Friday to make my payment; the payment was made Thursday, it posted Thursday, and the car was still taken Thursday. Even if their story about it being after business hours on Thursday was true, it wouldn't matter because I had been told I had until Friday anyway.

- The repossession company is their affiliate.

- It doesn't matter if I had been told by a different department, it's all still the same company.

I asked for a manager and was twice disconnected in transfer.

I called back and spoke with a collections person named Sal who repeated Santander's line "shedding responsibility". I asked for his manager and was transferred to Mario Compean who identified himself as Sal's boss. He also repeated Santander's refusal to rectify the situation. In addition he said that the 3 previous employees who had said that I was in the right would be disciplined for putting the company at risk.

I explained to Mario that if that was Santander's position, then I would file a complaint to the Better Business Bureau - which I have done. While he did not "write-it-off", he did not seem concerned.

Mario transferred me to a voice mail for Terra Stewart who is apparently a manager in the "Reinstatement Department". I left a message for her to please call back, but have not heard from her.

A fair resolution would be for "my car" and my property returned to me as soon as possible. Without any problems, "hoops", or fees from either Santander nor their repossession affiliate.

Our daughter died, her car was financed with Citibank, during negotiations with Citi to pay cash/blue book value for the lemon sold to her, they sold the car to Santander. Knowing that our daughter was recently deceased, Santander would call asking to speak with her and refused to negotiate with us. Instead they charged late fee and interest on a deceased customers vehicle.

Yesterday, they sent guys from Renovo of Grand Rapids, two trucks, who went door to door my neighbors, instead of knocking at our door. Later that evening one approached our home, no paperwork, telling me to open the locked gate so that they could repo her car. He called the police and said that I pointed a gun at him. I had also called the police to have him removed from our property.

The law states that locked property cannot be entered to repossess a vehicle in MI. The female police officer, disregarded the state law/civil issues and order me to unlock the gate and they took her car. The officer looked at the VIN only after the repo truck was in our yard. Giving them blanket permission without verification.

Citibbank never sent notification that the contract had been sold.

We have filed a complaint with Detroit Police Investigative Unit.

My wife also now has an account with them. Again she was never notified. We got our free credit reports and this is how we realized this. They recently reposessed my car with no notice. I say no notice as in I had no idea who they were. Nothing from Citi telling me of a transfer, nor from them with any type of statement. Also My wives balance prior to them taking over was under $1000 and now is stated as close to $2000. I would like to sue to illegal repossession and fraud. I would also like to press charges for grand theft auto.

I had a loan with HSBC that was taken over by Santander (Drive Financial). In April 2010, my truck was repossessed by Santander. Granted, I had made a few late payments with HSBC, but never more than a month late. I was sending payments to HSBC and was never notified that Santander had puchased HSBC's Auto Loans. I spoke with the driver that was taking my truck; that's the only way I found out about my loan being bought out. After paying the required money to Santander ($1400) the day my truck was repossessed (this is more than what was already paid to HSBC for the same time frame - HSBC got $936.00), I went to the company that "repo'd" my truck and had to pay $498.00 to get my truck back. After I paid this, I was told my truck was being auctioned off. Understand that the payment to Santander was done via Western Union and the payment to the "Repo" folks was done by certified check. This does not include the $26.00 (x2) that I had to pay to the Police Department for a piece of paper stating that I did not report that the vehicle was reported stolen. One copy went to Santander and the other to the "Repo" company. After being told my vehicle was sent to auction, I then rushed to the auction place to pay another $75.00 for a storage fee to get my truck back. This all happened over 48 hours. Now, my vehicle was paid off early on 9/11/2010. Here we are, 10/11/2010, and I am still receiving phone calls from Drive Financial stating that, as of today, my payments will be 60 days past due on 10/15/2010. The vehicle is paid off! I am told by Santander's Credit, Customer Service, and Title Department that there must be an IT glitch in the Credit Department because there is no balance due, but my title will not be processed (even though the truck is paid off) because I am over 30 days past due on my payment! Here's the kicker. I offered to make a payment, even though the truck is paid off, but was told I cannot make a payment because there is no balance due! Summary: My truck is paid off, but their credit department has an IT glitch, I continue to get threatening phone calls (5-15 a day), but I can't do anything about it. Aside from hiring a lawyer, can anyone tell me what I can do?

I have a 2003 Ford F150 with original loan from First Essex Bank. The loan has been sold several times over times over the years, to Sovereigh Bank, Drive Financial and now Santander. The maturity date was March 2010. Under Sovereign I had two deferments, bringing it to May 2010. I have made all my payments, yet Santander says I still owe them principle and continues to add penalty and interest to the loan. They call daily, 4 times a day. I have requested 5 times for a copy of my original signed agreement and a complete payment history since loan origination and they continue to not send it and still have the title.
Every time they call me, each rep tells me a totally different amount that I owe. Some lower, some higher and significantly different.
This vehicle is paid off, and they are trying to collect more.
Yesterday I sent them a Debt Validation notice, certified mail.

I receive several calls a day, in regards to my 2001 Chevy Tahoe. Some time early this month (( September )) my car loan was sold to Santander. They stated that I was 45 days late, and they want $690.00 or they were going to repo my truck. They keep telling me they've sent it, and have never sent it. I am confused - they want payment sent to a P.O. box, not to a company. And they want my bank information as well as plate number. I told them I would send a payment to them but I wanted some sort of notification stating they would *not* take it if I paid it, and they said they can't say they will or they wont. I've also been giving different amounts that need to be paid; first it was $300.00 and then $690.00.

