Case Summary:
Santander consumer usa financed an automobile for me last year. I traded the one they financed on 12/28/09. Santander started calling me about the vehicle. So I went down to where I traded the , which was Chrysler Jeep Dodge in bessemer, al. I ask them had they paid off the vehicle I traded in, They showed me a copy of the check. When I related this to the santander representative, She ask me to record the people at the company who I traded the car to telling me about the check santander was claiming it had not received. I do not know what that was about to this day. I told her that i had seen the check and please stop calling. Santander consumer usa, has continually since that day called my job, freinds, and anyone else they could think of to harrass me and my family. I do not owe these people money, but they call a couple times a day, they even discuss my account with the people who picks up the phone, even though they know I don't live there please help me. When I did business with them I was never late nor did I miss any payments. I have never seen a company act so unprofessional. Apparently the don't believe in repeat costumers. Thanks.

This company has hurt my performance on my job, because of all the calling, and my bosses are not happy about the calls. They have hurt me with my friends ,by sharing my information with them. I would like to be compensated for that.

I had a car loan with citifinancial from 2005 to 2008..I spoke with citifinancial October of 2008 and inquired about my payoff which was approximately $4,000. I was going through a divorce at the time and knew I wouldnt be able to afford the truck payment for very long. I indicated to Citifinancial that I was paying the car off in February 2009 with my tax return. Citifinancial gave me the final payoff and made a notation. The next thing I know,I call to inquire about a payment and Santander has my loan; When I indicate paying the truck off, the payoff amount has doubled or more !!! I inquired about the increased payoff amount and they indiacted deferred payments, interest, ect..I ask them to send me a statement showing fees, ect..but never received it..Needless to say I couldnt continue paying 450 a month as a single parent with three kids..I called and attempted to negotiate lower payments, a longer loan with lesser payments, or anything to keep from losing my truck.I needed my job as a social worker, and transportation for my children. I did not want to have to let a truck get repossesssed after 4 years of paying on it and almost finsihsed with the loan..I stressed and struggled, continued to atempt to make payments, and then gave up..The truck was repossessed and they sold it for approxiamately $3.000.00 ...Now they are saying the loan is even more than originally..**I only owed $4,000 they sold it for $3,000 and they are claiming I still owe them thousands of dollars...Plus ruined my credit !! I wasnt a perfect payer, struggled at times, but I offered and attemtpted to pay my debt...I think they would rather ruin somone's life with bad credit than to have accepted and agreeed to get more money from me on different terms..I don't understand their way of thinking? Anyway, now they are threatening to garnish wages...I'm disgusted...thanks Citifinancial...I would have a paid off truck it it weren't for you selling to predators...

I've made all of my payments. loan matures in Jan. 2014 instead of aug 2013 because of 6 deferments which I am paying. They piled on thousands of dollars in interest so that loan can't be paid off. They have claimed my payments are late but they never are late. I have a loan that has a fixed rate and term of payments. Interest is already included in payment. They are robbing people by attaching illegal simple interest onto contracts that they bought out. I have been forced to pay for a car for 8 years that should have been paid off in 5 1/2. They have made it so that the car can never be paid off. I have filed complaints with AGs in two states and they are investigating as far as I know. But attorney and lawsuit are needed.

I originally purchased a 2005 GMC Yukon SLT on July 1 2007 for $33,000. My loan servicer at the origination of the loan was CITIFINANCIAL Auto. My loan term was for 72 months (6years) financing a total of $33,000. Santander took over my loan sometime in 2008 or 2009 when Citifinancial went under and was no longer in business. They sold my loan to Santander without me knowing it until I received a statement from Santander with a new account number, etc. I have made 56 payments of $746.66. My loan should be paid in full by July of this year (2013) just shy of 3 months of satisfying my loan debt. Surprisingly, I still have a balance of $23,000! My balance I have tried trading the car in for a newer model and NO dealership will take the car! I have been inconvenienced and I feel like I have been robbed. I don't know what to do and I need help. No consumer should EVER experience anything like this. This is completely unethical and sad. It has to be against the law to mistreat any customer this way and get away with it.

My loan was originally with CitiFinancial. On February 27, 2013, in early morning my vehicle was removed from my residence, Jackson, MS. This company claimed to have not received payments for December 2012, and for January, February of this year, which is not true. This information was told to me by individuals that worked with Santander. (come to find out, they claimed these people didn’t work for them after further inquiring) I expressed to all of them that I did pay my payments and that I have receipts for all payments paid. I enclosed a copy of payment receipts from November 2012 to February 2013 for my vehicle. I have decided to get the money orders tracked to see exactly who have cashed these money orders. I was sent on a wild goose chase as to where my car was been held and lied to by a customer service agent. Eventually after 5 hours my car was returned at a cost of $1,428.00 to get my vechicle back. I have been late a couple of times, but was caught up by then. They also have miscellaneous fees of 370.00 unexplained.

Sandanter took over a loan that I had with Drive Time. They had my car repossessed and auctioned it and then tried to bill me $4000 for the difference. They auctioned even though I sent them proof of payment from my bank and their own payment site. Every time I got a transaction number they wanted another. I had paid half of my loan so they made money on the deal.

I bought a 2007 Suzuki Forenza in July 2007, FOR 19000. I admit I have been late a few times but I always catch up with large payments. Now Santander is stating I still owe them 11000 on a 19000 loan they bought from Drive payments 443 a month and Ive made 54 payments. I have been harassed at home and work, and recieve anxiety attacks when they call due to not knowing what they will say. I am charged outstanding latefees and other charges that I dont know what they are for.

Santander has re-aged a debt that originated from Triad Financial. This was off my credit report and now it is back on. The 7 1/2 years expired over a year ago and they have changed the account number and aged the debt so it will not come off my credit report until 2016. Date of last payment was November 2004. I have printed credit reports from 2006 that shows how it was originally reported. They are now causing me to not get a home loan.

my contract was purchaced from hsbc by santander. santander says i signed a 62 month term contract but will not send me a copy of the contract that i supposedly signed for 62 months. the copy i have says 60 months. i have my payment history and i have actually paid extra on some payments and have overpaid on my loan. every time i call to try to get my title they feed me a different reason as to why i owe them more. today i was told that i have been morbidly late on payments resulting in extra fees and that they added two extra payments to try to help me spread the fees out in order to pay off my loan. in the same conversation they said that i had an excellent payment history and that they seen where i had sent extra payments that should have covered any and all late fees and then some. every time i call them to try to get them to mail me my vehicle title they say i still owe them something. i have paid more that in full on my contract and have the paperwork to prove it! i wish to have santander pay any and all attorney fees associated with my case in the event that i am contacted by an attorney to review my case.

Called my job and told my co worker that they were Pam from TX who is my mother, then when i told her not to call again she said that she will and to write a letter. With Santander my payments went back up to over $17,000; my car was repossessed through HSBC and all payments were current when Santander took over; unfortunately through illness and loss from work, car was repossessed twice by Santander and all payments and astronomical fees were paid upon retrieving my auto. However, all current payments do not show any principal being paid, only INTEREST? I am retired now and making more monthly payments to Santander than I was when HSBC had the car loan. At this rate, my car wil never be paid off until after my death if that. I currently remain one month behind in payments due to the receipt of my Social Security pension payments which occur after my due date of the 15th of the month which incurs LATE FEES. I constantly receive phone calls throughout the day on my cell phone - I do not answer it because they service reps are so rude and harrassing is unnerving. I recently have relocated to Florida from Connecticut. I have joined in the class action suit but have not heard anything more. I just want my payments to show that I have paid for the car almost 3 times what it cost to purchase!

