      | 492 |      LEAD PLAINTIFF: ksaylor      Case Filed: 2011-04-27
Case Summary:
Wells Fargo Bank practices of Excessive overdraft fees and Low to high posting of transactions, setting customers up for overdraft fees.

Case Detail:
Multiple times I have had to go into the local branch of Wells Fargo and speak with the Branch Manager to have him reverse fees that should not have been applied. Many times I had not notice the fees until an auto deposit went in and was for considerably less. Over the years of banking with Wells Fargo I am interested to know how much money I have paid them in late or overdraft fees which they use the same term for either one.

I have been trying for several years to "get back on my feet", however WF seems to hit me with an overdraft fee every time that seems like a possibility; the overdraft reduces my balance just enough that my other expenditures subsequently overdraft. They do not inform me in a timely fashion that this is the case, and reap overdraft fees for any and all transactions that occur during their delay. My overdraft fees this year alone come to over $1,300 so far, and that is only because I have been desperately trying not to overdraft. I am not a financial wizard and I often hold that against myself, but no matter how hard I try I cannot seem to hopscotch around their monthly overdraft scalping.

Case Details:
According to Wells Fargo the charge that put me into overdraft was issued on May 23rd. However, as a very responsible person when it comes to money, I check at least 4 or 5 times a day, and I know for absolute certain that charge was not on my account (online or on the app) in pending or withdrawls or anywhere. I had checked several times throughout the following five days up until Tuesday June 2nd, and according to Wellsfargo.com and the Wells Fargo app I had money, and I had several purchases that were in pending. Up until Tuesday June 2nd my account had not once dipped into overdraft. On the several charges still in pending, I had not been in overdraft. But on Tuesday when the charges were cleared from pending, the charge they claimed showed up on May 23rd appeared, and the rest of the charges were charged $35 each in overdraft fees, which then put me into debt by $211. The charge was not in pending it was not on my account at all until June 2nd, yet they continue to claim it was there since the 23rd.

We are a small business trying to make it in this terrible economy. We made 3 deposits from various local customers to keep our small account liquid. We find out the next day that Wells Fargo put a self imposed 14 day hold on all 3 deposited checks. Now this will results now in multiple NSF fees they can collect directly resulting from their imposing a 14 Day Hold on local checks deposited in to our account. When pressed they said "oh were sorry"

Wells Fargo has taken over 2500 each year from me in fees and every single transaction they always make it to where the larger deductions come out first then the smaller ones so I will be forced to be charged MORE FEES! I want a class action lawsuit! And I guarantee it we can win this! Bank Of America has been sued over this same thing and now it is Wells Fargos turn!

I am a mortified customer of Wells Fargo. I joined their bank about 5 months ago against my better judgment but my partners wanted to. We had a personal banker that promised us the stars, moon, earth etc...Fast forward 5 months and $6600 in Overdraft fees (no that is not a misprint). I am in the process of transferring to a new bank but this is a joke. I even called the corporate line and one of the tellers told me it was a joke and she reimbursed me. I will constantly be in the positive but they pull their funds after midnight and even after all my credit card deposits hit they still charge me with these stupid fees! I hope these leaches get what's coming to them!!!

Case Details:
Over the past 4 years Wells Fargo has repeatedly taken out hundreds of dollars at a time in overdraft fees due to restructuring of the withdrawls that come out of my account. They reorder them so that the largest bills come out first, so that I get closer to a zero balance in my account quicker in order to maximize the number of overdraft fees that they can collect. There have only been a handful of times over the last 4 years that I havent been able to cover a negative account balance the very next day. Credit card transactions from my business deposit at 6 am every single morning to cover any charges that came through in the middle of the night - from the day beofre. I signed up with Wells Fargo Merchant Services over a year ago because they told me that the overdrafts would stop. They told me that since the credit cards would now be processed by Wells Fargo, the bank would know that I was going to have the money in the morning to cover the fees from the day before, and I would not continue to incur fees, like I was when Bank Of America was doing my merchant processing. This was a flat out lie. Nothing has changed. They have no remorse in lying to me, and have offered me no assistance or provided me with any solutions to solve the issue. I have had as many as 8 items overdraft due to this dispicable "gauging" practice, and I am no longer going to stand by while they continue to steal from me, hurt my business and cause me emotional distress.