I've asked to speak to a supervisor and there's never one around. I am sick of the harassing phone calls and being threatened to like a lowlife. If anyone can help me, I would greatly appreciate it. I am to the point where I'm going to hide my truck so they can't find it until I get satisfaction and treated like a human being.

I had no idea till today that Citifinancial had sold their company to Santander. I had an agreement with Citi that I was going to be a couple months late due to hours cut at my job. They deferred me. I paid $100 last week because that was all I could, then I called today to see if they recieved my payment and I was told I owe over $1000K!!! I was shocked and upset at this. I told them I could make another $100 payment and the guy I spoke with was so mean and nasty to me. I can't help if my hours get cut. He said they would come get my car if I didn't pay at least half. He said he could hold a check for me till Tuesday. I was FORCED to give him my account information because I was in such shock and horror that my car might be repoed. I am at a loss and feel stupid and betrayed and lied to and forced into paying half of which I know I don't owe! I just did this not 30 mins ago. I feel like an idiot for giving him the information. He made me feel like I was scum for not having any money. I also don't have the money he forced me to pay. I was overwhelmed. I'm still overhwelmed. I don't know what to do now. I'm at a loss. I received notice one week ago that Santander is now handling my auto payments that were with Citifinancial. After visiting their site and trying to log on with my username and password from CItifinancial's site as they said it would work I had to call their customer service twice, because the first time I was hung up on after an associate put me on hold for 5 minutes.

The second time they said I had to go back to their website, follow a bunch of steps, then submit my request to have my password reset.

After I received the email to reset my password, I then logged on hoping to pay for my account online via their site and not have to pay $10.95 as they charge to do so over the phone as I used to do with Citifinancial for free. NO LUCK! They charge $10.95 whether you pay online with checking account/ATM/credit or over the phone. You can mail your payment but it takes 7-10 days to post which means you'll be charged interest and late fees. They know it's a setup, which is why they try and sell you on the fact that paying the $10.95 will 'save you' from paying more in fees late if your payment isn't credited on time.

I'd have no problem mailing my payment 14 days in advance if I hadn't read online from various sources that people who send in payments via check have the amounts altered and initialed by an employee or someone rips off their account info and suddenly random charges start appearing on their accounts.

I tried to pay online tonight to 'ensure' my payment won't be late to avoid fees, even though it's 10:15pm on 09/19 and my payment isn't due until 9/27. But when I hit submit, the page when to an epmty site that just said 'contacting client' and flickered for over 3 minutes. I hit refresh and still, nothing. Now I have to wait 2 days to see if the payment cleared, then I'll have to call. Ughh! Well, I know in 2 weeks I will be getting a money order and mailing it because I will not pay $10.95 to PAY a bill nor risk giving these jokers my account # cause they hire unscrupulous employees.

Good thing my car is paid off in 7 months.

PS- There is one other way to pay for 'free'. Sign up for automatic payment deduction. Yes, give them your account number and access to take the money from your account every month. But, when it's time for your car to be paid off, what's the guarantee they'll adjust the final amount and won't over charge you. Good luck getting your money back! You have to give them 30 days written notice to stop auto payments. Seriously, there needs to be a federal law preventing companies from charging you to PAY THEM!

Next time I finance a vehicle, I WILL NOT select anyone that has Santander collect their payments.

My original auto loan was through HSBC Auto Finanance, which was sold to Santander. My payment has gone up, I have had issues with arrangements I have made with reps on the phone not being honored, and santander has harrassed me calling 10-20 times per day on private numbers -- some of which are cell phone numbers on the same account as my cell phone that were never provided to Santander or HSBC.

They have called my parents, my in-laws, my friends, my jobs, etc. and have disclosed to ALL of them that I am delinquent on my car payments. They have sent a repo man door to door through the neighboroods of my mother, father, and in-laws passing out business cards, telling them to look out for my car and telling them that it is stolen, that I owe money on it, that there is a reward, etc. They have even gone as far as to call my job repeatedly posing as "a friend" of mine, making me look like I am getting personal calls at work.

I tried to pay off the car just to rid myself of these people and was told my payoff value on a $25,000 car was $23,000 after 26 months of payments. I asked the rep on the phone to explain this figure, to which the rep laughed at me and said "that's what you owe." I said that this amount was fictitious and I would be taking this matter further, to which he laughed again and said "Good luck, buddy." This is my worst nightmare come true. PLEASE HELP.

I was originally paying my car note through HSBC. The loan was switched over and bought out by Santander Consumer during the week I made an actually payment using Money Gram. I was unaware of the change-over until the Representative doing the Money Gram said the code was wrong for HSBC and it wouldn't go through. I then mailed HSBC the payment. It was never applied to my account and Santander has it noted on my account as funds not available when they tried to retrieve the funds.. HOW CAN IT BE FUNDS UNAVAILABLE WHEN IT WASN'T A BANK ACCOUNT.... IT WAS A MONEY ORDER!!!!???? I am constantly begging these people to stop calling my job. They actually spoke to a Nurse at my job told her how much I owe, gave her all kinds of personal information and she got upset and stood up for me.. This is a constant thing with them calling my job against my wishes and they don't care about any privacy laws.... They call my cell phone all day everyday including Sunday's and Holidays. I want to sue them for the amount owed on the vehicle (from the point where they took my payment then claimed it was lost) I'm not looking to receive and money. I just want to sue them for the amount left on the vehicle for the stolen payment, accompanied by the lie they put on my account to cover their own A**es & the harassment at my place of employment.