I paid $2777.96 to bring the balance current. They came and took the car. We told tow company balance was current. When we called they reps at Santander were rude and said they couldnt help. So they accept payments- call 5-6 times on every number they have. Yet get no emails from them. They have gotten my work upset at all the calls and my wife cant list her work due to the interruptions. I am reporting the car stolen tomorrow and want them to understand they need to be held accountible for thier actions. Now my wife cant get to work.

 Repohiclemy vehicle was reposes for non payment I am currently on disability but I did make the payment they asked for when I made the payment I called them and gave them the refrence number of the payment done by money gram I asked for them to please tell me where the vehicle was so I can get it back and several representative refuse to give me the information I cslled back several times and they still refuse I even spoke to a manager when I was given the information it was past 8:00 that evening and they stated that I could not get my vehicle that I would have to wait till Monday and they could not do anything about it so my car had to stay another extra two days when they had plenty of time to give me that information and I could have had my car that same day I made the payment. Now 3 days later I am getting harrasing calls again from them that my car is behind for $100.00 please help

Our loan was bought by Santander from Drive Financial without our knowledge or agreement. We got notice in the mail that this was the case and got our new statement from Santander. We started a new payment with out new loan servicer. We have had financial issues and we have had to make late payments but we would always get caught up with sometimes a 3000 dollar payment etc. In short, not only did we start to get aggressive calls and so did our references but we were given a new interest rate that we did not agree to and were assessed excessive late charges. For a car originally financed for 30K, we have payed over triple this with Santanders crazy fees and interest. We have been royally screwed and it looks like so have all their other customers. This is so sad that a company is able to operate this unethically. Please let someone take the cause and help us fight against these practices.

I bought my car and financed it thru SANTANDER...What a mistake. I lost my job due to medical reason and have tried in vain to make my car payments. I qualified for a modification. I spoke to the rudest person that they had working there. She told me the amount that I had to pay and I paid the EXACT amount with a check over the phone, the was a Friday. Monday afernoon there was a loud pounding and constant ringing of my door bell at the front door so I run to see what the ER was and it was a man ther stand with a clip board asking me to sign. He was the REPO MAN. He was taking my car even though I had went thru the modification and made the payment, he was taking my car. It was hooked up and ready to go. He asked for the keys and after I said no let me call SANTANDER and find out what's going on her popped the lock the alarm blarring witth the neighbors watching, started yelling at me asking what I wanted from the car since I can't pay me bills etc.. and Drove off with the alarm going.
I finally got in touch with SANTANDER and thery explained to me that my car was still behind in payments that I didn't make the entire payment due, I was short 2.00 and I shoud get my car back by NOW paying all the past due payments of 1500.00 plus 400.00 repo fee. The modification no longer mattered. The moral of the story is the CSR's are evil.. They say things out of spite. You the customer don't matter. They only want more and more and more money from you. And they are totally above and LAW!!! They are a corupt business. They have been doing this for years and will continue to do this. I can no longer mentally take their harassment or their bad math that 2 people can not explain the same. I am waiting for them to come and take their vehicle. The phone calls are making me need MENTAL NERVOUS drugs!!!!!! Calling someone 20-25 times a day should be criminal. Nothing can be done to stop these crooks. Good luck to anyone who has an account with them, you will pay an additional $10,000.00 for your car :(

Santander took over my car payment it was with Citi Financial and a payment was lost it took Santander one year to find out where the money went. There customer service agent told me they could take my car over 1.00, and they can call me as many times as they want. I counted and Santander called me 40 times in one day less then three hours. Early in the morning at 8:00 am the money was sent when it was being taken over from Citi Financial to Santander. I did not want my next door neighbor to know my business and the agent told them I was late and to look outside to see if they car was in the drive way. I was so scared that I gave all the money I had. Santander called my daughter cell phone and I was driving the agent said if I did not sent the money quick collect and pay 15.00 for the fee and that is the only method that could be paid. I wanted to send a money order but I had to get an extra money for this fee to send the payment. The agent took this as a joke. This agent called me every thirty mins. concerning this bill. When I stopped answering the phone the agent called my next door neighbor asking questions asking I still live their and if the car was their. And I was one payment behind when I need to make the payment. I sent Santander one month 500. 00 and the agent said this is too bad because we still can come and get the car. I cannot wait until I am finish paying for this car. I will never finance anything with Santander.

Dealing with this company has been the most frustrating thing of my life. If you are one day late they begin the phone harrassment which includes endless phone calls day and night. They are unyeilding and refuse to help. The worst part is they call people I listed on my application as references. I have recently (2 days ago) received loan modification documents from this company because my loan reached maturity 11/2011, but there was still a balance due because of a few extensions and excessive late charges and fees. Of course my payments have gone to pay all of the extra charges. They show a balance of $7400 on the $13000 loan.

I have made 50 payments @ $315.00 = $15750 and they indicate that I owe 10 more of the original 60 month loan ($3150.00). They now want me to sign a loan modification of $300.00 for 30 months ($9000.00) to satisfy the “principle” with a maturation date of 1/2014. My original interest rate is 8% and the proposed interest rate is 13%. They have gladly extended loan extensions due to my financial situation over the past couple of years but in reality there has been no extension of the loan itself. That is being accomplished by this modification. This plan would result in me paying $24750.00 for this vehicle that currently has major mechanical issues.

I have two vehicles financed through this same company and the actions are very similar, except the second vehicle has not matured yet. That loan will mature 4/2012. They also repo my truck last year because payments went to Citi and I didn't know that there was a different MoneyGram address for Santander.

I purchased a truck via Road loans, and the account was sold to Santander, without my knowledge Last Year I was involved in a accident where I broke neck, and back in three places. The process of disability insurance takes a few weeks, in which I was unable to make a payment on time. I requested a deferment, "which capitol one let me do on another loan", in which Santander told me I had to be sixty days late to be eligible for a deferment. Now either I give them a bank account for them to access, or my wife, her employer, and our cell phones receive harassing calls at all hours. I tried to speak to them but they don't speak well enough English to even understand.
I have never had a company harass, on violate my privacy like Santander.

This company is unbelievable! Our loan was sold to Santander and since that time they have been absolutely relentless. Our payment is current (it usually is) and yet this company calls at all hours of the day and night (sometimes at 3 or 4 O' clock in the morning when we are trying to sleep). They call from many different numbers to conceal who they are. They won't leave any messages on my voicemail, and sometimes they hang-up when I answer! I have politely asked them to stop call and yet it continues. This situation is absolutely ridiculous! I feel like my home and family is being constantly invaded, I haven't done anything wrong, and yet, I am helpless unless I want to change all my phone numbers (which I don't want to do!)

My payment has been late and this company calls me non stop! When they initially called my job I spoke with the guy and advised that I would call back later because I was working he stated that he wasn't concerned with that he wanted to know my payment was late. I kept trying to advise him that I was working and he wouldn't allow me to get off the phone so I hung up on him and of course he called right back. Now since I no longer answer my job phone for them they call all day from a couple of different numbers and there is a automated message playing. I had to change my cell phone number and not advise them to stop the harassment. When I go online to make a payment on my account the pay off balance NEVER changes and I find that extremely hard to believe.

My loan was bought from hsbc by santander and it has been one headache after another. I tried to pay off my loan in dec.of last yr. and at first they wouldnt tell me what the payoff was. I kept after them about it and then they gave me a payoff which was 5000$ more than it should have been and told me i will get no credit for an early payoff. They said that i would have to pay all the finance charges for the months that i paid off early. I asked them for a payment history and they said ok.It was in dec,2010 and im still waiting. This is is dec. 2011 as i write this. They had me blocked out of the system so i couldnt see my payment history. Now all of a sudden i can get in and they have a ton of deferred payments on my acct. I only had three. My payment is due on the 8th of ea.month if they dont have it on that day, they are calling any and everybody they can.My supervisor called me in the office and told me with attitude to handle this.

