Can my landlord deduct my California security deposit for repainting?

Paint is one of the most commonly misused deposit deductions, mostly because landlords treat "the walls need a fresh coat" as automatically chargeable. It isn't. The test is whether the condition goes beyond what normal living produces, and a repaint that would've happened between any two tenants doesn't clear that bar.

Age matters too, and it's the part landlords tend to skip. Paint has a useful life, and a unit painted five years before you moved in shouldn't be billed as if it were painted yesterday. A landlord who charges you full repainting cost on old paint is effectively asking you to fund an upgrade he was going to need anyway. If painting shows up on your itemized statement, ask what condition the paint was actually in, and how old it was at move-in, that single question resolves a lot of these.