I had a previous car loan thru Drive Financial on my last car. When I purchased the car that I have now in Nov. 2008, I again financed thru Drive Financial which ended up being sold to Santander. I was not notified of this until I was late on a payment due to medical issues. They left a message on my voicemail and the rep stated that she was calling from Santander. When I called back to see what the call was concerning I was told about the change in companies. I made all of my payments on time up until I was laid off from my job at that time. I received one deferrment and caught up the next month after receiving unemployment. This was in July of 2008.

I made all payments after that on time until I got sick in January of this year. I made payments less that a month late, which is something that I was able to do thru Drive Financial from time to time. I was only charged a one time late fee of $10.33. (Due the 19th of the month and made the payment on the first of the following month a couple of times) Late payment was only to be collected if received after the 10 grace period.

I have been granted disability by the state but it took about 4 months for this to get started. I paid the payments in two payments per month. Got a call from one of their rude representatives who stated that of 30 payments of $500.25 that I have made ( 15,007.50) only $1500.00 had gone to my principal. My contract states that I have a 10 day grace period but the rep told me that for everyday that I am late making a payment they charge me $10.43. My payoff amount is 18,000 and the total amount of the car was only $20,384.03. They have also called my family members giving them more information than they should legally. They have even googled my last name (it's unique) and the state that I live in and have called family members that I don't even have listed as references. They are extremely rude and disrespectful when they call 15-20 times per day. I would really like to be a part of this law suit. If nothing else I would just appreciate being able to give these people this car back without being penalized on my credit report any more than I already have with them reporting payments late that weren't late. Any and all assistance would be greatly appreciated.

I got my 2007 Chevy Cobalt on April 13th, 2008 and my loan was given to Drive Financial and then Satander Consumer. My payments are $468.71 a month. My car was worth 13K at the time I got it and I have not been able to make a single payment towards the principle balance because of misc fees that they refuse to explain. I have called repeatedly over and over and over and over about having the principle refinanced only to be met with threats to repo the vehicle. How is it logical to pay over 10,500 dollars cash in just interest alone over 3 years and not make one dent in the principal AT ALL!!! I'm sorry to reapt myself , but this is just absolutely mind boggling to me!! I have now been given to the so-called "service" manager who has basically told me that if I don't make payments which break down to about 405.00 bi-weekly they will come and repo the car the car. This was given as the answer to them refinancing the principal of 12,500 to which I still owe after 3 years of making payments of 405.00 to which they can't even explain why they only have credited just 26 payments. My husband has the note in his name alone. They call him and his work at least 35 times a day. They got a hold of my number, now they call me about 10-15 times a day, all hours of the day. Constant! They lie, they just want your money and, when you give it to them, they want more! It all started on 3-7-10 I recieved a letter from Santander that they reached an agreement with HSBC to serve as a third party servicer. On that letter it said " If you currently pay using automatic bank draft your regulary scheduled payment will continue uninterrupted" Well that was not the case I recieved a statement on 3-29-10 that said I was late I contacted them on 4-5-10 and asked why I am late and what had happened The operator Carmella said that I had stopped the payment, I asked her why I would do that first off then told her I had not done that and her company made a mistake, I asked to talk with her supervisor Marshall came into the conversation he told me the same thing I had stopped the payment well I went to my bank and they had no record of a bank draft nor a stop payment that I had made. After I told him I was not late and his company did this I asked him to defer the march payment to the end of my loan since this was a mistake and I had never been late in the 36 months on the loan. He said to me I cant do it because you are now 22 days late. I then asked him to speak to his supervisor and he told me "I am as far as it goes" and he would not be transferring me to noone else. I then went back to my bank and got a printed copy of all transactions and not one was from santander.I called on 4-15-10 to see if the autopay had started back it had not so I called and got in touch with Racheal another manager I told her what was going on and proceeded to pay for aprils payment I told her the march payment was not settled yet, she said she would make it for april I made the payment and she gave me a confirmation # for the regular months payment I asked her what that was she told me and I asked again what the amount was and confirmation# was she gave it to me. I then went back to the bank to make sure I was correct about the information before I filed a complaint then got disturbing word of they had sent in a payment plus late fees!! I had been lied to again by this company. I am now pissed beyond belief and will file complaints with everyone possible The federal trade commision the BBB and Office of consumer credit in texas I will also write the president and ceo Thomas Dundon every month just like a payment I suggest everyone do this fill his box up with our complaints.