Santander purchased my loan from Triad or Road loans. When they purchased my loan, all of a sudden, I had thousands in late fees. They have even repossed my vehile for these late fees and can not tell me what month or how much each late fee is. I have tried to get a statement showing late fees and they refuse to send it. They call non stop and even called my sister while she was a sophmore in highschool. I told them repeatedly not to contact her, yet they continued. They have called my job and told my boss that if I didn't return the call, my truck was in jeopardy. I wish I knew what to do about it.

In April of 2006, I purchase a truck from Huffines Dodge, and since my credit was less than perfect, I ended up having it financed through Triad Financial Services. From then until 2008 I never had any problems with payments or late fees. In the mid part of 2008, my note was then bought by Santander Consumer USA and this is where the problems began-

1.Missing payments-Santander is claiming that payments were NOT made on time, yet documentation was provided to them.

2.Failure to honor ALL aspects of a written contract-I was laid off in 2010 and when I originally signed my contract with Triad, I also signed up for unemployment insurance, being that if I lost my job involuntarly, that the insurance would pay my payment until I found suitble work. I faxed Santander a copy of my letter declaring I was laid off from work, and they told me "well, you need to find the paperwork that proves that is the case". I contacted the sales department at Huffines and gave them the information required and was told yes I did have unemployment AND disability insurance on my truck. Santander still has yet to confirm the receipt of the fax or acknowledge the contract is valid.

3. Illegal interest fees and penalties-Since I have been laid off, my source of income has been strictly limited, thus causing me to put aside other things, yet my truck payment is still a priority. From my understanding, they are charging me $8.00 or MORE per day instead of one flat fee for EACH DAY I AM LATE.. This in turn has caused my late fees to accumulate to an ungodly amount which leads to point #4...

4. Misappropriation of payments-in common business practices when a payment is split up, usually the lesser amount that is paid in is applied towards the current amount due. According to Santander, if a full amount is NOT paid at the time due, it is applied to the late fees that exist. I have called and called them to get this in writing but they refuse to disclose in paperwork how the poilicy is in effect.

5.Harrassment-I am called at all hours of the day, and have received calls AFTER 9 pm from "unavailable" numbers, usually a recording (9:01, 9:15 time frame), and also around 8 am on Sundays. I called them out on this and was told "We can call you anytime you want!'. According to the fair debt reporting and collection act this is illegal, and also from my understanding creditors cannot call you more than 1 time per day if they speak to you on the phone at least once.I have also had employees try to add me on social networking sites such as Facebook, Twitter, and MySpace and leave embarrassing comments on my page regarding my past due account.

Any information would be greatly appreciated in getting whats right done and this company shut down or reorgnized under fair and just treatment for cunsumers who have no choice but to use a sub prime lender.

We are getting nowhere it seems on a car that is now upside down. We pay outrageously high payments that are sinking us and our balance does not go down. They gave me the tracking number and I have proof that it was signed for and now I am getting the run around as to why it has not been posted to the account. Four days later and still waiting. Doesn't it seem odd that there is never a supervisor to speak with when by law there is suppose to be someone in charge. What would they ever do if an inspector showed up. I advise anyone that has dealing with Santander not only to post a comment here but also the newspaper and your local tv station along with filing a compaint with the FTC and Attorney General. If we all stick together maybe we can put a stop to companies like this. Don't know about anyone else but I am sick and tired of it always being one sided. May 2005 I purchased a 2005 Trailblazer for $22k. Drive Financial financed it @ a high interest rate, I paid $525 per month. I lost my job in May 2008, however I continued to make payments on time. I contacted them to have the vehicle refinanced to reduce my payments as I was on unemployment only to be told that they do not refinance. November 2008, I decided to find another company to do the refinance. Lo and behold, Road Loans picked up the loan at a lower interest rate and my monthly payments were cut by $150. About 6 months down the line, my loan was sold to Drive. I called Road Loans to make a complaint and was told that they were actually owned by Drive and there was nothing to worry about because the terms of the loan was not going to change. If you do the math, I have paid approximately $31k on a $22k loan and still owe $13k according to Drive. I feel like returning the vehicle because 4 months ago, I owed $11k. Any suggestions?

My car was totaled and the GAP insurance did not cover the whole amount of the loan. Santander lowered my monthly payments to "help me out". The new amount due was $!93.01 a month. I received a letter from them stating if I made the payment beginning in September 2010 and each month thereafter I would be current on my account and my loan would be paid off in 2013. Since I am making payments on a car I don't own, I was paying more than what was required of me. My husband and I began receiving calls that our account was late. I called them twice to explain that their records were wrong and there was no way we were behind since I had been paying more per month than what I was required to pay. They put the note in my account but still kept calling. I continued to make my payments. I tried to log in to my online account with them a week ago and found it disabled. I called them and they told me my account was more than 100 days delinquent and was "charged off". I could not believe this since I have made a total of $2500 of payments since September 2010 and only obligated to pay $1158. I was frustrated since their representative told me there was nothing he could do and could not explain why we were behind when I had obviously overpaid. My husband has called every day this last week to try to get to talk to a person that can explain why we are behind when we have overpaid. No managers are around, they are always in meetings, and the representative tells him that they can't look back into our records to tell us why. They are very rude to him when he calls. What recourse do we have as consumers? It seems that they are the ones stealing my money and saying we are behind....now my account is in collection. Please HELP!

On February 7, 2011, I spoke with Sophia (a call center representative) who informed me that based on the fact that my loan was “more than four months delinquent, my car was going to be repossessed.” I explained to Ms. Littlejohn that my account is not, in fact, in default, and I have made payments in accordance with the terms of my Payment Agreement from the time my loan was purchased by Santander (from CitiFinancial Auto) to the present.

I have sent numerous letters to Santander since October 2010, with accompanying proof that I have made the regular payments to the above account for the months of June, July, August, September, October, November, December, (2010) and as of this letter, January (2011).

On October 14, 2010, I spoke with a Santander representative regarding the fact that I made the payments for June, July and August, 2010. I also sent a facsimile stating the same, along with proof of payment from the bank. I explained to the representative that since the date of Santander’s purchase of my loan from Citifinancial Auto, Santander has neglected to apply the correct payments to the correct month, and based on that error, my payments were showing in default with Santander incorrectly. The representative stated that if I could show proof of payment, my account would be rectified. I did this by sending in what the representative asked for (i.e. the fax stating that payment had been made and proof of payment from my bank) and my account was never rectified.

I also spoke with the representative that day regarding the fact that I did not have access to my online account. She stated that it would be fixed by the following week. To date, I still do not have access to my online account. I cannot enter my password or login information, and the question for the security question is blank, therefore, I do not know the question that is being asked in order to give the correct answer.

Each month I receive a statement from Santander showing the payments due on my account (which typically show that I am 3-4 months behind in payments), and each month when I send in my payment, I also attach a letter stating the fact that I am not in default, payments have been made on time, and my account needs to be rectified. I have not received the bank information regarding my payment for December, 2010, based on the fact that, as of the date of this letter, Santander has not cashed the check to be applied toward the December 2010 payment.

since the inception of this loan, I have had trouble with Santander applying payments to my account, promises not kept by representatives, and have spent extensive time involved in sending letters, tracking bank payments, and time taken with telephone conversations at length regarding my account, and still have no access to my account online and my account still shows a default when I receive my monthly statement. I previously requested that everything from Santander be in writing and have received nothing but my monthly statement. Also, I have received no telephone calls to my telephone number listed above, but my mother, who is not listed on the loan, has received more than one telephone call from Santander (which prompted my call on February 7, 2010, in which I spoke with Ms. Littlejohn) Further, I have not received any documentation from Santander regarding the payments due or that there may be a chance of repossession of my car, and yet, month after month, I send in proof that payments have been made along with the regularly scheduled payment. This kind of customer service is unacceptable.