Case Details:
Wells Fargo set up my debit card to allow certain transactions to go through. This was set up with my knowledge or consent (I had no notice of such card services overdraft protection). Then, I made three separate purchases approximately $3 each. I was charged three separate $35 NSF fees for each purchases. However, I was under the impression that a recent credit card given to me was linked to the account. Further, I never used the account without funds being available so my transaction history would show that I had no clue the account was set up in that way. Wells Fargo took advantage of me not knowing and they charged several fees for small purchases that no aware consumer would do. Wells FArgo craftily created the situation by the way they set up my debit card and then took advantage of my unawareness. I need an attorney's help with getting a class action certified against Wells Fargo. Im sure several people have my same issue, so there is definitely a mass amount of people with a common legal issue at stake. Wells Fargo is surreptitiously charging bogus overdraft fees. They are finagling the way they post transactions and available balances. Their system and accounting practices are so convoluted as to confuse the customer and thereon take advantage of them.

Case Details:
Wells Fargo constantly held large transactions until the account was close to overdrafting. I would make a deposit before 9:00 or transfer money from one account to another. They would assume the account was going to over draft snd charge me od fees. They also took money from an account that was not linked and would not refund it. This has been going on for years. I finally had enough and changed banks
They hold transactions for over a week
I could go on and on. I would like to start a class action suit

I am a victim of fraud. Several internet charges not mine drained my account. I only noticed when my utility payments all came back decline. I was just paid that day so I knew more than enough funds should have been available. I filed the fraud dispute paper work a couple of weeks ago. Not only have I not receive a credit covering the fraud loss but I have incurred close to $600 dollars in overdraft fees as the utility payments that declined have repeatedly tried to process. This along with more fraudulent attempts have created a scenario for us in that if we get our money back that resulted in fraud it will just go to Wells Fargo to cover them victimizing us in the way of overdraft fees that should have not incurred as we put our account on fraud hold. They refuse to correct the overdrafts. We need to file lawsuit to fight back against being victimized by the bank now.

I am being contacted by a collection agency due to this Wells Fargo account. When these charges first appeared on my account, I immediately contacted my local branch and told them I didn't make or authorize the 2 transactions. I was told not to worry no charges would be applied and the transactions would be returned. They lied and ran up NSF and overdraft fees until they reached over $1200, then sold the account to a collection agency. All the while I was under the impression the account had been closed.

I have had to pay 35 dollars for a 2 dollar atm fee that supposedly didn't post the same time the atm transaction posted. I have had to pay 35 dollars for buying a pack of gum that was 99 cent's. I have reteatidly asked for my transactions to decline if the funds arent available to avoid these fee's. The customer service rep confirms that my account has this overdraft prevention but it never works the way the customer service rep explained it would work.

Wells Fargo / Wachovia Bank held
current checks from deposits excessively for 5 day and cashed checks against then in order that a $35.00 over draft fee could be rendered. Paid Over $10,000 in one year because of these practices without explanation from the bank officials

I am currently experiencing some serious financial stress (new living situation coupled with taking the bulk of the expenses for my boyfriend and I), and Wells Fargo has ensured that I will never be able to get out of the red at this rate. Not only do they hold deposits/charges for days to process them at their greatest benefit, but they process, reverse, charge a fee and repeat until I'm paying NSF fees several times for the same transactions. I was a Wachovia customer before the merger and had no choice in becoming a part of Wells Fargo. I've had nothing but problems and been subject to shady business practices and am currently looking to join a credit union to get the heck out from under WF's thumb.

Case Details:
I have been charged for hundreds or thousands of dollars over the last several years, on numerous occassions with overdrafts typically occuring in groups of 2 to 4. It is evident that pending payments are often held for 2 or 3 days before being processed all at once whenever my account balance went low, resulting in multiple OD charges. Other times I have had charges process immediately the same day when my account was low, leading me to believe that Wells Fargo deliberately holds my charges so that it can bulk process them if my balance goes low. Furthermore, I never see a "pending" status on my auto loan payment, which would be helpful in showing me my actual account balance. Instead, my car payment is usually held for up to a week before it is processed without notice and often it has resulted in multiple overdraft charges as well. Along with Wells Fargo's admitted high-to-low payment processing practice it is clear that they deliberately shuffle their processing order to extract the maximum amount of OD fees from its customers, resulting in billions of dollars in revenue. Wells Fargo's representatives make the claim that they process high-to-low in order to grant priority to the most important payments, but this is a moot point because they don't bounce checks anymore and instead process payments regardless of the account balance. They are more than happy to charge their exorbitant overdraft fees, their predatory tactics are criminal, and they hurt the low income citizens the most, who are the least able to afford such high repeat fees. Wells Fargo should pay dearly for ripping off Americans for all these years.