We were behind in payments which we indured their harrassing phone calls, mean accusations, and rude comments about our lack of responsibility. My husband was deployed to Iraq, and I made up the payment due plus I added an extra $200 to what was owed. The amount owed was $1,055 and I paid $1,200. I paid during the day, during normal business working hours and I was told that everything was fine. We were caught up and no other actions were needed. That evening about 7:00 pm, the repo guy showed up and took our van. My 2 sons (ages 5 and 4) are stuck in the house, out in the country without any means of a taxi cab, public bus, or friends to take us into town for food, water (we just had a flood and the public water system hasn't been cleared for consumption) and no way of picking up the vehicle, which they took to a place out-of-state. I was told that I have to pay the impound fees and have to pick up the van myself. I don't have another vehicle that I can take to pick up the van without leaving my 5 and 4 year olds at home -- alone. I can't take them in a 2 seater vehicle without their car seats, which are in the repo'd van. Drive Financial admitted multiple times that it was their fault but "We can't do anything more for you" and "We can advise you but we can't help you". Most of the time they just hang up the phone on me in mid-sentence.
How can a company legally repo a vehicle when the payments are current?

I lost my job and before I got behind I contacted them to tell them about my situation. I asked to defer a payment and they told me I had to get behind before they could delay the payment. Once the payment was due I called again and they said I had to make a payment and be current and be current before they could defer a payment. At the time I had no money. Then the harrasing phone calls started 5 to 10 times a day even after speaking with them id get another call an hour later. Then they started calling my 86 year old mother 5 to 10 times a day. I would call them back and try to work something out and the rules would change everytime I spoke with them. I finally came up with the money to make a payment and did so. Then they again changed the rules on a deferment and would not work with me. I am sending them every dime I have each weak cause I need my car and I keep getting further behind and the calls dont stop even after telling them when I can pay. Someone has to do something about this company and the way they are treating people. It has to stop.

My payments were made to Sovereign Bank and cashed by said bank. I always paid more than what was owed on the car loan I was running a month ahead on the payments anyway. Apparently, the car loan was sold to Santander but instead of being told this they just presented themselves to me a collection agency working on the loan for and through Sovereign Bank. Due to the economy slowing my carpet business was suffering and I sent a letter to Sovereign asking them to be patient as the busy season for carpet installation was fast approaching. Meanwhile, I secured a job in an industry I had been in for ten years previously so I could get caught up. In addition, I had given up my rental home in lieu of becoming a room mate in order to further free up my finances. Finally, I lacked $250.00 to get it out of repossession, running two payments behind. I made arrangements with them to pay this amount on Friday May 14, 2010 with an additional payment shortly thereafter. On the wee hours of Thursday morning May 13th a repo man came and got my van and ironically this was the day I started a new job for a major grocery store chain. It was the grand opening and I had to go to work basically hitching a ride and in shock with all of my personal possessions and tools God knows where. I had many items from the move in there including taxes and personal papers and finances...

I would have voluntarily given the vehicle up had there not been any other options but for them to be dirty and make arrangements and then pick it up with no regard for someone who had paid on time for three years. When I could finally arrange for a day off so that I could go pick up my belongings as the recovery company told me I could only come between 8-11 am m-f, a whole new problem arrived on the scene. THE AUCTION COMPANY WAS THERE TO PICK IT UP AND AS THEY DROVE IT PAST ME I NOTICED IT HAD BEEN DAMAGED SEVERELY IN THE RECOVERY PROCESS. THIS VAN WAS IN PERFECT NEAR SHOWROOM CONDITION AND THE WHOLE BACK QUARTER PANEL INCLUDING RIPPING OFF THE RUNNING BOARDS I HAD PUT ON WERE GONE. The recovery company would not let me notate this on the paper I had to sign to get my things nor would they admit to anything. In fact, they had a incident report stating it was like that which is a complete and total lie. I had full coverage on this vehicle there is no way there would be any damage on it, it was my baby and my livelihood. Now where does this leave me? They want me to pay $2000.00 to get it back for a vehicle that was trashed after having made arrangements with me. How can a company operate this way?? In addition I had not officially moved in yet so they were trespassing on my room mate’s property. How can these people operate as OUTLAWS and get away with it??? Who holds them accountable? Please let me know as I do not want anyone else to have to suffer such losses and emotional and financial distresses. Class action lawsuit? I'm IN!!!!!!!!!!

Santander purchased my loan from HSBC. I was laid off last year took a lower paying job to get by had a few late payments. I got a new Job in December 09 have made a regular monthly payment on the due date each month. They keep saying I am a month behind. I have spoken with several reps at Santander they tell me to make a payment and once it post call back and change my due date. I start calling the day the money come out of my account and they tell me I dont qualify for a due date change. Then the process starts all over again. I have made seven payments on my due date but they keep reporting me to the credit bureau's for being over 30 days late. I try again each mont to no avail. They are killing my credit when I am trying to buy a home. No one will work with you and they wont transfer you to any one higher up the ladder. I started to fall behind on payments. i was sent a letter by santander that they just took over my loan from hsbc. they want to modify my account make my payment less and pay a lower interest rate. i made the payment required by the letter and faxed a signed copy of the terms to them. 30 days later they still havent approved my modification. i am being told by service reps not to pay and the modification will be done in 3 or 4 days. this is a month later then i get hold of the modification team and they say re-fax the agreement and we will get it processed in 24 hours for you. they call me the next day and say that is was declined because the offer expired. i was steamed. so you mean to tell me that no one in this company could have told me that this was going to happen to me after everyone said that it will be settled within a few days. now i am 3 months late and i am sure they will be coming for my car. they are not only brain dead people but they are crooks and liers. worst company i have ever had to deal with in my life. i hope someone will burn them good and get back what they have been taking from us for years

I purchased my Gap insurance throught Drive Finanical back in Oct. of 2007. My car was resently stolen and claimed as a total loss in Dec. 2009 and so my car insurance paid their portion, then when my gap insurance was to kick it and pay the remaining they oly paid $1,900.00 of the $5,000.00 owed. It turned out that when Drive Finanical sold me the Gap contract there was an additional page with all kinds of terms that weren't listed on my addendum I was given. So the gap insurance didn't cover alot of the finanice charges left on my loan. I even have proof that I never recieved the second page. The offer to settle with half but I'm not satisfied. What rights do I have, how can I get them to take the whole balance off for selling me an incomplete contract.