My car was traded in and the loan was paid off to Santander. I had seperate warranty , gap and road hazard on the car. A check from the warranty company was sent to Santander after the loan had already been paid off and they cashed the check and never applied a portion of the check ($436.61) to my account. The check total for the gap and warrante credit was $845.94. Their accounting only applied a portion of check in error. This was back in November of 2010. To this date the missaplied has not been returned to me. I have only rec'd a check for the partial amount of the check that was applied. I have sent faxes, certified letters and have made over 4 dozen phone to Santander. They have ack. that the money is due back to me, but to this date February 2,2011 still have not recd the money. No one will help find out why, no one can provide a check number or amount, but they tell that the check was cut. I never got any check and still to this date dont have the money. They cashed a check that was on paid off loan which should have been returned to me in full. These people have basically pocketed $436.61 of my money.

Have taken one too many verbal beatings from Santander CSR. My car was totalled by another driver, their insurance company paid for what the car was worth to Santander and we also have Gap insurance. Santander was not the original owner of the loan, which was sold to them in September 2010 by CitiFinancial. Had to beg them to send information to Gap insurance to receive what money was owed. They insisted I make monthly payments and that whatever was "past due" up until October would be forgiven and I could start out with one monthly payment. Did not follow through with this agreement, which I actually have in a written letter by Santander. Still waiting for Gap insurance to kick in and am paying monthly payments even though I shouldn't have to. Had a conversation today with a CSR trying to explain to her that I'm not pass due and that someone messed up along the way. Not only did she not listen to me, she was verbally abusive, calling me a liar, threatening me of consequences of non-payment, etc. I asked to speak to her supervisor, and she started yelling at me. She couldn't transfer me into supervisor and had to deal with me. I insisted she look into the letter that was sent to me and if she couldn't find it then I would personally fax it to her. She found the letter scanned into their system. Made the comment, "Some ignorant person didn't even finish filing and taking care of this. Hold on while I talk to my supervisor". Came back on the phone sweet as pie, because come to find out I wasn't a liar and she had been verbally abusive. Gave me her supervisors personally work number so I can discuss this with him in a couple of days. I'm thinking this kind of behavior is illegal, but am not sure if I should get a lawyer or not. Really sick of the harrassment and I'm extremely worried that Gap insurance will cover what's owed and they'll pocket the payments I've been making while we're waiting for that to pan out.

Somehow, they are now reporting my car note twice on my credit report (as though I had bought two of the exact same cars on the same exact day, etc.). They call my work no less than 6 times a day, plus recently they called my In-Laws and discussed my account with them!

After paying timely for more than 5 years, my loan fell behind in November of 2010. In December, I made a single payment, but Santander withdrew 3. When I contested it with the bank, Santander was then blocked from receiving Credit Card payments from my card. I attempted twice, unaware of this block before I realized what was going on. On Monday 01/10/2011, my car was repossessed. When I called, they told me that I could pay $1108.54 within 15 days to get the car back. I sent this amount via MoneyGram and then called Santander. They told me that they would email the tow yard within 2 hours to release the car. When I called the tow yard 3 hours later, they advised me that they had just received instructions to send the car to auction. I asked that they reach out to Santander for clarification. The tow yard then called me back to inform that the third party, Renaissance knew nothing of my file. I just received a letter today advising that they want me to pay the entire loan in full by month's end to get the car back. Even after all of this, Santander is still insisting that they sent a notice to release the car to me and not to auction.

Citi Bank was financing me when I got my truck back in 2007. In 2010 Citi sold all its car accounts to Santander which I didn't know because no one contacts me for that. I was under an unemployment plan with Citi, so instead paying $550 a month I was paying $350 a month. I lost my job in 2009 and I have not been able to find full time job again. After I made two payments with Santander they told me that my payment will be $550 again because the unemployment term expired. I tried millions of way to keep this deal, it was not possible. They say that I must seek for trading or any type of way if I cannot afford my payments. So, I have been getting money from relatives so I can make payments. I had 10 days grace period with Citi, with Santander if you are a day late, they call the next day literally betweencccvxzzx 10-12 times a day. Of course I was late; I was struggling to make these payments. So when I called them today again, and try to see if I get a deal they say you better pay today because we are charging you $6 every day that you don't pay. Plus, if I try to pay online, to make an easy a quick payment, they charge me $11 just to MAKE A PAYMENT. In other words I have to pay some money to pay them. I need help I do not want to lose my truck I am struggling, I just want to reduce my payment for 6 months at least, and being able to make a payment online with no charge. This bank is a scam. I feel chased, robbed and frustrated. I would love to sue this people for harassment and for making desperate unemployed people like me almost to steal Money for them to get pay. Any help?? I can’t afford my next payment.

Traid auto loan charged off and cycled off all three credit reports by 11/2009. In 7/2009, settled debt to be paid in 6 monthly installements with last payment by 12/2009. Triad reported no recent activity on my credit reports (no mention of the settlement or anything recent) and thus, the account cycled off all three credit reports. The lawfirm authorized to settle and collect on Triad's behalf was Mullooly, Jeffrey & Flynn LLP, 6851 Jericho Turnpike, suite 220, Syosset, NY 11791. 515-656-5312. The collection manager is Joseph Kennedy and he sent us emails with the settlement offer letter and settlement satisfaction letter as scanned attachements to the emails. We have contacted him via phone and email and in the email we told him that in 12/2009 we see that santander reported on our transunion credit report with what appeared to be the old triad account the already cycled off. He told us that his lawfirm only represented traid not santander and put it on us to contact santander to inform them that the account with settled with his lawfirm. I could not understand this because once the settlement was completed I thought upon returning the file to the client (triad), would santander be made aware of this? This smells rotten to the core and I think we need an attorney to bring this matter before a judge to be decided!!. We challenged ther santander listing with transunion and they removed it during the spring of 2010, however, now it is listed on experian and equifax reports as of 11/2009. We have disputed it and they claimed that information was verified as accurate. Repeat. We need an attorney to act on our behalf and bring suit if possible if Santander does not want to comply and honor the settlement. If they claim to have no knowledge of it from the lawfirm then we have been ripped off and lied to by that lawfirm and need an attorney to bring suit against them!!!

Santander USA has consistently been hounding me for payments while I'm at work. Just recently, I fell short on my payment for the first time. Initially, I called Santander to let them know I would make payments and arranged dates. Yet, literally after a few hours, I get more calls.

Then, they act very polite bc I tell them their harassment are grounds for me to contact an attorney, file a complaint with the attorney general in Texas and here in California. Soon thereafter, they claim,"All we need is for you to check back with us from time to time and let us know what is going on. We appreciate you contacting us first sir."

To my utter amazement, I get another call a few hours later. The lady asks me if I can make a paymentm which i Just made a few days prior and arranged again which "recorded on their system."
She demands another amount and threatens me by saying,"Sir, I don't know what will happen if you dont pay us. Your car will be repoed. Can you afford your car?" I say, "Of course. Thats why I just made a payment and arranged another one. Repoed?! When do you guys plan on taking my car?" She threateningly states," This Friday." I hang up and call back. Another guy apologizes to me on behalf of this "unruly" operator and everything is sorted out, just for that day. The next day, the calls continue while I'm at work. Not to mention, Santander boldy told me, "You don't want to be charged 8 dollars a day do you? I advise you make your payments."

I've read many complaints from other victims of Santander and this is unjust. They are robbing people with their ridiculous charges and time-consuming ways of harassment. There is a violation there for certain.

If anyone lives in California, you can email me. I will get an attorney and fight this. If worse comes to worse, I will take them to court. I've read of others suing them and winning. All with the same plight.

