Regions Bank Rigged NSF Charges.
SPREAD THE WORD

      | 510 |      LEAD PLAINTIFF: jayccee      Case Filed: 2011-06-27
Case Summary:
Regions Bank rigged the NSF charges to benefit them the most. Instead of allowing items to clear independently they made money by bouncing multiple smaller transactions for that day.

Case Detail:
Regions would select only the smaller transactions to bounce instead of the larger. By doing this they would maximize the multiple 35.00 NSF charges. Instead of having just one NSF charge on the largest transaction, they would let that transaction go thru leaving no money left to cover all the smaller transactions. They did this on purpose. They also would mislead you into believing there was more money in your account than there actually was. Regions would temporarily match your last deposit. They did not do this on a regular basis, but they did do it at least twice a month on my account. For example I made a deposit of 200.00. The next day I would see my balance up by 400.00. There would be a double deposit of 200.00! on the computer ledger. Then it would disappear the next night.

Regions has consistently reordered our transactions to maximize the number of overdraft fees we encounter. They also show some transactions as clearing and the next day it is sent back even though it posted with funds to cover it on the previous day.

Regions is charging overdraft fees based upon pending activity in my account. For example. If I have a pending transaction that has not settled they are taking that money out and then charging overdraft fees on everything else that has cleared.

Regions bank took my smaller transaction that were pending and were covered and they over drafted my account to cover one larger transaction that was automatically drafted out but it wasnt suppose to come out until the next day when my paycheck went it in, but long story short they went ahead and processed the transaction a day ahead and covered it with the money I had in there for the smaller amounts I had used that were covered so they can charge me more that one NSF fee! And after I called and asks them about it they told me that's just how they process things and I said ok I will find another bank and ever since that day every 2 weeks my check goes into the bank they find a way to process my transactions so they can charge me as many NSF fees they can! THIS IS STEALING AND SOMETHING HAS TO BE DONE TO STOP THEM!

I had an automatic draft coming out of my account. I had an unexpected automobile mishap and had to use some of the money. Before the draft , I made a deposit to cover it. The next day, the draft was 5 charges down on the ledger, and other charges that had been cleared were now putting my account in overdraft by -341.00. I called the bank and was told that the largest amount goes in first and, and that the other charges were only pending. I wish I had printed the page because I'm sure those items had cleared. Something needs to be done about this. It seems illegal!

On numerous occasions I would have several things hitting the bank and if they would have hit the bank the way I did them there would not have been a problem. One time I actually had them bounce something because of a debit that was pending and it eventually dropped off the account but the nsf fee did not!

Case Details:
Earlier this year, I got into a situation where I knew one of my items would overdraw my checking account. I had one penny in my savings account. Since my savings account was linked to checking, Regions moved the penny, charged me $15 for that, then another $36 to pay the overdraft. Ok - no problem, although I thought it was supremely stupid to move a penny and charge me for it. But that started a domino effect. As a couple of deposits came in late and I had some additional medical and mechanical expenses I did not plan for, because I knew there was overdraft protection without the linked account, I updated my plan to include an overdraft of a single item with the overdraft fee. I made sure to give at least two or three days between other, much smaller items to clear before even trying to initiate another payment. It didn't matter. When the payment was initiated, the other items, in pending for days, were reordered with the largest item initiated that day going first. According to multiple responses from Regions, the only item in pending was the item initiated that day. Not true - I have screen shots for each day. Then they say that check card purchases are "frozen" against the account immediately when initiated. All of the items from the four day period were check card purchases, including the one in pending. To add insult to injury, each time I got hit with a boat load of fees, the pending check card item posted the same evening - again, other items in pending for days, not posted until potential for overdraft. In the past I have seen items sit in pending for up to seven days as long as the entire availability was there as if the person or system was waiting to see if potentiation would occur. Total hit between May and October 2013 = $1260. It would be $1404, but the first time I disputed they reversed the charge 'as a courtesy".

Case Details:
My wife and I have seen our account become depleted by the enormous amount of NSF charges that occurred over the past year. Regions would allow the larger charges to clear and penalize us for every single small transaction the same day. We have paid nearly 2000.00 in overdraft fees. We have had check on hold for nearly 30 days and other transactions have taken almost a week to clear. The ledger balance would show one amount and the next day we would see numerous overdraft fees. We have spoken with account representatives and were informed that Regions can hold any transaction for a month and that what we see on line is not what they see in the system. Their internet website is very misleading and their business practices should be investigated by the SEC.

Regions Bank has reordered my debt transactions largest to smallest instead of as they come thru, many times causing multiple small amounts to overdraft with fees instead of one large amount. Today they did it but with 6 different amounts, the largest being 8.73. So today I paid 216.00 in NSF on 36.37.

By doing this they would maximize the multiple 35.00 Overdraft/NSF charges Instead of having just one charge on the largest transaction, they would let that transaction go thru leaving no money left to cover all the smaller transactions. After over 10yrs of banking with Regions I had to let the account drop due to the excessive amount close to $1000.00. If I were to add it all up I would say I have paid over 8000.00 in fees.

am a Victim of Check Fraud. I received a letter on Sept.11, 2012, stating this company was seeking Secret Shoppers to monitor local businesses. The stated that I would be paid $ 200.00 to go into Pathmark and purschase goods. A Check for $1290.00 was made out to me. The letter stated, I should call 1-760-671-8981. I called the number and spoke with a Training Coordinator nameID#705 Victors. He, Victors told me about the secret shopper program and told me to deposit the check in my account and him the next day to see if the funds were avaliable. The next day the funds were availiable and I went to Pathmark and purchaseed a Reloadit money card then call Victor. He told me to scatch- joff the card and give him the numbers
Then, go to BestBuy. To do the same thing at BestBuy .I found out 11/16/12 that the Check did not exsist. That I was liable for 1290 check. I think the Bank should put 1290 dollars back into my checking acc.. What can I do to get money

While not a lot to some, several hundred in overdraft fees resulting from one check clearing at same time as numerous small purchases. Clearly shows on transactions that they were processed in order of biggest to smallest and that they processed this so they could charge me the maximum amount.

I've noticed when I have more money in the bank the post transactions faster. When I have less money they allow them to pend on my account longer and some transactions don't show up for days at a time. Posted 'pending" items will magically disappear, only to reappear later causing a dominoe effect of overdraft fees.

deposited a check in my wifes account via her atm yesterday 6pm - after closing with the intent of making the deposit in mine this morn. Regions cleared that check at 8am this morn opting to charge me $37 each for five previous lesser atm charges for a total of $180. i called to complain pointing out the Bank of America suit giving them the option of remove the charges or cancelling my account and they simply appologized and said they could do nothing. they did the same thing to me last year as well but i cucked it up.

I own a small business. When i first open the account, i stated that i do not want overdaft on my account. But now i received $282 of overdraft fee for one month. The bank agrees to return portion of my money out of the bank curtesy. I have filed a dispute, but still received anything yet. The representative told me to get my customer copy of the bank agreement when i first open the bank, it will have a place that i agree to opt in for overdraft. I brought the copy to the bank, however, there is no place anywhere in the copy that said that i have an option to opt-in for overdraft.