I bought a car in 2002 which was originally through Drive Financial services which was taken over by Santander. My loan is suppose to be paid in full come come July 2010. I have made substantial payments and fees keep getting added to my loan. The last fee was for $202.00 for apparent late fees after being late one day on a payment and this has happened several times. I made a substantial payment to pay-off this car with my tax money which was an automatic withdrawal from my bank account which they only show $400.00 being paid on the account. I provided the accounting department at Santander a bank statement and they will not return my phone calls regarding this matter. Due to this my attempt to get a new car loan with a differnet company is being rescinded because they will not provide documentation needed to the new car loan company. I want this resolved and my loan paid in full which whould be less than $3,000.00 but because they keep putting additional fees on my account my balance is showing $3,810.00. My purchase price of the car was $12,000.00 and with all the fees they say I've incurred I have paid over $25,000.00 for a 2002 vehicle.This is reidiculous and I would like some assistance in this matter. I pay my SOVEREIGN BANk auto loan every month. Not 1 late payment. I use the new SANTANDER payment stub which has an "ADDITIONAL PAYMENT" area. I have been adding additonal funds on this line for almost a year to find out that NONE OF THE MONEY GOES TOWARD THE PRINCIPAL. Santander holds the extra money and puts it toward the next months payment. So, They are still billing 100% of the interest and I am simply paying off the next months payment instead of paying off the vehicle early or earning interest on the additional funds I send them.
To top it off, the customer service people are the rudest I have ever talked to. I was told to call a "customer payment specialist" to arrange to add funds to the principal.

I gave the representative my debit card number. I was informed that it could not be used because it was coming up in their system as a credit card. I told the representative, that my debt card is both a debit, and credit card, she told me they could only accept straight debt cards. Two days later $1519 dollars was charged at Walmarts in Florida. My car was financed through HSBC. Since it was sold to Santander we have had constant phone calls from them.

I am a legal assistant that does debt collection, so I know the rules of the FDCPA.

I recently sent them a letter asking them to verify the amount they are telling me I owe. They say I owe a specific amount and can't tell me why, but they have continued to call me. These calls were all placed to my cell phone so I can document the violations and have records of their calls.

They told me my payment history was online that I could research the payment history myself that they don't ever do that for anyone. Then she got very upset, when I asked for a supervisor they refused. If they say I owe the money they should tell me what it is for but not one person can tell me. One said late fees, one said the remaining portion of a past due bill, etc. I've heard it all.

They violated the FDCPA by continuing to call my husband at work after they have been told to cease from doing that.

Regardless, I am collecting data and I will file a lawsuit once I get more information.

I would like to be one of the lead plaintiff's as I have and continue to collect proof of the violations.


Right now, I have about 8 violations of the FDCPA in the past 2 weeks and I would like to have 20 or more before I file. However, at the rate they are going that won't take very long!

I bought a car thru a dealership in June 2008 and the car was financed with Drive Financial. I made payments on time until June 2009 when finances prevented me from paying on the exact due date. I still made a monthly payments by phone and paid the $10.95 service fee in addition to the $330.00 monthly car payment. I lost my job in December 2009 and filed for State Unemployment. I was approved for State Unemployment and was sent 2 benefits checks, then the State Unemployment suddenly stopped. Not because I was ineligible BUT due to an error entering my wages. The State Unemployment should have entered in my lowest quarter wage as $9,000.00 - instead it was entered as $900.00 I brought this to the State Unemployment Office BEFORE receiving a final decision of eligibility, because I recieved a letter in the mail stating that I did not make enough money in wages or below $1,200 in a quarter. The rep at State Unemployment told me not to pay attention to the letter because its an obvious mistake. I threw the letter away and shortly thereafter, the weekly benefits stopped because State Unemployment decided to 'fix the error' Even though I will still get the same amount of unemployment, which is the maximum amount, I have to wait 13 weeks for the error to be corrected. Meanwhile, Drive Financial is repossing my car because I am NOW behind in payments due to job loss and State Unemployment typing error. Drive Financial DBA Santander has called my Father and Mother In-Law(s) about 6-12 times a day (EVERY DAY) and threatens, harrasses, intimidates, and tells my In-laws my account status and other personal info about ME. I don't live with them, but since they are a reference, Drive Financial DBA Santander continues to call them. They have told this company to stop calling, I have tried to get in contact with this company, but was always told that I need to speak with Loss Mitigation Dept. which is virtually impossible because of the hours and no voice mail system to leave a message. The repo man came today and spoke with my husband, I was not home and neither was the car. I am currently 4 months behind and have asked for a work out 4 months ago, but nobody at Drive Financial DBA Santander has helped out. This company only intimidates, lies, harrasses and laughs at the customers. I am tired of dealing with unrational people.