On Sept 1st 2010, I refied a Citi Auto loan with my Credit union, I have a a copy of the cancelled check proving I paid the loan in full. I used ACH payment for cite and never had a late payment. Because my auto payment was the 3rd of every month, Citi auto advised me to put a stop payment on my Sept 3rd Payment, and I did so. On Sept 2nd 2010, my 12k loan was paid in full. On Sept 3rd citi attempted to debit my reg ACH payment and this payment was stopped. On Sept 6 Santander USA bought out my loan. On Sept 11th, Santander posted a stop payment, but instead of applying it to my Sept 3rd payment after being paid in full, Santander applied the stop payment to my Aug 3rd Payment. I gave santander Bank statement proof that my August 3rd payment cleared and was not stop nor was returned to my account. US Bank also sent Santander a letter confirming my August 3rd payment cleared my Bank account and was not returned. 104 days later and about 40 phone calls later, Santander still claims I owe the August 3rd Payment. They would harassment me and call me 10 times a day, to the point I sent them a ceast and desist letter, that stopped the phone calls but has not stopped the problem. My credit score has dropped 80 points this month because Santander reported me being 30 and 60 days late. I am attempting to refi my house right now and the credit hit will hurt this. I can easily prove I paid this loan in full and its obvious Santander made a mistake and citibank as well. This will be an easy case for a CA lawyer. On statement stated I owe 90 in December, yet the lady on the phone says I owe all of December, another says I owe payment for Sept Oct and Nov plus December! I have paid them every month through them. The one check I sent through my bank on line they claimed to not have received, yet one person their says they did get it, but did not try to cash it for over 20 days! They have been rude. I have asked for upper managment and they tell they are the management. I owe more money on my car now then I did when I bought it according to them. I never had problems with CITI. I have saved copied of all of my paper work from them since this started in September.

I was not even aware that they horrible people bought the loan from roadloans.com. I had to find out by viewing my credit report online. From Oct-Dec 2009 I was getting over 8 calls every day from these people. They harassed me to no end.

I am a survivor of DOMESTIC VIOLENCE! I was forced into cosigning for a car that I did not want in 2004. I signed under duress, and fear of what my now exspouse would do to me. That was the WORST mistake (second to being married to an abuser). After he threatened to STAB me in July 2007, I started to get help. I moved out in Jan 2008, and filed divorce.

The judge ordered him in stipulated judgement to get that car refinanced into his own name. Well, 2.5 years later, this loan is STILL on my credit reports. It is being reported late. I never ever got any statement in the mail to notify me this loan had been bought by santander. They refuse to send me any documents about this car, because they told me I was not the primary borrower.

I have called them several times recently to try to get them to remove that account from my name, and my credit reports. I faxed all court documents, and even mailed them two copies certified mail over 8 months ago.

Last week they reconfirmed receipt of all documents. They refuse to take my name off the loan. I have no idea where the car is. I have not seen it in nearly 3 years now. I had to move 100 miles away just to be safe. Santander will not return my calls.

They claim I am responsible for $19K on this car. Yet, I have to see one statement. They will not delete it, and could care less if my life was in danger. They just told me "oh well, you signed a contract."

I am not even the registered owner of this car.

The contract I was forced to sign is not valid, and needs to be cancelled. I just want my name, and my credit protected from that batterer who tried to kill me. He is dangerous, and I do not deserve to have my credit ruined indefinately until he finally sells it. It is NOT MY FAULT, he is not paying them on time. They have no proof of non payment either or late payments, at least none that I have seen.

Where is the justice for women who were abused, and had to start over with literally zero?!

Per court documents, I am NOT responsible for that car. PLEASE HELP!

I will be filing complaints with Dept of Cosumer Affairs, BBB, Federal Trade Commission, and CA & TX Attorney State General offices, and the FBI in Dallas TX.

I suggest everyone else do the same. The more complaints the FBI gets, then maybe those JERKS will finally get shut down, and brought to justice!

I want this company brought to justice, for violating my rights under the Fair Credit Reporting Act, and Fair Debt collection Act.

For what it is worth you can call some lady name Cynthia (cindy) at Santander, she claims to be a manager. 817-605-4978. Harrass them, and see if any results are made. Dont bother wasting your time on worthless customer service reps! They KNOW NOTHING & DO EVEN LESS!

I was diagnosed with Lupus in July of 2009. I was on short term leave from work and hospitalized for a month. after a year of not being able to return to work I was told I am permanantly disabled. I now recieve money once a month from disability. I kept in contact with Citifinancial who had my loan at the time and due to the situation was granted a medical modification. I was only 1 month behind in my payments. The next time I contacted them to find out why I hadnt recieved the written agreement I was informed that my loan was sold to Santander. It had nothing to do with my situation but infact Citi will no longer deal with auto financing. Well I contacted Santander and not only are they the rudest people in the world they dont even listen to what the customer is saying. All they care about is when they are getting there money. I updated my info with them and they call me 10 to 15 times a day asking the same questions as if the answers will change. I was told no prior agreements are accepted, they dont have a medical clause, and it was my responsibility to take care of my health. If I didnt caught up my payments it may or maynot be repoed,and my decrease in income was my problem. I was also told to "borrow the money, or dont pay my rent". my original payoff was 8/2011 now it 8/2012 they added about 50% in interest to my acct along with fees. I have a 2005 Jetta that I have had 4 yrs and they say I still owe 16,239.12 my payments are 538.29 monthly. Santander cant explain why I still owe this amt. Not to mention I made payments of 1 and a half months to attempt to catch up and they are not even applying the payments, but they show them on the statements. ex. Letter sent 11/22/2010 states 10/2010 owed 132.18 11/2010 owed 538.29 12/2010 owed 538.29 with 10.00 late fee equals 1218.74 payment of 674.05 made 11/8/2010 still owe 1218.74 as of 12/2010 acct 53 days past due. The charges are undisclosed and unexplainable. Every different person tells you a different amount/payment/or payoff. They will not allow management to talk to you at all. They promise a call back but the call backs are harrassment calls and when you say your waiting to talk to a manager they hang up on you. No reps notes are of the actual previous conversation.They have no way to send you a contract from the buyout to justify the new amt you owe.

Santander took over my auto loan in February of 2010 from HSBC. The origination date of my auto loan was Sept. 2006 for $13,542, in January 2010 my balance was $4,100, since Santander’s take over in February my balance was stated as $5,201. I have been with HSCB since 2006 and I have never missed a payment and have ALWAYS been in good standing with HSBC. In April I received a notice from Santander (my first correspondence from them) stating that I had missed my February 2010 payment. I in fact made the payment to HSBC (which you can not get a hold of now in regards to auto loans) but I was able to pull my banking statement to provide proof that I had paid for the loan in February. I have faxed over records to Santander in regards to this payment and all I have been told is I must contact HSBC to have the payment sent to Santander. My credit continues to fall victim of this horrible situation on a monthly basis. I am on the brink of giving the vehicle back as I am not able to pay two times the amount of this vehicle on a monthly basis (I also have a mortgage). Santander will call five to ten times in one day starting at 8 am and ending at 8 pm, each time from different numbers, at one point I spoke to THREE representatives throughout the day that all asked the same questions, when I asked them to please stop calling I was told, “your account is past due, we will call you to collect payment until you are current”. You can not understand anyone who is calling you, they will not escalate your call to a manager after you request to speak with one; they argue with you and will hang up without hesitation, the lack of customer service is astounding! I have been sent harassing letter “DEMANDING PAYMENT” and I simply don’t know what to do. They will even call you on the day they have received a scheduled payment to get another payment, I do not live, eat, work to pay Santander. Someone please help me!