I have been in contract with drive financial since 02/2007. I have the original contract and have repeatedly asked why my down payment was applied to my finance charges. I have been told everything from the salesperson(from the dealership) has the payment until today (03/18/2010)that they have the payment. I went over the contract terms and we seem to have two different contracts. I didn't sign for the amount that Santander is claiming. In addition, the accounting on account has been miscalculated many times I have requested an accurate accounting, but I receive no response. I have been called and harrassed for late payments on holidays and 6am to 10 pm. This is obviously illegal.

When I was behind on my payments with Santander I notified them that I would make a payment as soon as I could and they continued calling me at all hours of the day and night. So I started to ignore their calls. One day I came home from work and my neighbor across the street had came over and toward me that Santander Comsumer had called them and notified them that I was behind in payments and to have me contact them. My neighbors are no where listed on my contract or contact list. That was embarrassing to myself and my wife.

Towards the end of 2009 I fell behind two car payments. When I received my Income Taxes I called to make a payment. When I spoke with the Santander Representative I told them that I wanted to make two sepererate payments. One to cover the two payments I was behind and one to cover the late fees. I was told that one mass payment would cover both. When I received my bill for March there my payment was less then normal and I still had late fees. When I called to ask about this I was told that the small amount I paid for the late fees in Jan went towards the principle of my loan and not towards my late fees. This is actually the second time that they had done this to me.

In June 2009, I tried to contact Santander about my car note and get a deferment to do car repairs. I was basically told that I could not get a deferment because I was not behind on payments. I was then told that according to their system, I didn't have a payment due (other than 50 cents), and that my next payment would be due in a month of the normal amount. I verified this information, and proceeded with my car repairs. 5 months later, I start getting calls that I am a payment behind. I tell them what occurred earlier in the year, and asked again for a deferment. I was told they could not give me a deferment. Since then, they have been calling me up to 8 times a day, every day! I continue to make my normal payments, plus $30 so that the late fees to do not pile up, as I continue to try to get the issue worked out. I have sent letters which were ignored. Representatives are rude and refuse to talk to me about anything other than immediate payment over the phone of one payment plus fees. In reviewing my account, it seems that my payments are not being properly applied to principle...even noted one month when only $107 of my $567 payment was applied to principle, when the months before and after $300+ was applied to principle. I notice that the principle payment keeps going up and down, as Santander takes more interest on some months than others. I've also done the math on what they say I owe, and how long I should have left to pay, and I can easily see them trying to get an extra $2000 lump sum out of me at the end of the note. I feel these folks have killed my chances of refinancing, and I'm stuck with them for another 3 1/2 years. I need help! I lose sleep at night wondering if they are going to repossess my car over 1 payment and fees, and have ended up in numerous arguments with them over the phone. These people are crooks!

My acount is a half a paymet late. I had called them and was surpose to be making arraigment for the week I get my unemployment check.
They starts calling at 6:00 a.m.-11:00pm. All during that time it's an 30 minute interven then the calls starts again.
At one time it had gotten so bad, that one caller will be on the phone with me and the other would be on the phone with my cosigner..
No matter what you explains to them, they get so rude and will tell you what you need to do. I only get $174.00 a week from umimployment. I have to explain every 30 minutes when they calls. When the next calls 30 minutes later, they will get rude and say that you never called and talked to anyone..
Since they have started all this calling, my doctor has put me on depression meds and ambians meds. To calm me down and help me sleep.
My mom has even been getting the treating calls from Drive looking for me. She is bed ridding sick. They have even talked so ugly to her as well. She tries to explain that she is sick. They told her that;s not there problem, she just need to get the message passed.

Called back to ask for manager and then another lady hung up. I was not cursing or anything and when i tried to call back they had blocked my phone. I managed to get back via the spanish option and a lady gave me a PO box address to complain. I always heard noise in the background of ppl laughing. Wow I cant beleive this compani from Spain is allowed to operate here or anywhere. I NEVER recommend doing business with Santander EVER!!! and i cant beleive these ppl dont get fired as I now see that they have thousands of complaints.

The per diem and high interest has over inflated the car pmt so bad that I am blown away. I wouldn't have known a per diem was invovled if i didn't engage in web chat with a rep and asked straight questions about how my payment history and interest has my payoff so out there that they don't match at credit bureau, statement, or their website.

When loan started in 2007, paid fine until had child early by emergency basis and became unemployed. The car was repossessed and i was able to recover the vehicle and hasn't missed a payment since. Now that Santander has taken over, the constant calls and no disclosure about fees or per diem and information not in line at all at any 2 sources at the same time.