I was nearing the end of my contract when Santander took over my car loan. I am now at the final payment, which should have been paid on 11/07; however, they sent a bill showing a balance of 747.11 but only requesting a 320.00 payment. I made the 320.00 payment on 11/05 and then began receiving the automated phone messages that my account was past due. Now they are claiming that because I had split my monthly car payments in half in the past (due to being paid bi-monthly) that I owe another 431.00 in late fees and that the balance of 747.11 - not the amount owed (320.00) at the bottom of the bill was supposed to be paid by 11/07/10. He also mentioned that this late payment fee that I have been accruing was around $5 per month. The funny thing is that I refinanced my original loan with Citi so they did not have it full term which would have been 60 months. Even at 60 months, $5 per month is only $300...not 431.00. I did have a deferment with Citi due to being laid off in 2008-2009 but the difference of the deferment would be more than 431.00 if that is what they are trying to recover, so I have no idea where they are getting this amount from. They have also said that it was my responsibility to be aware of my maturity date and obtain the payoff amount instead of going by what was on the bill so now my account will be in collections until I can pay the 431.00 on 12/01/10. The payoff is apparently based on the interest and is only good for 15 days...but no one ever sent anything out about that. I have paid off other cars before and have NEVER had this much trouble.

Santander acquired my auto loan when they bought Triad Financial in November of 2009. I owed Triad Financial $10,324 for a voluntary repossession. Santander sent me a "deficiency owed on account" letter that stated they'd contact me. They never contacted me again. In May of 2010, I found their contact information on my credit report, as they'd listed my debt as $18,600 (original loan amount) "bad debt charge off." I called them, they stated they hadn't "had time" to contact me regarding my debt. I made payment arrangements with them, and they promised to send me all the account information, including amount owing and contract. They stated they would update my credit report with the amount actually owed and my monthly payments, if paid on time. They never contacted me. I called them in July of 2010 and they stated it was my responsibility to keep contacting them if they didn't contact me. He stated there was no written contract. He stated that they were under no obligation to update my credit until the balance was paid in full. I filed a dispute with the Better Business Bureau and with the Federal Trade Commission. Two days later, Santander offered me a settlement of $3458.40, to be paid in monthly installments of $144.10 for 24 months. At that time, my credit score was 618, as the charge-off on my credit report was 3 years old.
I have made $482.30 in payments from July 2010 to October 2010. In those four months, Santander has added an $18,600 bad debt charge-off every single month, dropping my credit score to 550. The most recent hit on my credit from them was Friday, November 12, 2010. I called them this morning and they said they would fix my credit once the debt was paid in full.
In the meantime, my credit has been ruined and my vehicle broke down. I was unable to get a newer, safer vehicle for a decent price; my interest rate is over 16%. I want my credit report and credit score fixed.

Case Details:
Santander Consumer USA bought my auto loan from Citifinancial Auto. I bought my vehicle in March, 2004 for a term of 72 months. Due to financial hardship, I had three deferments on my account, but as of September, 2010 have made 68 of the 72 payments.

I received a bill in September, 2010 from Santander stating that I owe $5,552.08. I called the company and explained that they've made a mistake and they acknowledged the number of payments on my account and the CSA at Santander could not understand the discrepancy on the account, but wanted a payment, anyway.

In good faith, I made a payment of $335.67 on September 30th, 2010, with the understanding that the error would be corrected and the amount would be rectified to reflect the appropriate amount.

I continued to get numerous, daily harrassing phone calls and had to explain over and over ad nauseum that I was in the midst of correcting an error in my account.

I called them once again in October, to inquire about the status of the account and when I could expect to receive the account history, as had been promised to me in September.

The CSA was rude and unhelpful, though he, too, acknowledged that I'd made 68 of 72 payments, but told me I owed the other, larger, amount for interest on the loan. I explained to him that the interest payments are included in the monthly payment, to which he replied that I must owe all the extra amount for fees. This is impossible under the terms of my loan.

He said if I didn't make a payment, he would "...continue calling me night and day,... didn't want to yell at (me,) but he had to have a payment."

I declined to make a payment to him, stating that I was reluctant to pay on an erroneous amount, and could they please send me a complete payment history and debt disclosure. He assured me he would -- on that day -- and I concluded that call saying that once the amounts were rectified, I'd make payment.

Finally, over a month later, I received an account statement that shows all of the payments I've made, that confirms my beliefs and knowledge of my account, yet still states that I owe $5,552.08. I placed a call that their amounts are wrong and was told that I owe what the statement says I owe.

On November 8, 2010, I received a letter from Santander to call and work with them to bring my account current.

Now, today, Tuesday, November 9, 2010, a man showed up with a tow truck on the authority of Santander Consumer USA and repossessed my vehicle.

A quick Google search resulted in hundreds of cases similar or exactly the same as what I'm experiencing.

I feel that this company is willfully extorting me for monies it is not entitled to under the terms of my loan agreement and is operating in an illegal manner that restricts consumers from their rights. I contend that my car has just been stolen and am wondering if I should call the police to report it.

I've just spoken with them again and have been told that I need to pay $1,462.00 (past due) and $400 (repo fee) to get my car back. This is MORE than I currently owe on the entire loan!

She then said they don't have all the records on my account from Citifinancial Auto, AND I was told that my account number was wrong when I called and they needed to access my account via SS#.

I was told today due to late payments, the interest added up to the extra $4.051.72 that they claim I owe, despite the fact that interest is included in each payment! I asked if the late payments she's referenced were those that I'd had deferred; she does not know.

Please do something about this company.

When I inquired about my re-occurring payment arrangement with Citi, the customer service representative from Santander told me that my payments would no longer be drafted out of my checking account. This was a mistake, and my checking account was drafted the full amount of my normal payment, even though the vehicle had been already paid off by my refinance loan. When I inquired about a refund, i was told that it took 30-45 days for a refund. I continued to call and ask for status, and was continually told 30-45 days. On day 47, I contacted Santander using their online customer service, and was told that the normal wait is 45-60 days. I have been missing my $585.66, and have had to run up credit card bills to make up for the missed money.

I have a 2003 Ford F150. THe original loan was with First Essex bank, which sold to Soverign Bank who sold to Santander. The 84 mo. loan was due to be paid off May of this year. However, Santander keeps claiming that I still owe on principle.
After sever requests for a complete payment history and a copy of my original signed loan agreement, I sent a Certified letter for Debt validation to Santander.
They sent me a history of payments that only consist of Soverign Bank forward. They are missing 11 months worth of payments from First Essex.
They have 73 payments recorded to Soverign Bank and to Santander... the 11 missing payments bring me to the 84 on the original loan terms. SO my vechicle is paid off, but because Santander doesnt have a copy of the payment history to First Essex bank, what can I do ?

Santander bought our auto loan from CitiFinancial. I have been sending payments to CitiFinancial because we had no statements from Santander. Finally received one today, 10-14-10. The payment due date is for 9-22-10. They are trying to say we are delinquent with a balance of $866.00, when we are current and actually sent October's payment in early. Sent it on the 4th and it isn't due until the 22nd. When asking questions they keep changing their answers. One minute they bought the the loan, next they are just servicing the loan, If that is the case why can I not talk to CitiFinancial? They are very rude & nasty to talk to and have no answers to any questions you have. Another thing is we like CitiFinancial Auto because they would work with us because my husband is laid off every winter. They would either defer payments or lower the payments. Santander told us today they will not do any of that. Plain words pay or lose your vehicle. We have a 5 year loan on this vehicle and have been paying on it for 3 years now and these people want the money, even when they lose it or come take your vehicle. Oh and lets not forget they wanted me to give them another payment on the phne today with a 10.95 fee while our other payment is among the missing. Have been reading all the complaints online about this company. They really need to be stopped. They are hurting alot of people.

I was approved for a amendment with Citifinancial Auto to make my payments more affordable. I was told I needed to be a month late, then I needed to be two months late, then was told I needed to make another payment to be only a month late. I faxed over the information they needed along with an over the phone interview 4 times and each time I was approved but was told I needed to wait a week for the process of the amendment to go to the manager and to call back on a certain date - which I did, I get a message that Santander was now in charge of Citifinancial. Now in short, I've been told by several reps with Santander that Citifinacials rules no longer applies now that Santander owns my account and that my amendment that was promised no longer applies. They also tell me that I can not talk to a manager or anyone that I spoke to before that there is no one there to help me and I need to get caught up on my payments. $25,000 loan at 14% 28 payments and I owe almost 23,000. Originally before accepting the loan with Citifinancial Auto, I was promised verbally that after 2 months payments that the interest would be dropped to 9%.
Was denied promise 2 months later. There are always excuses with Santander never the same answer. Just an awful company!

My husband and I have a car loan through HSBC. Several months ago Santander aquired thos loans from HSBC. I became ill and could not work and fell behind in my car payments. I had spoken with these people several time. They call every hour from 8 am to 9pm on my home phone, cell phone and my husbands work (which is not allowed at this company). I have paid the best I can. I received a call from someone who said that they were going to reposess our car. At that point I asked what we could do to get this taken care of. The lady that I spoke with was very kind. We agreed that every two weeks the 15 and the 31 of the months 400.00 would be deducted to get it taken care of that in March 2011 it would be up to date and good to go. I gave her a 400.00 payment right then, she said she would keep my card on file and we would go from there. She even made the comment "You are making a step in the right direction to get this taken care of". On September 14, 2010 my husband received a call at work no less and was told that they were coming to get our vehicle. He was like "What are you talking about" he was told that since we did not answer our phone on September 1st a payment was not deducted therefore we renigged on our arrangement and they were coming to get it??? I was so upset, I chose to call and speak to someone. I finally spoke with Keisha who told me that who ever set up this payment arrangement in August was wrong. That they do not do payment arrangements at all. Either I pay 1999.00 or they were coming for the car. I asked her how this could happen, how could an employee keep me on the phone for 20 minutes in August while we made all of these arrangements and you are now telling me that you do not offer such a thing? Needless to say, I have cried until I cannot anymore. I do not know what to do, I need help. These people need to be stopped, they are predators looking to harass people, it is horrible.

My original auto loan was through HSBC Auto Finanance, which was sold to Santander. My payment has gone up, I have had issues with arrangements I have made with reps on the phone not being honored, and santander has harrassed me calling 10-20 times per day on private numbers -- some of which are cell phone numbers on the same account as my cell phone that were never provided to Santander or HSBC.

They have called my parents, my in-laws, my friends, my jobs, etc. and have disclosed to ALL of them that I am delinquent on my car payments. They have sent a repo man door to door through the neighboroods of my mother, father, and in-laws passing out business cards, telling them to look out for my car and telling them that it is stolen, that I owe money on it, that there is a reward, etc. They have even gone as far as to call my job repeatedly posing as "a friend" of mine, making me look like I am getting personal calls at work.

I tried to pay off the car just to rid myself of these people and was told my payoff value on a $25,000 car was $23,000 after 26 months of payments. I asked the rep on the phone to explain this figure, to which the rep laughed at me and said "that's what you owe." I said that this amount was fictitious and I would be taking this matter further, to which he laughed again and said "Good luck, buddy." This is my worst nightmare come true. PLEASE HELP.

To my surprise my contract was sold to santander I guess around 2009 I didn't know it was a debt collector santander actually repossessed my car saying I have a balance of 8,000.00 after I continue to tell them I thought the car was paid off because I have my contract I sent it to them and they sent me what they had which was a fradulent signature of me and my son's and some invistible witness they scanned onto a document. the car was refinanced by them signed by them and they continue to harrasse me for payments in which I'm paying so they will not snatched the car again.

Basically, my issues are the same as those above. Santander purchased my previous finance company Triad, with whom I had a two month deferment agreement with, followed by automatic payments to resume after deferment. Automatic payment didn't happen since during this time the purchase of Triad by Santander occured unbeknownst to me. No phone calls, nothing in writing. Finally was contacted after a couple of months and was told my account was closed. Tried to reason with them in every possible way including paying for all missed and deferred payments but would not work with me. I still have the car and don't want it repossesed (I have moved and they don't have my new address), but they have already crushed my credit and I'd like to know my rights.

On July 29th, I was 124 days past due, I made a payment of 695 (which is 2 payments worth) and only 30 days were knocked off the delinquency. I then made another 350 (my normal payment is 347) on the 14th of August and no days were knocked off it's delinquency. This is not proper accounting as if one makes those payments they are first applied to the loan itself. This loan was purchased from my previous lender HSBC.

On October 27, 2009 I called in to make a car payment of $488.12 and my debit card was charged twice. Although a refund was issued 5 days later, the company did not make right my account due to the insufficient charges I received because of the unauthorized second payment.

Santander blamed Western Union, and then First Data, however Santander illegally authorized my card for second payment. To make matter worse, I had a claim in with my Bank and because Santander refused to communicate with them regarding their error. My bank account was closed and my claim denied and since then the unpaid insufficient fees have been sent to a collection agency.

I have tried to get this matter resolved with to no avail. My credit has been ruined. Please help.

Our auto loan was sold to Santander a few months ago. About a month and a half ago, my wife had surgery. We called Santander approx. 15 days before our payment was due, and asked them if we could "defer" our upcoming payment due to loss of income, during my wife's recovery from surgery. They told us sure, they could do it one time throughout the life of the loan. We were told to call back on the day the payment was due. We called on the due date, and were told there wasn't anything they could due at that time, and we would have to wait until our payment was "late" We called back a few days later, and were told they can't help us, we would have to make the payment. We explained to them what we were told, and they said "we don't do that" When we asked to speak to a Supervisor, they hung up on us. We called back again, and were told to Make The Payment!! We asked again to speak with a Supervisor, and they said no. I called again. This time I was told to Make The Payment! again. I asked what could we do to work through this, and they told us to Borrow the money from someone!!! I've never been treated so poorly ever.......

My loan was originally with Sovereign bank, was sold to Satander.

I agreed to a one time payment out of my bank account for $699.95. Two days prior when I knew I would be short the money, I called to ask to push the payment back two days. They refused and told me to stop payment. i did (costing me $25) they presented the back for the amount of 694.95, thus being a different amount it paid. I then had a bank charge. Don't give these people your card information. I only send them Money Orders or Western Union

I bought a car from bill waits in Lawrenceburg a month after my truck was bought I got a letter saying the dealership had closed then 2 weeks latter I got a letter saying the dealership had filed bankruptcy... At that point in time I still had no title and no registration to the vehicle..... The police department and the co attorney where I lived worked for the next 4 months to get my title and registration and finally on june 12th I received both in the mail..... I continued to call santander and make my payments even when the vehicle wasn't in my name .....They called daily sometimes even 10 -20 times a day including calls to my work pace many times saying that there was a 1200 dollar payment that was owed to them that had never been paid.... I got threatened with reposition over this amount and on the morning of June 19th my 4 children were outside and came in and said there was someone outside hooking my truck up to their truck..... The repo man was there and said that I was 1272 dollars behind in payments and when I called them they said the same thing..... They told me I had till July 1st 2010 to make the payment or they would keep the truck..... I called and tried to see if they would help if I sent in documentation of payments and they said no they need the money and I would have to pay a repo fee of 400 dollars .... I told them this would not be possible and asked if there was any other way they would work this out and they just flat out said no!!!! Asked if I could set up a payment plan and they said they could only release the vehicle if it was mad in full plus the repo fees....... You would think if I was willing to work out a payment on money I do not owe they would have wanted to do that.... But no they want to push you around tell you that you are no good for having late payments , not even trying to work with you when you offer to make a good faith payment..... I have got the run around since I bought this vehicle and now with my payments made and my 4100 dollar down payment I have lost almost 6000 dollars and now have no vehicle and ruint credit which I was trying to rebuild,,,,, is there no help out there to get help with these people who take advantage of people with low incomes and try to pay their bills but sometimes cant make them..... Pls help,,,, these people need to get what they deserve....