In early 2008, I was out looking for a vehicle. I stopped by Bill White's Hyundai of Russellville, AR. We (my fiance and I) test drove a couple cars and then they brought us a brand new 2007 Sonata that they needed to get rid of. We test drove the Sonata overnight, and really liked it. We went to the dealership the next day and told them we wanted the car. With a sale price of $19, 000. We had no credit and no co-signer, so the dealership decided to pull a couple strings to get a deal worked out for us. We were told that if we would make a $2, 000 downpayment, and accept high payments (625/mo) for the first year making every payment on time, we would definitely be able to refinance and be looking at payments around 325/mo. This deal was also to include sale tax being paid. After a couple hours we signed for the car, and drove home. That next week, I went to get tags on the car the the revenue office. Everything was going fine, til the lady behind the desk put our shiney new plate on the counter and said very delicately "That'll be 2200 bucks" I just stood there and looked at her knowing she was joking. turns out, they didn't pay the sales tax, also turns out that part of the contract was removed prior to us returning to finalize the deal after the test drive. After driving for 30 days without tags, and not having the money to pay to get them, as we were paying $625 for the car, it found a nice resting place in my front yard. Months went by and we made every payment on time, while saving for tags. 10 months into the payments and about $6, 250 plus the $2, 000 down I contacted Drive to ask about refinancing. They very generously disclosed this little factoid..."WE DON'T REFINANCE"..I asked to talk to a supervisor, which probably really meant I was bounced to the next cubical. Everyone I talked to told me the same thing. I was really pissed at this point. After paying 625/mo for 10 months with the promise from the dealer of being able to refinance we still didn't even have tags and the car had only 3, 000 miles on it with one oil change. I went up to the dealer to yell at someone, to my surprise however, I learned that the whole team that was there when I purchased my car had been fired because of the way they were conducting business. The new supervisor was very friendly and tried to do everything she could to get me financed by another company. However, even with building our credit scores from 0's to 700+ we couldn't be refinanced because the original loan (625/mo for 60/mo) came to almost 40, 000 which was twice the value of the car. I also found out that they got us approved by saying that we were married. I immediately stopped making the payments and received harassing calls from Drive Financial on a daily basis. Everytime it would be a different person and by this point I was tired of talking serious to these people (and explaining the above story EVERYTIME, with each person saying "um okay sir, I'll make a note of that on your account") and took on the "sarcastic asshole" persona. The last lady didn't like this and said "Sir, if you don't make your payment's we will come and take your car." I said "F*ck it, the car is yours just come and get the piece of sh*t" she replies with "sir the car isn't ours, the collateral is"...I finished with "The car is the collateral you stupid B*tch! and hung up. A year later, I walked outside one morning and the car was just gone. No one knocked on the door to ask for keys, no phone calls, no letters to this day. All I know is the dealership where we purchased the car is now closed down. Waiting to get a letter saying they're dragging us to court.

Financed my car for 10,000 three years ago and the balance is still 7,000. Had to deal with the same issues the whole time I've had the car. Today was the last one. I was put on a deferment and was supposed to start regular payments in January. I have talked to them once a week to let them know where I am with getting the money. Now today, they claim I owe double my regular payment for December as well as January and February. I JUST spoke with a rep last week and that was NOT the case. This is not the first time this has happened. They also claim I've only made 2 payments in the past year. BULLCRAP! I have not only used my bank account, but western union and money gram to meet their needs. They call EVERYONE in my family and people that I worked with 8 years ago who I don't even talk to anymore telling them my financial situation. They tell them how far behind I am and how much I owe. This is immoral! They call my house 40 times a day and my mother just said today that some lady called there being extremely hateful with her telling her she needed to give them my location. I JUST TALKED TO THEM LAST WEEK!!!!! The entire city knows my financial status now and I am devastated! I don't want everyone that I ever worked with or knew knowing I'm a day late on my payment. And it doesn't matter if you make arrangements, they still call a million times. I am a single mother with three children who doesn't get child support and I do good to make the regular payment, and they keep adding past due amounts on there that weren't on the previous statement or that they didn't mention before. This is ridiculous and I am now stuck in a horrible situation...either let them repossess the car because I owe double what it is worth, not to mention the car is a complete LEMON and doesn't run half the time or keep paying for it and letting them add a payment here and there until I end up paying 30,000 for this stinking car! They are very rude and hang up on me, then tell me they can't help what the last person told me last week, this is what it is today...BULLCRAP!

Long story short ..if you get a car that sells for 11000 used and end up with a loan through this company that ends up to be 30000 the interest being collected is predatory and should be illegal. refinancing? not an option for most conventional upside down loans besides they charge to buy out the loan. Overpaying is prevelant in subprime or areas of disparity by companies like this that are allowed to operate. Understood that most companies are in business to make a profit but almost triple what the value of the car is being sold at the dealers is just not considered good business practice.

I contacted them in June 09 due to knowing I would be out of work for a while due to having back surgery. I was told to have a due date change and if I still was out of work in July to call back & they would do another one. I was then told that if I made a $210.00 payment by 8/15 they would do it. I borrowed the money to do this since I was still out of work. Then I find out from Russ a manager that only 1 due date can be done during the term of the loan and that deferment was not for me. I spoke with Bruce a supervisor on 2/10/10 who put in a two month deferment request which was denied less than 24 hours later. When questioned as to why the deferment was denied I was told because my account was in good standing with them and that I always seem to make my payments even though they say I am behind 25 days and receive 20 to 30 calls a day. I also almost lost my job because of them calling and requesting my husband too many times. My husband and I are struggling because we are behind in all our bills due to my surgery that was a have to have. They do not care about their customers at all and are predatory of people who have less than perfect credit! Something must be done.

Unlawful repo after the payment we promised them was paid and then was basically told owell, calls to familiy members that they DO NOT have permission to speak to, constint FDCPA violations, calling us 5+ times a day even if we made a payment te day before and have told them that no payment can be made for a couple more weeks, unbeleivable fees that that will not explain to us what they are for. I originally purchased a car in 2/2000 that was financed by Triad. Also in 2000 I was in a horrific car accident where the vehicle was totaled with 2 major and 1 minor injuries which I was included an injured party. I was also pregnant at the time of the accident and could no longer work. I was unable to continue to pay for the totaled vehicle. Triad then charged off the purchase and placed a negative mark and charge off on my credit report. The negative entry fell off my credit report in 2007. Santander Consumer USA purchased Triad in Novermber 2009 and then placed a collection on my credit report with a new close date of November 2009. This new item's date of deletion is now 2016.