2003 Ford Explorer - principal $32,000 paid in full in Feb 2010 (loan was through HSBC and sold Feb 2010 to Santandar) Had $374 late fees to pay - Santandar added enormous interest charges bringing total amount due to over $800. Last Friday - repo man came and took our vehicle - saying we owed for late fees and interest. Called Santandar that day - told to pay $1243 in 20 days. Going to pay it - don't want to throw $32,000 down the toilet - but this isn't legal!!!!! No calls, no letters, just 2 repo guys from 45 minutes away taking our truck we paid on and sacrificed for over 7 years!!!!! This is theft!

I was not able to pay my car payment one month due to financial reasons. I called Santander Consumer USA and talked with a rep. about my payment and she was very nice and helpful. I made payment arrangements with her and was assured that everything would be fine.
The next day and most every day after I have received one or more calls from them starting at 8:20 am. I have called them back and the rep. confirmed my payment arrangements but said there was nothing she could do about the automated calls.
I believe the frequency of calls and the blatant inability to stop them constitutes harassment in one form or another and I would like to start/be involved in a class action lawsuit against said company.

I have been struggling to pay this loan for the last year. When I originally applied for the loan I had to agree with a 20% interest rate! Crazy right, I could afford it at one point, then with the economy crisis and being laid off, I had to quickly find another job, being a single parent of a 2 year old. I found a job, but it paid iltterally $5 less an hour than I was originally making. I have been struggling for a while, having to save 2 paycheck a month to pay my car pymnt. I am clearly upside down on my car loan, and they will nothelp me. I have called for help, and been treated like a peice of trash by theire customer service center. They talk to you like your stupid, in fact they once even said that it was not their fault I had no job. Prior to me loosing my job I began to slowly slip on my huge pymnt. They called my best friend, my sister, my mom, and my job...each almost 3 times a day, and continue to until this day. They have also told them in detail why they were calling, looking for me. This has cause major embarrassment for me, my boss asked me to make them stop calling at one point. They even told my boss I was behind on my car. They will not offer any loan mods. They only offer "differments" which means...basically you will still owe us, we will just make it go away for now, but extend your loan even longer and throw it to the back of the loan. Even upper management treats you like crap, and they are EXTREMELY unprofessional and no where near trying to understand the hardships I am currently going through to work with me. I have had my car for 2 years and still owe them the same amount as my original loan balance!!!! I have only made 15 oymnts. acoording to them since 2008, so therefore "i am not eligible for any help, or loan mods. unless I have made a minimum of 30 payments. I asked them so how was I supposed to know I'd loose my job and get paid $5 hr. less within my "30 pymnys" I need help now!!! A loan mod. is beyond needed!!!! They basically laughed at me and hung up. Not being sensitive in anyway to a completly normal situation for people nowaday with the ecomomy crisis. They do not care at all about their customer service dept. to train them and teach them professionalism when it comes to customer support. I feel like im between a rock and a wall right now, They have all the power and they know it, they have harassed my friends, job site, and myself. I feel like my accnt. balance is nowhere near correct.How can I have a car for 2 years and still have the exact same payoff anount. And how could they, as direct lenders, not be willing to do any type of loan mods. unless I have made 30 payments!! That is 2 1/2 years before you are eligible for help. I need to know why these people are getting away with murder! I started to look into maybe sending a financial hardship letter and info. of my current employment status and googled the company, then I saw over 4 websites of people with the exact or very similar complaints about this finance comapny!!! We need someone to stand up for us all and sue the crap out of these theives, and unprofessional goons!!!!! I HATE SANTANDER, they are a nightmare, and have held me hostage. I feel so helpless, and they make you feel like a criminal and interrogate you and everyone you know. I wish I had never signed that loan with this company. They make me wish I never even got the dam car! TOTAL NIGTMARE, SANTANDER IS NOT RIGHT!!! THEY ARE THEIVES & HAVE NO RESPECT FOR ANY OF THEIR CUSTOMERS.

I lost my job and before I got behind I contacted them to tell them about my situation. I asked to defer a payment and they told me I had to get behind before they could delay the payment. Once the payment was due I called again and they said I had to make a payment and be current and be current before they could defer a payment. At the time I had no money. Then the harrasing phone calls started 5 to 10 times a day even after speaking with them id get another call an hour later. Then they started calling my 86 year old mother 5 to 10 times a day. I would call them back and try to work something out and the rules would change everytime I spoke with them. I finally came up with the money to make a payment and did so. Then they again changed the rules on a deferment and would not work with me. I am sending them every dime I have each weak cause I need my car and I keep getting further behind and the calls dont stop even after telling them when I can pay. Someone has to do something about this company and the way they are treating people. It has to stop.

My vehicle was reposessed because I lost my job, and I could not get through on their line to make arrangements. I called everyday, and I was on hold with the automated system until I had to hang up. At the time, the balance was about $4400. They sold my vehicle for about $4400, so they claim, but said I still owed $2200, from all the fees, storage and things like that, but were willing to settle for $250???? I advised them I still don't have the money. They cannot provide with proof stating why I owe $2200, when my balance was $4400 and they sold my vehicle for about that much. They are adding about $450 on my balance on my credit report everymonth, saying the whole balance is past due. It says it is a charge off, profit loss for an extreme amount, yet they are still adding interest. I have been working on fixing my credit so I can get a better job, and this is hurting my score so much, but it is not accurate at all. If they allowed it to be a charge off, and left it at that, thats fine, but they are reporting to the bureau that I owe more now than before they sold my vehicle, and I know that is not legal, and I can't afford a lawyer and don't even know where to begin to fight!

I originally financed through United Auto Credit Corp. who apparently sold the loan in March 2010 to Satander without my knowledge. I filed a complaint with my state atty general for never receiving statements from UACC after they left Oregon. They sent me a letter promising to do so. They never did until March, and then again in April, both not reflecting payments I had made. My balance with Satander is somehow HIGHER now despite having paid $900 since the sale of the loan. I cannot get the history of the loan. I want to sue them because according to my records I should own this vehicle outright.

My name is April and about 7 months ago I obtained a new cell phone and new cell number under my mothers contract through AT&T. The harrassing phone calls started a few months ago for a guy named Mark. I keep calling Santander back to tell them that they have the wrong person, but they still keep calling me and hanging up on me. These calls are harrassing and I had a few instances where the person I was talking to violently yelled at me.Of course I yelled back. I do not owe anybody money and I wish these calls will stop. I have to check my voice mailbox everyday because I will have up to 4 voicemails a day telling me to " please call Santander back". Even though I have REPEATEDLY told them that they have the wrong person,..they still call and hang up on me every time I start talking to the representative. I have already threatened a lawsuit of harrassment but it does not help. I am ready to take action. I just want my cell phone to stay silent again.

Because of bad credit I had to get a loan through Santander it was Drive Financial prior but drive sold out to Santander. From August 2009 until present we have received harassing phone calls at least 4-8 times daily-with some brief lapse of calls. I am not late on my account nor have i been. Also I just come to find out that my Aunt who was one of my references is now receiving harrassing calls about a reference and they are asking for her social security number- thank god my aunt is not stupid and has not issued them a social security. I can't understand why now after 1 year (13 months) of the purchase of my new car that they would be calling and doing this. There has also been a few calls to my mother at her job which is damaging her reputation at her job. I am really upset and stressed about this because they are calling my home and cell phone so many times a day and I speak to someone and then they say they won't call again and the calls continue! It's very distressing and nerve racking to have to deal with this type of situation all the time.