Before our payment was due both of our phones were ringing off the hook at the same time. Our payment was due on the fourth of the month and these phone calls started at the end of the previous month.

I called to make a payment and asked what the full balance was, they told me we only owed the payment. I paid this payment, yet when the bill came for the next month a late fee of $55.16 appeared even though the customer service representative didn't tell me of this fee when I called to pay the bill. We now have a charge of $55.16 on our bill as a late fee. We were told that it was a late for Aug, Sep and Nov for $13 a month. You do the math (13 x 3 = not 55.16)

Lastly, I wanted to say that we purchased our vehical at Carmax. Carmax pretty much apologized to us because they know how many problems people have with Drive Financial now know as Santander Consumer USA.

This company should be made to close.

Additionally, Santander had received a double payment & upon filing a complaint with the PA Banking Department was forced to return it which they still claim caused our account to be past due even though we never missed a payment. Short into long, they repossessed the car. We have bank statements proving we never missed a payment but they still claim we did. We were forced to make a payment 5 times more than we owed and the very next day after receiving the payment they placed the car up for auction. Through the PA Banking Department, we were able to bring enough attention to the case to force Santander to release the car but it had been detailed and set for sale after we had made the payment. We were forced to pay several hundred more dollars to get the car out of storage. We are now being assessed hundreds of dollars in "fees" which they refuse to break down. They have lied, stole our vehicle and even damaged the ignition because they replaced it with a cheaper one when it was detailed.

We need help. We are out of a couple thousand dollars now and it keeps going up.

They have harrassed me on my job, and all my references i used on my apllication. I was late in sending a payment I sent them a payment and they picked up the car later that night. When they did pick up my car they took it to a whole different place. I had to fin*d someone to take me to go and get my car after I came up with over 2100.00 for them to give it back not including what the compnay charged me to give it back. The company they used had two employess that havd conviction records. I kept telling them that I made the payment and they said they could care less and they had there's and to deal with them. after all of that transaction. I told them I saw them some where before and they became quiet and would not say anything but I kept on insisting that I did so later on the morning when business started opening it came to me where and they had been convicted of theft before, so you figure. Since they had once taken my car i owe them out the butt for late charges after charges but remember i just gave them over 2100.00 earlier to get my car back. It seems by blance is not reducing at all. They contiuelly call my employment I have told them not to call me there and they continue and then get rude on the phone because they know I cant say anything out loud so oneday I lost with them in my office and everybody now know my personal business and which they should'nt. My mom in on on assistance and they have threatened her and that is where I draw the line because she cant take care of my debt. Nobobdy will refinece you on a car that is worth so little but yet you have a large balance. They kind laugh at you and ask wahat you were thinking but we all know we need some kind of transportation so we settle for those who call themselves helphing you get back on track. How many of us know now it is not getting back on track nor is it helphing our credit either. Something really needs to be done about them because they are a riffoff. I am to the point in letting the car go back because I the payments themselves are hurting me and they are 610.95 and that is not including all the fees they keep putting on my account every month so I will never see the end of the road with them.

Due to the high interest rate attached to the auto loan, I've been having a difficulty time paying my living expenses such as rent, utilities, and medical expenses. I as well as friends and family members have suffered greatly from harrassinf phone calls from Drive during late hours at night. I've had a customer service representative openly call me a "broke nigger" over the phone because I was late on my payments. Drive has ruimed my marriage and lost me my job, I've paif off my car twice, and still have no title. Called my friends and family including my fiance claiming I was a crook. I am also a victim of Drive Financial now Santander Consumer USa My husband and I paid over 18,000 to this company for a 2005 truck and was stil told we owed over 22,000 more dollars for the vehicle. We were paying 652 month and got behind and one night a repo man showed up at our door. When I called the company back they said that we could have it back if they did a remodification on our loan which would decrease the payments but added 14 more months on to the loan. I told them that you are already saying we over over 22,000 for an almost 5 year old car in which we have already paid 18,000 into no way am I going to pay this plus more interest. This company is on ripoffreport.com and is a major rip off.

Account with Drive in August 2004. Making scheduled payments for several months to find out by Drive that the payments we were making were not payments for our monthly note...something about not enough for the down payment??? We have had harrassing phone calls to us our family and friends that we did not list on lthe application for the car...they even tried sneaky tactics as they would speak to my daughter to make her beleive that they were a friend of mine. We would make a payment and then the next day call to demand payment for the next month when it was not due. They would call my husband and tell him that we were two, three months past due, or they never got payments....my credit has been destroyed by them. 11/2009 I find out that they charged off my truck and I had no idea. The repo man came and got it but was rude as if we had something that belonged to him. They lie, take your money, harass, no customer service, they make arrangements with you for you to find out that it's been noted that the arrangement was defaulted and now you end up behind and can't understand what happend... WE NEED HELP AGAINST THIS ... ALL CUSTOMERS OF DRIVE/SANTANDER NEED SOME HELP
